## **JUDGMENT**
1.W.P.(C).No.9934 of 2022 is filed seeking directions to the respondents to appoint the petitioners as Mid Level Service Providers (Staff Nurses) (hereinafter referred to as “MLSP” for short) based on their ranks in Exts.P2 and P3 against the existing vacancies and those likely to arise before the expiry of Exts P2 and P3 within a time limit to be fixed by this Court. As also seeking directions to the respondents not to fill up the 124 vacancies each in Kottayam and Ernakulam Districts otherwise than by appointing candidates included in Exts. P2 and P3.
- 2.The prayer in W.P.(C).No. 14560/2022 is for a direction to respondents 2 to 13 to fill up all existing vacancies from the present ranked list in their respective districts. The petitioners therein are persons included in the ranked lists for

the districts of Thrissur Idukki, Thiruvananthapuram, Wayanad, Kannur, Palakkad, Malappuram, Kollam, Pathanamthitta and Alappuzha respectively. The parties and documents are being referred to as in W.P.(C).No.14560 of 2022, unless otherwise stated.
- 3.Heard the learned counsel for the petitioners and the learned standing counsel appearing for the respondents.
4.The petitioners in these writ petitions are persons included in the ranked list published for selection to the post of MLSPs (Staff Nurses) by the District Program Managers under the National Health Mission (hereinafter referred to as “NHM” for short). Exhibit P1 was the notification. Exhibit P2 is the ranked list for Thrissur district, while Exhibit P3 is for Idukki district, Exhibit P4 is for Thiruvananthapuram, Exhibit P5 is for Wayanad, Exhibit P6 is for Kannur, Exhibit P7 is for Palakkad, Exhibit P8 is for Malappuram, Exhibit P9 is for Kollam, Exhibit P10 for Pathanamthitta and Exhibit P11 for Alappuzha. Exhibits P2 and P3 in W.P.(C).No.9934 of 2022 are

the list published for Kottayam and Ernakulam districts respectively. The learned counsel for the petitioners contend that the validity of the ranked lists was specifically mentioned as two years or until all candidates have been advised, whichever is earlier. It is submitted that even before the expiry of the ranked lists, fresh notification was issued on 10.3.2022, which is produced as Exhibit P4 in W.P.(C).No. 9934 of 2022 and Exhibit P12 in W.P.(C).No.14560/2022. The short contention of the petitioners is that the attempt by the respondents to conduct a fresh selection when the ranked lists already published after due selections are still in force is violative of the rights of the persons included in the list.
5. This Court in 23.3.2022, had passed an interim order in W.P. (C).No.9934/2022 that the proceedings pursuant to Exhibit P4 notification shall not prejudice the right of the petitioners guaranteed under Exhibit P1 notification, particularly at the bottom of Exhibit P2 ranked list. The learned counsel for the petitioners contend that since the ranked list specifically stated that they would be in force for two years or till all

11
candidates are advised, whichever is earlier, the respondents cannot conduct any selection before the expiry of the two year period.
6. A detailed counter affidavit has been placed on record by the respondents. It is stated therein that NHM, Kerala is a health mission under a registered society, the State Health and Family Welfare Society. The mission is a joint venture between the Central and State Government with monetary contributions from both. Since the mission is a project depending for its existence on extension of the project every financial year by the Union Government and its implementation being on consensus between the Union and State Governments, it has no statutory existence, rules or regulations, service rules, sanctioned posts or cadre. In Kerala, it is run by personnel provided by Government/quasi Government institutions on deputation and by personnel engaged on contract basis. It is stated that there is no continuity in service for any employee and that the list prepared are also only for contract appointments. It is stated
W.P.(C).Nos.9934 & 14560/22
12
that the Government of India had brought out the comprehensive policy on primary healthcare through health and wellness centres in 2018, based on which it was decided to set up health and wellness centres across the nation to augment the services available at the lower levels of healthcare facilities. The concept envisages primary healthcare institutions to focus on preventive healthcare and family well being rather than their traditional role of being curative centres. In the year 2019-20, 728 sub centres were proposed to be upgraded as Health and Wellness Centres in the Program Implemented Proposals and was approved by the NHM. In the year 2021, the NHM, Kerala proposed 825 subcentres to be upgraded with the approval in the Record of Proceedings for 2020-21. It is stated that after deliberations at various levels, a decision was taken by the NHM, Kerala that Staff Nurses would be recruited as Mid Level Service Providers to be posted in the Family Health Centres and they would be trained and certified through IGNOU/other State Public Health /Medical Universities for a set of competencies in delivering public health and primary healthcare services.
W.P.(C).Nos.9934 & 14560/22
13
As a part of the initial discussion a curriculum was also fixed for the training. It is stated that by Exhibit P1 dated 24.12.2020, applications were invited for selection of 1603 staff nurses in all the 14 districts. The notifications specified that the number of candidates proposed could increase or decrease according to appointments and that a live ranked list would be prepared from which additional requirements may be recruited. It was specifically made clear in Clause 10 of Exhibit P1 that the NHM reserved the right to fill up or not fill up even the posts advertised and the qualification would be B.Sc./GNM Nursing with one year post qualification experience. All the candidates would be giving training for four months and thereafter posted as MLSPs. It is contended at paragraph 12,14 and 15 of the counter affidavit as follows:-
“12, That, NHM through the Center for Management Development conducted a written test and after interviews prepared select lists for each district. It was the SMD, Kerala who initiated and implemented the selection and publication of the rank list. The respective District Program Managers [DPMs] published the district select lists forwarded to them such as by Exhibits P -2 and P — 3. The endorsement at the bottom of Exhibit P — 2 is merely surplusage by the third

14
respondent and is not a binding edict in his capacity as the recruiting/selecting authority. This is why such an endorsement is not there in Exhibit P3 list by another DPM, the fourth respondent. Neither the third nor the fourth respondent were entrusted the function of preparing select lists of Staff Nurses and they were merely exercising the ministerial function of announcing the select lists to the candidates who were likely to be engaged on contract by the NHM in their districts.
**==> picture [201 x 8] intentionally omitted <==**
14.That, it is a fact that in order to get trained manpower of 1603 Staff Nurses, the NHM has so far had to train 1738 persons. The payment effected during the minimum training period alone worked out to Rs.68000/per Staff Nurse. In the present context. the financial burden to ensure placement of MLSP in the field works out to Rs.11.81 Crores.
15.That the NHM being a Project depending on its existence on provisions made in the Union budget and Central assistance extended year to year to the State does not have its own Rules and Regulations, service or staff Rules or a regular cadre strength. The NHM only engages staff on deputation from the Central/State Governments or Organizations under such Governments or engages employees on contract for a maximum period of one year which is on the 31[st] day of March every year. If for the next

15
FY the PIP submitted by the State NHM is approved by NHM, New Delhi through the RoP for the next year, adequate funds are provided by the Central and State Governments to implement the scheme in which the employee is engaged on contract, if the scheme is implemented in priority by NHM, Kerala, over other schemes for which sanction has been accorded but funds for all the scheme have not been provided by the Central and State Governments and if the employee clears performance appraisal for the previous FY, then and only then are fresh engagements on contract offered to the employees with a break on 1[st ] April of the next FY and commencing on 2[nd] of April till 31[st] of March of the said FY, In short, even the engagement from the select lists are only for a maximum period of one year without assured continuity of service, even on contract.”
7. It is submitted that 1738 persons had been engaged from the ranked list for the 1603 advertised posts and the replacements for those who resigned or dropped out were also made from the ranked list. It is stated that the NHM, New Delhi has now permitted engagement of another 1510 MLSPs. When the NHM, Kerala reviewed its experience gained over the last one year, it is found that an enormous amount of Rs.11.81 crores had been expended to train the
W.P.(C).Nos.9934 & 14560/22
16
MLSPs and to bring them at par to render the service required. It is stated that at the relevant time, there was no other alternative since there were no staff nurses who had undergone MLSP training as part of their curriculum. It is stated that the MLSP training in now part of Nursing and Post B.Sc Nursing Curriculum and that the first batch of students who have undergone this updated curriculum, including MLSP training have just passed out in the second half of the calendar year 2021. It is submitted that since more than the notified number of vacancies had already been filled up from the ranked lists, it was decided that a fresh selection should be conducted. It is contended that the persons included in the ranked list pursuant to the notification dated 24.12.2020 have absolutely no right to insist that appointments should be made from the lists since the stipulation regarding period of validity stated in some of the lists is a clear error made by the District Programme Managers without any authority of law and cannot be relied on by the persons included in the list to contend that they shall be appointed from the list to all further vacancies as well.
W.P.(C).Nos.9934 & 14560/22
17
8.The learned counsel for the petitioners would contend that the fresh notification issued also provides for qualification only as per Exhibit P1notification and that there is no specific qualification provided or even weightage given to persons who have completed MLSP training as part of their curriculum. It is, therefore, contended that the arguments raised are without merits.
9.The learned counsel for the respondents would contend that stipulation regarding validity of ranked list which is relied on by the petitioner finds a place in the ranked lists issued for the districts of Idukki, Thiruvananthapuram, Palakkad, Malappuram, Kollam and Pathanamthitta, but was conspicuously absent in the case of the lists issued for the districts of Thrissur, Wayanad, Kannur and Alappuzha. It is, therefore, contended that the prescription of the validity of the list was not one made by the appointing authority who alone would have the power to prescribe such a validity and that the same was supplied by the district officers who had no authority to do so.
W.P.(C).Nos.9934 & 14560/22
18
10.Having considered the contentions advanced and in view of the fact that the selection conducted pursuant to Exhibit P1 was only for appointment on a contract basis for 1603 posts and since it is not disputed that more than that number of advices have already been made from the lists, I am of the opinion that the petitioners, who stand included in the list would have no right to contend that they should be appointed from the list. The notification specified the number of vacancies available for contractual appointments and further specified that the NHM reserves the right to fill up or not to fill up the posts advertised. It is trite law that participation in a selection process and the resultant inclusion in a ranked list will not confer any right on the candidates to insist that they are entitled for appointment. The decision of the Apex Court in **Balu S.S and another v. State of Kerala and others** [2009 KHC 85] and of a Division Bench of this Court in **Vinod Kumar M.K. v. State of Kerala and others** [2022 (2) KHC 664] are two decisions on the point. A selection conducted and a ranked list prepared for filling up specified number of
W.P.(C).Nos.9934 & 14560/22
19
vacancies normally ceases to be operative when the notified vacancies are filled up from the list. The position would be different only in cases where the statutory Rules or the Rules of Procedure applicable provide for a period of validity of the lists prepared and state that vacancies arising during the validity of the list shall be filled up from the said list. In the instant case, the notification was issued for making contractual appointments to the specified vacancies. The notification did not contain a provision with regard to validity to the list. The right, if any, of the petitioners arise only from the stipulation in certain of the ranked lists that they would remain in force for two years. However, in view of the fact that the appointing authority contends that there was no such stipulation or intention in the conduct of the selection and since only some of the lists contain the said stipulation, I am inclined to accept the contention that the said stipulation was the result of an error or mistake committed by the District Programme Managers. If that be so, the reasons stated by the respondents for conducting a fresh selection cannot be found fault with. Those of the petitioners, who are eligible and
W.P.(C).Nos.9934 & 14560/22
20
qualified would be entitled to submit their applications in pursuance to the later notifications as well. Since it is the specific case of the 2[nd] respondent that there was never any intention to keep the list alive to fill up more than the number of vacancies which had been notified, I am of the opinion that the prayers as sought for cannot be granted. The writ petitions fail and the same are accordingly dismissed.
