Case Synopsis & Summary

These two connected writ petitions challenge actions within the General Education Department concerning leadership appointments and disciplinary actions at VPM Higher Secondary School, Vellarada. In WP(C) 37635 of 2022, the petitioner I. Bindu, a retired teacher-in-charge, seeks mandamus to compel the Government to disqualify the manager (5th respondent) and to appoint the petitioner as Headmistress with effect from 01/04/2019 to 31/05/2022. In WP(C) 4428 of 2023, the Manager of VPM Higher Secondary School questions Ext.P28 and Ext.P30 orders and prays for quashing and for consideration of Ext.P31, along with mandamus directing the 1st respondent to decide Ext.P31 promptly. The petitions are connected; the court disposes of them by a common judgment. The judge directs the 1st respondent to consider Ext.P31 in WP(C) 4428 within two months from receipt of a copy of the judgment and to issue appropriate orders, with notice to petitioners. Depending on the Ext.P31 decision, the Manager is to take steps in accordance with law, and petitioners must furnish certified copies of the judgment for compliance. The order embodies a time-bound task to resolve the leadership dispute and ensure due process in school governance.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners argue for prompt judicial relief to resolve leadership disputes at VPM Higher Secondary School. WP(C) 37635 seeks mandamus to disqualify the 5th respondent-manager and to appoint the petitioner as Headmistress with effect from 01/04/2019 to 31/05/2022; WP(C) 4428 targets quashing Ext.P28 and Ext.P30 and seeks consideration of Ext.P31, challenging the government’s actions and urging early redress. The petitioners contend that there has been a chain of orders and inquiries affecting the school’s governance and want the court to streamline appointment processes, dispense with translations, and ensure compliance with law.

Contentions of Respondents

The respondents’ stands are that due process must be observed through the established administrative channels. They emphasize the need to rely on Ext.P31, Ext.P28, Ext.P30 and related records, ensuring due process and proper consideration of complaints, inquiries, and disciplinary actions before any appointment orders are passed. They seek judicial supervision only to the extent necessary to ensure lawful and timely action by the education department.
