## **J U D G M E N T**
Petitioners in all these writ petitions are applicants who appeared in the entrance examinations for admissions to Kerala Engineering/Pharmacy/Architecture/Medical and Medical Allied Courses (KEAM) 2020 and NEET for admission to undergraduate professional courses. All of them belong to communities eligible for reservation for admission. The common complaint is that they could not upload the non-creamy layer certificate in support of their claim and they are treated as candidates in General category.
2. The petitioner in W. P. (C) No.21439/2020 applied for appearing in the entrance examinations KEAM 2020 as well as NEET 2020. She belongs to Muslim community. Based on her application, the village officer issued her Ext.P1 non-creamy layer certificate and Ext. P2 income certificate on 05.12.2019, for central education purpose. She uploaded the very same certificates for NEET as well

as KEAM. Producing Ext.P5 the admit card issued to her on 03.07.2020 for appearing in the entrance examination for admission to Engineering courses on 16.07.2020 and her profile Ext.P5 downloaded from the KEAM website, she states that her community status was shown as general instead of Muslim eligible for reservation for Socially and Educationally Backward Community (SEBC). On enquiry she was given to understand that her claim for reservation was rejected since she did not upload the certificates for state education purpose along with her application. She therefore obtained Ext.P3 non-creamy layer certificate dated 30.09.2020 from the Village Officer and Ext.P4 income certificate dated 29.09.2020 from the Village Officer; but she could not upload the same. Thereupon she submitted Ext.P6 email and Ext.P7 representation to the Commissioner for Entrance Examinations on 01.10.2020 requesting for correction of her community status as Muslim (OBC) and to permit her to upload the certificates

Exts.P3 and P4 so as to enable her to claim reservation.
3. In W.P.(C).No. 21455/2020 petitioner passed her Higher Secondary School Examination with 97.6% marks. She belongs to Islam (Muslim) community eligible for reservation for SEBC. She applied for appearing in the KEAM 2020 examination as well as NEET. In Ext.P2 confirmation page of KEAM 2020, the category claimed was shown as MU-Muslims (all actions following Islam) and in the application she stated that she uploaded certificates in proof of date of birth, nativity, non-creamy layer certificate/community certificate (income certificate) along with her application dated 15.02.2020. She appeared in the KEAM 2020 examination held on 16.07.2020 for admission to Engineering courses based on Ext.P3 admit card. She appeared in the NEET (UG) 2020, held from 13.09.2020 based on Ext.P4 admit card where also her category was shown as OBC (NCL). Her case is that based on her

application for non-creamy layer certificate before the Village Officer specifically stating that it was for the purpose of admission to professional courses in educational institutions under the Government of Kerala, Ext.P5 non-creamy layer certificate was issued to her on 16.12.2019. She had uploaded the same along with her applications for KEAM and NEET. Seeing that her name was not included in the preliminary list of reserved candidates published on 01.10.2020, she submitted Ext.P6 representation dated 02.10.2020 requesting the Commissioner for Entrance Examinations to include her in the reserved category. By Ext.P7 email dated 02.10.2020 she was informed that she did not upload the non-creamy layer certificate for state education purpose and she did not rectify the defects despite a memo issued to her in the web portal and hence her claim in the application, for reservation as Muslim (SEBC) was rejected and she was included in the general category. It is stated that Ext.P5 certificate issued

to her was one for employment purposes. Petitioner stated that she was ranked as 3474 under general category in KEAM 2020 preliminary list. It is also stated that by the time she received Ext.P7 memo, the
time granted for curing defects was over on 28.09.2020. Petitioner claims that no individual memo was issued to her regarding the defects and therefore she submitted Ext.P8 representation dated 03.10.2020 before the Minister for Higher Education requesting to permit her to upload the proper non-creamy layer certificate. She thereafter got Ext.P9 non creamy layer certificate for education purpose on 06.10.2020. But she was unable upload it. It is stated that she would get around 605 out of 720 marks in NEET and hence there is a fair chance for her to get admission in Government College itself in case she is included in the category list of candidates with reservation for SEBC.
4. The petitioner in W.P.(C).No. 21474 of 2020 belongs to Ezhava community eligible for reservation

under SEBC. She submitted Ext.P1 application for admission to KEAM on 14.02.2020 uploading all certificates in proof of date of birth, nativity, non-creamy layer certificate, community certificate, etc. She had also submitted application for NEET 2020 based on which Ext.P2 admit card was issued to her and she appeared in the examination. It is stated that that the Tahsildar issued Ext.P4 non creamy layer certificate on 11.11.2019 and she uploaded the same along with her application. But the non-creamy layer certificate which was accepted for NEET 2020, was not accepted for KEAM 2020. She therefore submitted Ext P4 application before the Village Officer on 11.09.2019 for issuing a non-creamy layer certificate in the prescribed format. It is stated that the Village Officer was on leave from 15/9/2020, due to his father's ailment till 6/10/2020. The condition of his father was critical and he passed away on 30.09.2020 and the Village Officer resumed officer only on 06.10.2020. As soon as he resumed

office, he issued Ext.P5 certificate on 06.10.2020 in the prescribed form. But by that time the time permitted for uploading non creamy layer certificate was over. It is stated that the petitioner made several attempts to login to the website for uploading the certificates she was denied access. It is stated that the provision for uploading the documents was closed on 29/9/2020. Therefore she submitted Ext.P7 representation before the
Commissioner for Entrance Examination requesting to permit her to upload the certificate. According to petitioner, when the very same certificate was accepted for NEET (UG) 2020 for appearing in the entrance examinations. She had obtained the certificates as early as in November 2019. According to petitioner, in case the village officer was not on leave or in case there was anybody in the office who could issue the non-creamy layer certificate, she could have been able to upload the same when opportunity was given to cure defects till

29.09. 2020. Petitioner claims that even now time for uploading certificates for NRIs is not over and also because the results are not published so far, she should be allowed to upload the certificates as it was not because of any fault on her part that the issuance of non-creamy layer certificate based on her application dated 11.09.2020 happened to be delayed.
5. Sri. V. Manu, the learned Senior Government Pleader on instructions furnished the entire procedure followed by the Commissioner for Entrance Examinations starting from 07.11.2019 till date. It is stated that the Commissioner for Entrance Examination had issued notification dated 07.11.2019 announcing the schedule of entrance examination for KEAM 2020. It was followed by another notification issued on 26.11.2019 informing all concerned that the proceedings for submission of application for KEAM 2020 would commence in January 2020 and in order to avail benefits of category/reservation all eligible candidates should upload relevant category

certificates along with their Online application form. Another notification was issued on 23.12.2019 again informing the candidates that they should get themselves ready with all the certificates in advance for uploading the same along with their online application, specifically stating that the certificates that would be uploaded along with the online application, alone would be accepted. Applications were invited for KEAM by notification issued on 31.01.2020 specifically providing in Clause
6 that the candidates have to upload their photograph, all the documents and eligibility certificates, certificates in proof of the date of birth, nativity reservation, etc., on or before 29.02.2020 05.00 p.m. It is stated that the KEAM prospectus was approved by Government on 31.01.2020 and uploaded in the website on 02.02.2020 which contains a specific provision in Note(i) of Clause 5 to the effect that claims for Special/Mandatory reservation should be made by a candidate in the

online application itself and supporting documents shall be uploaded to the online application within the stipulated time, specifically stating that claims made after the submission of online application will not be entertained and even if supporting evidences are produced the claims for special and mandatory reservation once made in the application cannot be altered by the candidate under any circumstances. In clause 5.4.2 (a) and (b) thereof specifically provided that candidates belonging to socially and economically backward classes (SEBC) should upload to the online application a certificate to the extent that the candidate belongs to the community which is designated as SEBC and does not belong to the category of creamy layer, in the proforma given as Annexure V of the G.O.(P) No. 1/2015/BCDD dated 01.01.2015. It is stated that the communities which are included in SEBC are given in Annexure xi of the prospectus. In sub clause (b) of 5.4.2 provided that candidates belonging to Ezhava, Muslim, other

backward Hindu, Latin catholic and Anglo Indian, Dheevara and related communities, other backward Christians and Kudumbi communities claiming reservation under SEBC quota should invariably upload the non-creamy layer certificate in the prescribed format for State government Education purpose obtained from the Village Officer concerned. Another press release was issued on 15.02.2020 alerting the candidates about the last date for submission of applications. By notification dated 24.02.2020 the last date was extended till 29.02.2020. A press release was issued on 28.02.2020 informing that there will not be any further extension. The petitioners in all these cases have submitted their applications on or before 29.02.2020. Again on 11.05.2020, the Commissioner issued another notification requesting the candidates to verify their profile and rectify the defects and to submit the requests for rectification before 05.00 p.m., on 25.05.2020. It was followed by another notification issued on

07.09.2020 again granting time to candidates till 10.09.2020 asking them to verify their profile and to rectify defects if any in the photograph, signature, fee, documents/certificates, etc., uploaded along with their applications, alerting them that defects which would be cleared within the specified time alone would be considered for allotting any claim/reservation and that further opportunity would not be given for rectification. The entrance examination was held on 16.07.2020. On 28.07.2020, another notification was issued informing the candidates that they can view their profiles and check the details of their claim for reservation status and other benefits in their profile and that they can view defects if any in their online applications by clicking the menu item “Memo details” provided in the profile page. The candidates who submitted defective certificates for EWS quota and NRI quota seats also can rectify the defects by submitting corrected certificates in time. However as

per notification dated 18.08.2020 another opportunity was given to the candidates till 27.08.2020 to cure the defects in the certificates or documents, stating this time also that no further time would be given. The KEAM Scores were published on 09.09.2020 and the rank list for admission to Engineering and Pharmacy courses were published on 24.09.2020. Again in notification dated 24.09.2020 one more opportunity was given to the candidates as a last chance, stating that requests were received from several candidates who uploaded defective certificates. Candidates were asked to view their profile in the portal and to rectify the defects from 25.09.2020 to 28.09.2020 again stating that it would be the last chance. It is stated that the activities relating to central allotment process to Professional Degree Courses for the year 2020-21 commenced on 30.09.2020 inviting online options for Engineering and Pharmacy courses. The provisional category wise list of candidates who applied for admission to Engineering and Pharmacy

courses and who were allowed with eligible communal reservation/special reservation/reservation under persons with disability was published on 01.10.2020 and final category list was published on 03.10.2020 on which day trial allotment was also made. It is stated that the first phase of allotment commenced on 07.10.2020. The rank list for Architecture course was published on 11.10.2020; category-wise list of candidates for admission to the said course, allowed with reservation was published on 11.10.2020. Therefore the learned Govt. Pleader points out that petitioners did not avail the opportunities which were available to them from 07.11.2019 onwards well before the outbreak of Covid-19 pandemic and thereafter till 29.09.2020 producing the relevant documents. Relying on the judgments dated 14.08.2020 and 14.09.2020 in W.A.No.1080/2020 and W.A.No. 1183/2020 respectively and the judgments dated 12.08.2020 in W.P.(C).No.16518/2020, judgments dated 23.9.2020 and 04.10.2020 in W.P.(C) No. 16518/2020,

18
17368/2020 and 20844/2020, the learned Government Pleader argued that petitioners cannot be granted any relief.
6. I have considered the rival contentions on either side. According to the petitioners the respondent would open the site for enabling the candidates who have applied against NRI quota; the results for NEET are yet to be published; therefore no harm would be caused to anybody if an opportunity is given to them to upload the correct certificates.
7. In the case of the petitioner in W.P.(C) No. 21439/2020 it is pointed out that she happened to lose her opportunity given on 24.09.2020 only because the Village Officer was on leave. She had uploaded the certificates for central government purpose issued on 5.12.2019, which was accepted for NEET. Thereafter though she submitted application for the correct certificate for State Government purpose, on 11.09.2020, the Village Officer who was on leave could issue the certificate only on 06.10.2020 when

he re-joined.
8. It is seen that none of the petitioners have produced the certificates as required in clause 5.4.2(a) and (b) of the prospectus which was published on 02.02.2020, where it is specifically stated that they have to upload the certificates as required in Annexure V of the G.O.(P) No.1/2015/BCDD dated 19.01.2015 and that they should invariably upload the non-creamy layer certificate in the prescribed format for State Government Education purpose obtained from the Village Officer concerned. As rightly pointed out by Sri. V. Manu the learned Senior Government Pleader, there was sufficient time available for the petitioners to apply and obtain the certificate along with their application itself before 29.02.2020 well before the outbreak of Covid19 pandemic and even thereafter when opportunities were provided several times till 24.09.2020 each time alerting that no further opportunity would be given. Though it is quite unfortunate for the petitioner in

20
W.P.(C) No. 21474 of 2020, that she could not avail the opportunity made available from 24.09.2020 to 28.09.2020 when her application was pending from 11.09.2020, a further opportunity cannot be directed to be given to the candidates by this court, when the competent authority has fixed the dates and has given multiple chances to the candidates. Those who apply for professional degree courses should be vigilant enough to submit their applications along with the requisite documents as required in the prospectus. Along with the application the candidates are submitting a declaration (as seen from the confirmation page) to the effect that they have downloaded and read various clauses in the prospectus and agreeing to abide by them. In case they had read and understood the provisions in the prospectus properly they would have submitted the relevant certificates along with the application itself or would have got it cleared when opportunities were given further.

9. Moreover similar claims of candidates who did not upload the requisite documents at the relevant time were rejected by the Division Bench, after elaborately considering the procedure adopted by the Commissioner for Entrance Examinations and with reference to the case law on the subject in the judgments in W.A.No.1080/2020 and W. A.No.1183/2020 respectively. In the judgments in W.P.(C).No. 16518/2020, 17368/2020 and 20844/2020 also similar claims were rejected. It is also pertinent to note that in the judgment in **Sainulabdin v. State of Kerala** [1995 KHC 362], relied on by the learned Government Pleader, the Division Bench of this Court has held that failure to submit the income certificate in the form prescribed for that purpose, as provided in the prospectus, along with the application would render the application defective and the candidate cannot seek a remedy on the strength of such a detective application under Article 226 of the Constitution. In the light of the

judgment also petitioners cannot be granted any relief. Though Sri. Praveen, the learned counsel for the petitioner in one of the writ petitions relied on
the judgment reported in **Chairman NRI Service and Educational Trust v Kerala University of Health Service and others** [2014(3) KLT 312] and argued that the petitioner should be treated as a candidate eligible for reservation, in the light of the judgments of the Division Benches in 1995 and also in 2020, the said contention cannot be accepted. There are sufficient number of candidates who have submitted the valid claims for reservation uploading the requisite documents at the relevant time.
In view of the above circumstances, I am of the view that petitioners do not reserve any relief in these writ petitions. Accordingly these writ petitions are dismissed.
