Case Synopsis & Summary

The petitioners, farm labourers employed at various units of the Kerala Agricultural University (KAU) at Mannuthy, filed this writ petition seeking a mandamus to absorb them in the University service with retrospective effect under para 53 of the Supreme Court’s Umadevi (3) decision and related reliefs. They contend that though engaged through contractors on daily-wage terms, their status is that of workers of the principal employer, i.e., the University, and thus they merit regularisation under the cited constitutional jurisprudence. The University counters that the petitioners are workers of contractors and not direct employees of the University; hence regularisation is not owed. The petition relies on decisions such as Dasan v. State of Kerala, Payyannoor Education Society v. Narayani, Trivandrum Port and Head Load Workers Co-operative Society Ltd. v. Dhaneshkumar, and Moideen v. Gopalan. The court notes that para 53 in Umadevi (3) cannot be invoked for daily-rated employees, a position clarified by Satya Prakash and Others v. State of Bihar, which explains that para 53 relief is limited to irregular appointments and that daily wage workers fall under para 55, allowing competition in regular recruitment with age relaxation and weightage. The writ petition is disposed with a direction to the first respondent to consider the petitioners’ claims under para 55 in light of Satya Prakash, and to pass appropriate orders within one month.

Legal Doctrines & Maxims

  • Regularisation of irregular appointments under para 53 Umadevi (3) doctrine
  • Daily wage employees to be treated under para 55 with potential age relaxation and weightage (Satya Prakash)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that as farm labourers engaged through contractors for KAU, they are effectively workers of the University, the principal employer, and thus are entitled to absorption in service, with retrospective effect, under para 53 of Umadevi (3). They cited Dasan, Payyannoor Education Society, Trivandrum Port and Head Load Workers Co‑operative Society Ltd. v Dhaneshkumar, and Moideen v Gopalan as supporting authorities for regularisation and status as University workers. They urged the court to apply para 53 (and para 55 in the alternative) and direct retroactive regularisation and related relief.

Contentions of Respondents

The respondents urged that the petitioners are workers of contractors, not direct University employees; regularisation under para 53 is inappropriate for daily wage/daily rated employees. They submitted that the one-time relaxation in para 53 was limited to irregularly appointed employees, per Satya Prakash, and that daily wage employees fall under para 55, which permits competition in regular recruitment with age relaxation and weightage. They asked the court to deny absorption and require recruitment procedures instead.

RAVIKUMAR, J.** - - - - - - - - - - - - - - - - - - - - - - - - - - - - ## **W.P. (C) Nos. 25524 OF 2010** - - - - - - - - - - - - - - - - - - - - - - - - - - - - Dated this the 20[th] day of August, 2010 ## **J U D G M E N T** The petitioners who are Farm Labourers working at different farms of the Kerala Agricultural University, Mannuthy filed this writ petition mainly seeking for the issuance of a writ of mandamus commanding the respondents to absorb them in its service with retrospective effect in the light of para 53 of the decision of the Honourable Apex Court reported in **Umadevi (3)' s case (2006)4 SCC I** and such other consequential as also alternative reliefs. They are labourers engaged through the contractors, on daily wage basis. According to the petitioners they are to be treated as workers of the respondent University as it is their principal employer and they are serving for its benefit. To buttress their contention they relied on the decisions in **Dasan V. State of Kerala & Others(ILR 1990(1) Kerala 55), Payyannur Education Society V. Narayani(1995(1)KLT - 21), Trivandrum Post and Head Load Workers Co operative Society Ltd., V. Dhanesh Kumar (2000(3) KLT 10)** and **Moideen V. Gopalan (1995(2) KLT 349).** But WPC.No. 25524/2010 : 2 : according to the University the petitioners are workers of contractors and therefore, they are not entitled to seek the benefit of regularisation relying on the aforesaid decisions. However, considering the admitted status of the petitioners as daily rated employees, I am of the view that the petitioners cannot seek the benefit of para 53 of **Umadevi (3)' s case (2006)4 SCC I)** . The said position was clarified by the Apex Court in **Satya Prakash and Others vs. State of Bihar and Others (2010(4)SCC 179)** . In the aforesaid decision, the Honourable Apex Court held that the one-time relaxation in para 53 was granted only in favour of irregularly appointed employees and further that the case of daily wage employees have been dealt with in paras 55 of Umadevi(3). It was also held therein that in the case of daily rated employees the only benefit granted under the said decision was to permit them to compete in regular recruitment process by giving them age relaxation and due weightage. Therefore, I am of the view that the petitioners are not entitled to claim the benefit of para 53 of Umadevi(3) decision. The learned counsel for the petitioners though, initially, attempted to sustain the claim for regularisation changed the stand and confined his argument canvassing the position that the petitioners are entitled to get WPC.No. 25524/2010 : 3 : the benefit of paragraph 55 of Umadevi(3) decision. I am also of the view that the entitlement of the petitioners to the benefits under para 55 of the aforesaid decision in the light of the decision of the apex court reported in **Satya Prakash and Others vs. State of Bihar and Others (2010(4)SCC 179)** is to be looked into by the respondents. 2. The learned counsel appearing for the petitioners submits that while considering the said question the respondents are also bound to consider the decisions of this court reported in **Payyannoor Education Society vs. Narayani(1995(1)KLT 621), Trivandrum Port and Head Load Workers Co-operative Society Ltd. Vs. Dhaneshkumar(2000(3) KLT 10) and B. Dasan Vs. State of Kerala & Others(ILR 1990(1) Kerala 55).** According to the learned counsel the said decisions are relevant in the context of the contentions of the respondents that the petitioners are workers of contractors. In the said circumstances, this writ petition is disposed of with a direction to the first respondent to consider the claims of the petitioners for getting the benefit of para 55 of the decision reported in **State of Karnataka vs. Umadevi (2006(4)SCC I) in the light of Satya Prakash and Others** WPC.No. 25524/2010 : 4 : **vs. State of Bihar and Others (2010(4)SCC 179).** While taking such a decision, the respondents shall also look into the decisions reported in **Payyannoor Education Society vs. Narayani(1995(1)KLT 621), Trivandrum Port and Head Load Workers Co-operative Society Ltd. Vs. Dhaneshkumar(2000(3) KLT 10) and B. Dasan Vs. State of Kerala & Others(ILR 1990(1) Kerala 55)** . Appropriate orders based on such consideration shall be passed by the first respondent within a period of one month from the date of receipt of a copy of this judgment. Sd/- **(C.T.
