## **JUDGMENT**
## **Dated this the 29th day of May 2020**
The petitioners in these writ petitions are applicants under the sports quota for admission to the professional courses in the State of Kerala under the Kerala Engineering Architecture Medical Entrance Examination (KEAM), 2019 conducted by the Commissioner for Entrance Examinations. The petitioners in both the writ petitions had applied for admission in the MBBS course under the sports quota.
2. It is contended that the prospectus specified that applications under the sports quota have to be submitted along with copies of all relevant certificates of achievements by 28.02.2019. The petitioners challenge the eligibility of respondents 6 and 7 to be included in the sports quota for admission to professional courses in the year 2019. It is contended that the last date for submission of online application as per the prospectus was initially fixed as 28.02.2019 which was later extended to 04.03.2019. The last date for submission of documents in support of the eligibility for admission in the sports quota was 31.03.2019. It is contended that a reading of the relevant provisions of the prospectus would make it clear that the eligibility

conditions for admission in the sports quota was to be ascertained as on the last date for submission of the applications.
3. It is stated that revised eligibility criteria for sports quota was issued by Government Order dated 07.03.2019, which was under challenge in W.P.(C) No.18203/2019. A draft eligibility list was prepared by the Commissioner on the basis of priority and grace marks and the writ petitioners were included as serial Nos.21 and 71. The 6[th] respondent was included as serial No.56 and the 7[th] respondent as serial No.11. However, a final eligibility list was prepared with the petitioners being shown as serial Nos.23 and 74 with 58 and 43 marks respectively, while the 7[th] respondent was included as serial No.1 with 76 marks and the 6[th] respondent was included as serial No.61 with 50 marks. It is stated that later, a category wise list in rank order was issued on 28.06.2019 for admission to the sports quota. The petitioners in these writ petitions were ranked as 5 and 6 respectively while respondents 6 and 7 were ranked as 4 and 1 respectively. It is stated that the documents produced as Ext.P7 in W.P.(C) No.23341/2019 and Ext.P10 in W.P.(C) No.21685/2019 would reveal that the Kerala team did not secure the first three positions in the South Zone Men and Women Senior competitions and as such, the claim of the 6[th] respondent is doubtful. Reliance is also placed on documents and

photographs from the website of the 5[th] respondent to show that the claim of the 7[th] respondent is dubious since the first place in SAF Games was acquired after 04.03.2019, which is the last date for submission of applications.
4. It is contended that while admitting W.P.(C) No.21685/2019, an interim order had been rendered on 07.08.2019 making the admission of respondents 6 and 7 subject to the outcome of the writ petition and that therefore, the issue is liable to be considered on merits. It is stated that though ample material was produced before the respondents to show that the claim of respondents 6 and 7 was dubious and could not be taken note of for the purpose of deciding eligibility for admission to professional courses in the year 2019, the Commissioner has proceeded to issue notices of allotment to respondents 6 and 7 and they have been enabled to secure admission and continue their studies.
5. It is contended that W.P.(C) No.18203/2019 was filed challenging the revised eligibility criteria fixed by Government Order dated 07.03.2019 and that the decision rendered in the said writ petition would have no bearing on the present writ petition since the veracity of the certificates produced by respondents 6 and 7 are called into question on the basis of reliable documents in the instant writ petitions. It is contended that if the eligibility of

**==> picture [45 x 8] intentionally omitted <==**
respondents 6 and 7 is found against, the petitioners would be entitled to admission in the seats which had been allotted to respondents 6 and 7 wrongly.
6. The learned counsel for the petitioners places reliance on the decision of a Division Bench of this Court in **Simi Raj** v. **Commissioner for Entrance Examinations** [1999 KHC 669] to contend that the conditions in a prospectus have to be construed strictly and a candidate cannot be permitted to rely on material which is obtained after the last date fixed for submission of applications. The decision of a Division Bench in **Sainulabdin** v. **State of Kerala** [1995 KHC 362] is also relied on to contend that the court cannot direct the consideration of the claim of a student except as otherwise specifically provided in the prospectus.
7. The decision of the Apex Court in **Charles K. Skaria and others** v. **Dr. C. Mathew and others** [(1980) 2 SCC 752] is relied on to contend that eligibility is to be decided taking note of the last date fixed for submission of the application. The decision in **Nidhi Kaim and another** v. **State of Madhya Pradesh and others** [2017 KHC 6121] is relied on to contend that where admission is gained to a professional course by exercising fraud, the candidates who have completed the course would not be entitled to reap the benefits of fraud practised by them. Reliance

is also placed on the judgment of the Apex Court in **M. Siddiq (D) thr. L.Rs** v. **Suresh Das and Ors.** [AIR 2018 SC 5134] to contend that a prior judgment would be a binding precedent only in respect of the questions which have been specifically decided therein and cannot bar a litigation on different questions. The decision of the Madhya Pradesh High Court in **Dharmendra Singh Shakya** v. **State of M.P. and others** [2018 KHC 4224], the decision of the Manipur High Court in **Md. Tarif Ali** v. **State of Manipur and others** [2017 KHC 5706] and of the Jammu and Kashmir High Court in **Competent Authority, Entrance Examinations, J. & K. and another** v. **Mahesh Kumar Jia Lal Raina and another** [2016 KHC 3406] are also relied on by the learned counsel for the petitioners.
8. In W.P.(C) No.21685/2019, a statement has been placed on record by the 3[rd] respondent, the Kerala State Sports Council and the 4[th] respondent, the Atya Patiya Kerala State Association has also filed a counter affidavit. In both the writ petitions, counter affidavits have been placed on record by the 7[th] respondent. Reply affidavits have also been filed. It is contended by the learned Government Pleader that even if respondents 6 and 7 are found ineligible for admission under the sports quota, the petitioners in these writ petitions would not be eligible for

**==> picture [52 x 8] intentionally omitted <==**
admission on the basis of their eligibility and the marks secured by them. It is further contended that the issue with regard to eligibility for admission had been specifically considered in W.P.(C) No.18203/2019, which was filed by the petitioner in W.P.(C) No.21685/2019 and another applicant and this Court had found that the petitioners therein have no manner of claim for admission under the sports quota. The writ petition was accordingly dismissed. No appeal was preferred against the said judgment by the petitioner. The said writ petition was disposed of along with W.P.(C) Nos.17920/2019, 17995/2019, 18376/2019, 19257/2019 and 20720/2019. Writ appeals were preferred against the judgment in W.P.(C) Nos.20720/2019 and 19257/2019. Writ appeals were disposed of by Ext.R7(a) judgment interfering to a limited extent. Civil Appeals were also preferred against the said judgment, which were dismissed on 5.9.2019. It is submitted that the present attempt is only to raise issues of eligibility, which, if such disputes were bona fide, ought to have been raised at the time of filing of the initial writ petition itself. It is stated that the present attempt of the petitioners to rake up matters, which have been given a quietus by this Court as well as the Apex Court after considering all relevant aspects, is an abuse of process of court.

9. A statement has been placed on record by the 3[rd] respondent in W.P.(C) No.21685/2019 specifically stating that the proficiency claimed by respondents 6 and 7 had been verified on the basis of the original certificates issued to them, which had been produced by the respective candidates. It is stated that the genuineness of the certificates had been countersigned by the concerned State Associations. It is further stated in the statement in paragraphs 6 and 7 as follows :-
“6. It is further submitted that the 5[th] South Asian Atya Patya Championship 2018-2019 in which the 7[th] respondent has secured the 1[st] position is not an invitational tournament as clarified by the Atya Patya Federation vide letter No.APF1/139/A/19 dated 12.03.2019. A true copy of the aforesaid letter is produced herewith and marked as Annexure R3(a). This being a senior championship approved by the south Asian countries priority No.25 has been assigned to the 7[th] respondent and 76 marks has been awarded. Whereas, the 6[th] respondent has won the third place in the 6[th] Men and Women Senior South Zone National Atya Patya Championships. Therefore the same has been included under priority No.51 and 50 marks have been awarded.
7. The proficiency claimed by the 6[th] and 7[th] respondents have been verified on the basis of the original certificate issued by the concerned National Federation. None of the grounds raised by the petitioner are tenable either in law or on facts. It is respectfully submitted that the writ petition is devoid of any merit and is liable to be dismissed. It is accordingly prayed for.”
WP(C).Nos.21685/2019 & 23341/2019
-: 12 :-
10. The counter affidavit filed by the 4[th] respondent in W.P. (C) No.21685/2019 also supports the stand of respondents 6 and 7. Though reply affidavits have been filed by the petitioners and documents have also been produced in support of the contentions therein, I find from the pleadings on record that the question of eligibility of respondents 6 and 7 for admission under the sports quota is vouched for not only by the respective Associations which have issued the certificates to them but also by the Kerala Sports Council after a due verification.
11. Having considered the contentions advanced and in the light of the facts and circumstances of the case, I am of the definite opinion that this Court would not be justified in embarking on an exercise of verification of the certificates produced by respondents 6 and 7 in an attempt to find out whether they are in accordance with the requirements of the prospectus. This is more so because a batch of writ petitions challenging the provisions of eligibility had already been decided by this Court in W.P.(C) No.18203/2019 filed by the petitioner in W.P.(C) No.21685/2019. The findings of the learned Single Judge were not challenged by the petitioner in W.P. (C) No.21685/2019. Though appeals were preferred by other aggrieved parties against the common judgment, the said issue
WP(C).Nos.21685/2019 & 23341/2019
**==> picture [52 x 8] intentionally omitted <==**
also stands settled by the decision of the Apex Court in Civil Appeal Nos.7025 and 7026 of 2019.
In the above view of the matter, this Court would not be justified in granting the prayers sought for in these writ petitions. The writ petitions fail and the same are accordingly dismissed.
