Case Synopsis & Summary
The petitioners are Deputy Tahsildars in the Revenue Department aspiring for promotion to the post of Tahsildars. They are included in Ext.P1 final seniority list of Deputy Tahsildars and were included in Ext.P2 dated 17.11.2007. Ext.P2 was operated and 40 persons were promoted as per Ext.P3 order. The petitioners contend that there were 14 more vacancies in the post of Tahsildars and three vacancies arose in December 2007. Altogether 17 vacancies of Tahsildars were available even in December 2007. But the Government did not effect further promotions to the post by operating Ext.P2 select list and hence the writ petition. On 21.1.2008, this court directed the Government Pleader to get instructions as to whether there are vacancies in the post of Tahsildar consequential upon promotion of 10 persons as Deputy Collectors as per Ext.P4. A statement was filed by the respondents stating that 17 vacancies arose in December 2007 due to retirement on 30.11.2007, but promotions were not effected for reasons including non-finalisation of the seniority list and an unrelated revision issue (G. Viswanatha Pillai). The court recognised the Government’s discretion to decide whether to fill vacancies but directed a time-bound decision. It directed that if vacancies are to be filled, Ext.P2 should be utilized as long as it remains in force, and if not, reasons must be communicated within two months. The petitioners were asked to obtain a copy of the judgment and petition, and to present representations to the first respondent to facilitate the decision.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioners argued that the existing vacancies in the post of Tahsildars (17 in December 2007) and the Ext.P2 select list should be acted upon and vacancies filled, as per the recommendations of the Departmental Promotion Committee. Ext.P1 (final seniority list) and Ext.P2 (select list) demonstrate entitlement to promotions, and the Government cannot indefinitely withhold promotions when vacancies exist; the court should direct timely action and ensure Ext.P2 remains operative.
Contentions of Respondents
The respondents submitted that the Government possesses discretion to decide whether to fill vacancies and is not bound to fill posts. The seniority lists were not finalised, and there are other competing issues (e.g., Viswanatha Pillai’s revised seniority). The Government argued that Ext.P2’s currency and validity must be considered and that Rule 30 of Part II of KSSR provides a mechanism to revise seniority lists; thus, promotions may be withheld for justified reasons and not as a matter of right.

| Case Name | Citation | Treatment | Explanation |
|---|---|---|---|
| Thankaraj v. State of Kerala | ILR 1996(3) Kerala 733 | Mentioned Only | Counsel cited the case to support the argument that revision of a seniority list (UDC) does not automatically revise the Deputy Tahsildars’ seniority; the court did not adopt or rest its decision on this ratio. |
| M.P.Raghavan Nair v. State Insurance Officer | 1971 KLT 583 | Mentioned Only | Cited by counsel regarding seniority revision but the court did not base its decision on this authority or endorse its ratio. |
