Case Synopsis & Summary

These are consolidated writ petitions challenging the extension of suspension of a bank employee and seeking reinstatement with full subsistence salary pending completion of disciplinary proceedings. The second respondent, Secretary in-Charge under suspension, was placed under suspension on 25.01.2023 in connection with VACB investigations under the Prevention of Corruption Act, IPC offences (sections 406, 409, 420, 465, 468, 471, 477A, 120B). The Managing Committee sought a further six-month extension beyond the initial period, with prior approval required by Rule 198(6) of the Kerala Cooperative Societies Rules, 1969. The Registrar rejected the extension by Ext.P6 dated 19.01.2024. WP(C) Nos.3239/2024 and 6407/2024 challenge that decision, while WP(C)5680/2024 is filed by the employee seeking quashing of the suspension and payment of subsistence allowance from 26.07.2023 onward and reinstatement. The court, after hearing, held that Rule 198(6) restricts suspension beyond one year without Registrar’s prior approval, acknowledged delays in initiating disciplinary proceedings, and found the Registrar’s rejection proper. Consequently, WP3239/6407 were dismissed, while WP5680/2024 was allowed: the petitioner is to be reinstated forthwith and subsistence allowance payable within two months, with further directions as required. The decision reflects a cautious approach to indefinite suspensions and emphasizes necessity and proportionality in disciplinary processes.

Provisions of Law Cited

Prevention of Corruption Act, 1988 – Section 13(1)(c)(d) read with Section 13(2)Indian Penal Code – Sections 406, 409, 420, 465, 468, 471, 477A, 120BKerala Cooperative Societies Rules, 1969 – Rule 198(6)Kerala Cooperative Societies Act – Section 83(1)(j)Kerala Payment of Subsistence Allowance Act, 1972

Legal Doctrines & Maxims

  • Not to keep a person indefinitely under suspension; suspension must be necessary for completion of disciplinary proceedings.
  • Rule 198(6) of the Kerala Cooperative Societies Rules, 1969 – no employee shall be kept under suspension for a continuous period exceeding one year without prior approval of the Registrar.
  • Power to suspend is governed by need and necessity on facts; indiscriminate extension erodes justice.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that Ext.P6 (the Registrar’s order rejecting extension of suspension) is impermissible or at least quasi-judicial to be stayed, relying on interim orders and the broader principle that suspensions should not be indefinite while the disciplinary process unfolds. They argued that the extension was sought before the expiry of the original suspension period and that the registrar’s power to grant prior approval under Rule 198(6) should be exercised liberally where there is legitimate need, ongoing enquiries, and risk of interference with bank operations. They urged reinstatement or at least the maintenance of suspension extensions where necessary to protect bank interests.

Contentions of Respondents

The respondents asserted that Rule 198(6) restricts suspensions beyond one year without prior Registrar approval; Ext.P6 correctly refused extension, given delays in disciplinary proceedings and the need to safeguard bank interests. They argued that the Registrar’s decision is consistent with statutory framework and jurisprudence such as Suresh V. and Mohammedkutty, and that indefinite suspension is not justified by the facts. They maintained that the order to reinstate is not proper in context of ongoing investigation and disciplinary process.

Since a common issue arises in all these cases between the same party, the petitions are heard together and common judgment is passed. 2. W.P.(C) No.3239 of 2024 is taken as a leading case and the facts in brief as follows: The 2[nd] respondent was suspended from service with effect from 25.1.2023 as the Vigilance and Anti-Corruption Bureau (VACB) registered cases against the 2[nd] respondent under Sections 13(1),(c),(d) read with Section 13(2) of the Prevention of the Corruption Act 1988 and under Sections 406, 6 WPC 3239, 6407 & 5680/24 409, 420, 465, 468, 471, 477A and 120B of the Indian Penal Code. Ext.P3 is the suspension order dated 25.1.2023. Since the original period of suspension was about to end, the Managing Committee decided to extend the same by a further period of 6 months. The said extension was due to expire on 24.1.2024. On 22.11.2023, the Managing Committee took a decision that the enquiry was not finalised, so the suspension has to be extended for another period of 6 months and decided to get prior approval from the Registrar of Co-operative Societies as mandated under Rule 198(6) of Kerala Cooperative Societies Rules, 1969 (for short ‘the Rules’). After the decision, Ext.P5 was issued to the 1[st] respondent seeking permission for extension by a period of 6 months from 25.1.2024. The 1[st] respondent considered the request of the petitioner and by Ext.P6 letter dated 19.1.2024, took a conscious decision to reject approval for extension of the suspension. Being aggrieved by the rejection of the request for 7 WPC 3239, 6407 & 5680/24 extension of suspension, The Managing Committee impugns Ext.P6 in this Writ Petition. 3. In the meanwhile, after the rejection of the request of the Managing Committee for extension of the suspension of the 2[nd] respondent, she filed a petition on 25.1.2024 before the Assistant Registrar (General), Muvattupuzha, complaining that she is not reinstated even after the extension sought is rejected. The Assistant Registrar (General), Muvattupuzha, by letter dated 25.1.2024, directed the Managing Committee of the bank to reinstate the employee forthwith. W.P.(C) No.5680 of 2024 is filed by the employee for quashing the suspension order and for a direction to the respondents to pay full salary as subsistence salary from 26.7.2023 onwards as envisaged under Rule 198(6) of the Rules, 1969 and to reinstate the petitioner. 8 WPC 3239, 6407 & 5680/24 4. At the time of admission of W.P.(C) No.3239 of 2024, an interim order was passed by this court staying Ext.P6 to the extent of rejecting the request for extension. 5. A counter affidavit is filed in W.P.(C) No.3239 of 2024 by the 2[nd] respondent, wherein it is contended that the Writ Petition is not maintainable as Ext.P6 order passed by the Joint Registrar is appealable under section 83 (1)(j) of the Kerala Cooperative Societies Act. The allegation raised that the 2[nd] respondent, along with the Managing Committee in the office, misappropriated an amount of 65 lakhs, is incorrect and baseless. It is after 6 years of the alleged mis-appropriation that the _defacto_ complainant filed a complaint to VACB and FIR is registered on 23.7.2022. It is true that the 2[nd] respondent was placed under suspension by the order of the Managing Committee based on the direction of 1[st] respondent Joint Registrar. The Joint Registrar directed the bank on the basis of the direction issued by the Government, which is 9 WPC 3239, 6407 & 5680/24 impermissible in law. As per Rule 198(6) of the Rules, the Registrar is only having the authority to give prior approval for extending the suspension exceeding one year. 6. The learned counsel for the 2[nd] respondent relied on two judgments of this court in S **uresh V. v. The Joint Registrar (General) [2018(3) KLT 320]** and **Mohammedkutty v. Secretary to the Government (2002 KHC 183)** . As per rule 198(6) of the Rules, in no case no employee can be kept under suspension for a term exceeding one year without prior approval. The Registrar has rightly rejected the request to extend the suspension. After the expiry of the suspension period, though the petitioner approached the bank to reinstate her, they did not permit her to join and therefore, a letter was submitted to the Assistant Registrar (Muvattupuzha) to take steps to reinstate her and he directed to reinstate her forthwith. 10 WPC 3239, 6407 & 5680/24 7. The counsel for the petitioner in W.P.(C) Nos.3239 as well as in 6407 of 2024, Sri.P Mohanan argues that the Assistant Registrar ought not have issued further direction to reinstate the petitioner, since Ext.P6 rejection is already stayed. 8. He further argues that since the order passed by the Assistant Registrar is a dependent order, the same need not be separately challenged though as a matter of fact, the Managing Committee has filed W.P.(C) No.6407 of 2024 for quashing the said order also. 9. The counsel for the petitioner in W.P.(C) No.5680 of 2024 has relied on the judgment of this Court in L **eelamma** **Augustine M. v. Kerala State Cooperative Rubber Marketing Federation Ltd. [2008 (2) KHC 148]** to contend for the proposition that merely because the enquiry proceedings 11 WPC 3239, 6407 & 5680/24 are not over, it is not proper to keep a person under suspension ## for an indefinite period in a mechanical manner. ## Paragraph 3 of the said judgment reads as follows: “3. It is a salutary principle of law that a person should not be kept indefinitely under suspension, particularly when, there is no shred of material on record that the continued suspension of that employee is necessary for the appropriate completion of the disciplinary proceedings. It is also not the principle of law that a person under suspension should be continued in such status during the entire disciplinary proceedings. While sub-rule (6) of R.198 of the Kerala Cooperative Societies Rules, 1969, for short the "Rules" provides that no employee shall be kept under suspension for a period exceeding six months at a time and that no employee shall be kept under suspension for a continuous period exceeding one year without the prior approval of the Registrar, the power to keep an employee under suspension in terms of that provision is not an authority to continue a person under suspension for the entire periods that is permissible under that provision of law, except in cases where that is required. That is also not enjoined. The power to keep an employee under suspension in terms of R.198(6) has to be understood in such a mariner that it stands controlled by the need and necessity that may be, on the facts, situation and circumstances of each case. Otherwise, the exercise of that power, merely by reference to the Rule, would erode justice.” 10. The employee was suspended as per order dated 25.1.2023. Ext.P3 in W.P.(C) No. 5680 of 2024 is the charge memo dated 23.6.2023 issued to the petitioner as part of the 12 WPC 3239, 6407 & 5680/24 disciplinary enquiry. In response to Ext.P3, the employee filed Ext.P5 reply requesting for the documents as stated in the memo of charges. Thereafter, another charge memo as Ext.P7 is issued on 5.9.2023. Thus, it can be seen that though the employee was placed under suspension on 25.1.2023, the charge memo as well as statement of allegations were issued only on 23.06.2023 and 5.9.2023 respectively, after a lapse of five to eight months. It is after this, that the Managing Committee decided to extend the period of suspension and sought prior approval from the 1st respondent, Joint Registrar for extending suspension beyond the period of one year. A perusal of the documents produced on the side of the petitioner as well from the respondents show that the delay in initiating disciplinary proceedings is definitely on the Managing Committee of the Bank. The request of the Managing Committee for extension of the period of suspension is rejected by Ext.P10 order dated 19.1.2024 by the Joint Registrar. One 13 WPC 3239, 6407 & 5680/24 of the reasons stated is that the Managing Committee could not point out that criminal cases are pending against the employee and that the vigilance enquiry is only in the preliminary stage. It is taking note of this fact that the Joint Registrar declined to approve for extension of time beyond one year. 11. In the affidavit filed by the 3[rd] respondent in W.P.(C) No.5680 of 2024 in paragraph 7, it is stated as follows: “7. In the said request the bank stated that she was suspended as per the direction of the Vigilance and AntiCorruption Bureau and as directed by the Joint Registrar of Co-operative Societies. The continuance of the petitioner in office would give opportunity to her to tamper the documents which she has access. Hence the retention of the petitioner in the office pending enquiry would adversely affect the interest of the bank also. In the meanwhile the bank has issued memo of charges and the reply filed by the accused found unsatisfactory an Enquiry Officer was appointed and he started the enquiry and now about 7 sittings are over. It is learned that enquiry would be completed in the middle of March provided petitioner cooperate.” 14 WPC 3239, 6407 & 5680/24 The above statement would show that the enquiry is in the final stage and the time frame by which the enquiry is to be completed is less than a period of 3 weeks from today. Therefore, at this point, keeping the employee under suspension has been taken note of by the Joint Registrar, which has rightly rejected the request for an extension of suspension. On going through the averment and documents produced, I am of the firm view that the Joint Registrar has rightly declined the request of the Managing Committee for extension of period of suspension beyond the period of one year. The delay of 8 months in even issuing charge memo by the disciplinary sub committee also stands against the Managing committee for extending the term. Therefore, I am of the view that the petitioner in W.P.(C) No.5680 of 2024 is entitled to be reinstated in service forthwith. The employee is also eligible for subsistence 15 WPC 3239, 6407 & 5680/24 allowance as per Rule 198(6) of the Kerala Co-operative Societies Rules, 1969, and also under the Kerala Payment of Subsistence Allowance Act, 1972. If any amounts are due towards subsistence allowance in terms of the said Allowance Act, the same also shall be paid within a period of 2 months from the date of receipt of a copy of this judgment.
