Case Synopsis & Summary

This bail application, under Section 438 CrPC, concerns four accused in Crime No.708/2022 of Edavanna Police Station, Malappuram, alleging offences under sections 341, 323, 324, 308, 427 and 506(ii) read with 34 IPC. The petitioners seek anticipatory bail in Bail Application No.1096 of 2023 before the Kerala High Court. The prosecution alleges that on the night of 23 December 2022, the petitioners assaulted the defacto complainant over political animosity related to a Panchayat election, with accused 1 allegedly beating the complainant on the head with an iron rod, causing injuries; others are said to have assaulted with their hands and damaged cars, causing an estimated loss of Rs.10,000. The defense submitted that the 3rd accused has already been arrested, rendering pre-arrest bail for him infructuous, and that there is a counter case against the complainant and others which is still under investigation. It was submitted that accused Nos.2 and 4 did not use weapons. The Public Prosecutor argued that arrest and custodial interrogation are necessary to recover the iron rod and to facilitate a meaningful investigation. After considering the case diary and medical wound certificate, the court dismissed the bail for the 1st and 3rd accused and granted anticipatory bail to accused Nos.2 and 4 with conditions.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners’ counsel submitted that accused Nos.1, 2 and 4 seek anticipatory bail while accused No.3 has already been arrested, making pre-arrest bail for him infructuous. They argued there is a counter case against the defacto complainant and others which is under investigation, and that accused Nos.2 and 4 did not use any weapon; the investigation requires that the 3rd accused’s arrest or pre-arrest bail not be obstructive. They urged grant of anticipatory bail to accused Nos.2 and 4 with appropriate conditions, emphasizing cooperation with the investigation.

Contentions of Respondents

The Public Prosecutor contended that arrest and custodial interrogation of the petitioners are necessary to recover the iron rod and to accomplish meaningful investigation. The case diary discloses a specific overt act by the 1st accused and attempts by the accused to interfere with or threaten witnesses; he also used a weapon. Since there is an ongoing investigation and potential risk of tampering, the prosecution argued against granting anticipatory bail to the 1st and 3rd accused, while supporting bail for accused Nos.2 and 4 with suitable conditions to ensure cooperation.
