## **JUDGMENT**
These writ petitions are filed seeking regularisation of service of the petitioners who are contract employees engaged under the NORKA ROOTS, which is the Government of Kerala undertaking. It is stated that the petitioners had been engaged in various capacities on contractual basis. When the contracts were not renewed, the petitioners had approached this Court seeking reinstatement and regularisation in service. It is stated that the petitioners had been appointed after undergoing a due process of selection and that the termination of the appointments was without any reason and without giving the petitioners any opportunity to state their case. It is stated that, the contract appointment of 33 persons was terminated without any notice and that the action of the respondents was completely unjustified.
2. The petitioner in W.P(C)No.23906/2017 was appointed as Accountant in the office of the 2[nd] respondent as per Ext.P3 Appointment Order dated 28-02-2011. It is stated that a contract was

entered into and the petitioner was placed in a consolidated salary of Rs.12,000/- (Twelve Thousand only). It is stated that thereafter, the pay was enhanced to Rs.14,000/- (Fourteen Thousand only) with effect from 01-07-2012 and the petitioner's services were extended for a further period of two years from 17-03-2013. It is stated that by Ext.P4(b), the petitioner's services were further extended at a consolidated pay of Rs.16,000/- (Sixteen Thousand only). Thereafter by Ext.P5 proceedings, the term of contract was further extended by three years from 19-032016. While so, it is stated that by Ext.P7 order dated 27-05-2017, the contract is unilaterally cancelled and the term of the contract was curtailed as one year and the petitioner had been sent out of service. Seeking retention in service on the basis of a later daily wage engagement granted to the petitioner, the petitioner had approached this Court and an interim order had been granted ordering retention of the petitioner in service. Thereafter, by order dated 27-09-2017, the interim order was vacated.
3. The petitioner in W.P(c)25292/2017 also challenges Ext.P7 order dated 27-05-2017, by which her appointment as Confidential Assistant has been terminated. The challenge is on identical grounds. In the said

7
writ petition, no interim order is granted and the respondents were given time to place pleadings on record.
4. In W.P(C)No.12287/2018 the petitioners challenge Ext.P1, which is the order dated 27-05-2017 produced as Ext.P7 in the other two writ petitions. However, challenge raised by 12 of the persons whose services had been terminated by the said order, is raised after one year of the termination.
5. A detailed counter affidavit has been placed on record in each of these writ petitions. It is contended that the petitioners had been appointed after a selection process. The appointment was specifically on a contract basis and the contract entered into between the employer and employee clearly stated the terms of the appointment. It is stated that though permission was sought for from the Government for sanctioning posts and for making regular appointments, the request had been rejected by the Government. It is therefore stated that the appointments were not against sanctioned posts and that as such, the terms are as provided in the contract between the parties. It is further contended in the counter affidavit that the NORKA ROOTS was initially formed as a Society under the Societies Registration Act and later

8
incorporated as a public limited company. It is stated that these writ petitions filed for specific performance of a contract of service are not maintainable as against the respondents and the petitioners can only claim damages for breach of the contract, if any.
6. The learned counsel places reliance on decisions of the Apex Court in _**State Bank of India and others v. S.N.Goyal [(2008) 8 SCC 92], Union of India and another v. Kartick Chandra Mondal and another [(2010) 2 SCC 422] and Gridco Limited and another v. Sadananda Doloi and others [(2011) 15 SCC 16].**_ It is contended, relying on _**S.N.Goyal's case (supra),**_ that the question of granting reinstatement on the basis of a contractual appointment would not arise especially in view of the non statutory character of the NORKA ROOTS which is only a public limited company. It is stated that where employment is governed purely by contract, even when the employer is a statutory body, a contract of personal service will not be specifically enforced. It is further contended that the Apex Court in _**Gridco Limited's case (supra)**_ has held that the power of judicial review cannot extend to the Court acting as an appellate authority sitting in judgment over the decision even of a statutory authority. It is stated that so long as the action taken by the

9
authority is not vitiated by _malafides_ or arbitrariness and so long as it is not demonstrably outrageous, interference by this Court would not be justified. The decision in _**Kartick Chandra Mondal (supra)**_ is relied on to contend that where notice pay is accepted by the employees, the further challenge against the termination will not be maintainable.
7. I have considered the contentions advanced on either side, it is clear that the petitioners had been appointed under the respondent after a selection process. However it is averred that such appointments were not against sanctioned posts. The respondent had approached the Government seeking sanction for the post held by the petitioners. However, such sanction was declined.
8. In the above view of the matter, the Board of the respondent constituted a sub committee to consider the issue and on consideration of the report submitted by the sub committee, a decision was taken to terminate the services of the persons who had been appointed as against the posts which did not have the sanction of the State Government. The impugned order reproduces the provisions contained in the contract of employment. It is stated that the notice pay has also made available to the petitioners. In view of the fact that the

10
petitioners had not been appointed against the sanctioned posts and since the respondents do not have the financial resources necessary to pay the salaries due to the petitioners, I am of the opinion that the petitioners, who were contract employees cannot have a claim for regularisation against posts which do not have Government sanction. The contention of the petitioners that certain other persons who had been appointed on similar terms, had been regularised, earlier in point of time, also will not come to the aid of the petitioners, since the petitioners have not succeeded in establishing any sustainable claim for regularisation.
In the facts and circumstances of the instant case, I am of the opinion that the prayers sought for in these writ petitions cannot be grant. The writ petitions fail and the same are accordingly dismissed.
