The petitioner in W.P.(C).No.16162 of 2022 was included in the EWS quota on the basis of the EWS certificate issued on 24.11.2021. Later, the village officer submitted a report before the Tahasildar recommending cancellation of the certificate and seeking action against the petitioner's father for giving false statement and affidavit. The petitioner was put on notice and heard and Exhibit P1 order dated 7.1.2022 was passed by the Tahasildar cancelling the certificate on finding that the monthly family income of the petitioner was more than Rs.25000/-. The petitioner submitted Exhibit P2 appeal 6 W.P.(C).Nos.30183/21 & 16162/2022 before the RDO. W.P.(C).No.1760/2022 was also filed by the petitioner and by Exhibit P3 judgment, this Court directed the consideration of Exhibit P2 preferred by the petitioner before the RDO. The parties were heard and Exhibit P6 order was passed, which is under challenge in the writ petition. 2.The learned counsel for the petitioner submits that the notification pursuant to which the petitioner had submitted application was dated 29.1.2020. It is, therefore, contended that what must be considered is the family income of the petitioner as on the said date and that the cancellation of the income certificate on the ground that the family income of the petitioner was more than Rs.25,000/- per month as on 24.11.2021 is completely illegal, since the family income as on 24.11.2021 is completely irrelevant. It is further submitted that the petitioner had earlier obtained the certificate from the village officer for production before the recruitment board in accordance with G.O(MS) No.2/2020/P.A.R.D Thiruvananthapuram dated 12.12.2020 W.P.(C).Nos.30183/21 & 16162/2022 7 and the village officer had issued the said certificate after conducting all necessary enquiries. It is submitted that the basic pension of the petitioner's father was only Rs.15164/per month and that the full pension of the petitioner's father during January, 2020 was below Rs.25000/-. It is submitted that the finding that the income was more than Rs.25000/was based on subsequent pay revision which occurred in November, 2021 and that the income in 2021 is not relevant. It is further submitted that the petitioner got married on 2.9.2020 and that the family income to be assessed is, therefore, the income of the petitioner and his wife and that the father's income cannot be taken into account at all. 3.The learned counsel for the petitioner places reliance on the decision of the Apex Court in **State of Gujarat and others v. Arvindkumar T.Tiwari and another** [ 2012 KHC 4503] and of a Division Bench of this Court in **Kerala Public Service Commission v. Reshmi K.R and others** [2019(5) KHC 875]. W.P.(C).Nos.30183/21 & 16162/2022 8 4.The 2[nd] respondent in W.P.(C).No.16162/2022 has filed the earlier writ petition that is W.P.(C).No.30183/2021 seeking removal of the name Manu Mohan from the supplementary list of EWS in Exhibit P6 list and seeking directions to the 2[nd] respondent to advice and appoint the petitioner as RMO from the said list. It is submitted that the inclusion of Sri.Manu Mohan in the list was completely illegal, since the said person is the son of a retired Government employee and was not eligible for any certificate for inclusion in the EWS quota. It is submitted that the very action of the recruitment Board in having considered the application, which was not accompanied by a proper EWS certificate in accordance with the notification and having granted him time to produce a certificate in compliance with the notification was erroneous and that the said candidate has absolutely no right for being included in the EWS quota. It is contended that the notification specifically provided the criteria and the format of the certificate to be obtained for claiming the benefit of EWS and that the petitioner was the only candidate meeting the criteria and having the proper certificate. It is submitted W.P.(C).Nos.30183/21 & 16162/2022 9 that in view of the fact that the EWS certificate granted to the petitioner in W.P.(C).No.16162/2022 now stands cancelled, his name has to be removed from the list and the petitioner is eligible for appointment. 5.Counter affidavits have been filed by the RDO, the Government and as well as the party respondents. The pleadings disclose that the petitioner in W.P. (C).No.16162/2022 had submitted an application and claimed the benefit of the EWS quota. The notification contained the specific criteria for availing the EWS quota. Admittedly, the petitioner had produced a certificate which was not in accordance with the notification, but was one issued in terms of G.O(MS) No.2/2020/P.A.R.D dated 12.12.2020. The candidates were called for interview on 23.11.2021. On noticing that the EWS certificate produced by the petitioner in W.P.(C).No.16162/2022 was not one obtained in accordance with notification, the petitioner was given a week's time to produce a certificate in accordance with the notification. Thereafter, the petitioner produced the W.P.(C).Nos.30183/21 & 16162/2022 10 certificate dated 24.11.2021. It appears that the petitioner in W.P.(C).No.30183/2021 submitted a complaint before the Tahasildar and the village officer, alleging that the family income of Sri.Manu Mohan was evidently more than Rs.25000/- per month and that therefore the certificate issued by the village officer on the same day of the submission of the application was erroneous and unsustainable. The village officer submitted a report to the Tahasildar, who, after issuing notice to and hearing the parties, came to the conclusion that the family income of Sri.Manu Mohan was more than Rs.25000/- and that the certificate issued was liable to be cancelled and that the certificate was so cancelled. Sri.Manu Mohan submitted an appeal and approached this Court for consideration of the same. This Court directed the consideration of the representation by the RDO and ordered status quo to be maintained till then. The RDO again heard the parties, considered the matter and found that the cancellation of the certificate was proper. W.P.(C).Nos.30183/21 & 16162/2022 11 6.The ground raised by the writ petitioner against the order of the RDO is that the family income as on the date of issuance of the notification had not been considered by the RDO. As a matter of fact, the RDO has considered the specific contention of the petitioner that his family income in January, 2020 ought to have been considered. The RDO found that the certificate was issued on 24.11.2021 on an application submitted on 24.11.2021. The certificate is specifically with regard to the income as on the date of the application and therefore, what is to be considered is the current income and not the income on any earlier date. The respondents also contend that the pension revision which is relied on has retrospective effect from 1.4.2019 and even if the contentions of the petitioner are accepted, the family income would be as shown in the pension book with retrospective effect from 2019. 7. The petitioner had admittedly applied for an income certificate with regard to his family income on 24.11.2021. The village officer had issued the certificate on the basis of 12 ## W.P.(C).Nos.30183/21 & 16162/2022 the statements and the affidavits of the petitioner's father. Subsequently, on a complaint raised by the rival claimant, it was found that the statement with regard to family income was incorrect and that the family income was more than Rs.25000/- at the relevant time, since the pension of the petitioner's father alone exceeded Rs.25000/- as on 24.11.2021. This aspect has been specifically considered in the order of cancellation as well as the order issued by the RDO on directions by this Court. 8. In the decision relied on by the learned counsel for the petitioner in W.P.(C).No.30183/2021, it was held that fixing eligibility for a particular post falls within the exclusive domain of the legislature/executive and cannot be the subject matter of judicial review. It was further held that courts should refrain from interfering in matters of appointment unless the appointments so made or the rejection of candidature is found to have been done at the cost of fair play, good conscience and equity. W.P.(C).Nos.30183/21 & 16162/2022 13 ## 9.In **Kerala Public Service Commission v. Reshmi K.R.** **and others** [2019(5) KHC 875], a Full Bench had considered the question of following of instructions to applicants and held that in case of defects committed despite clear instructions, there cannot be any relaxation of instructions and there would be no scope of judicial review in such matters. 10.In the instant case also, the petitioner had been required to submit an income certificate in terms of the notification. He could produce the income certificate as provided in the notification only on 24.11.2021. In view of the fact the said certificate stands cancelled, the application of the petitioner is not supported by any income certificate which would make him eligible for inclusion in the supplementary list for EWS and therefore he can be considered only as a general candidate. In the above view of the matter, I do not find any legal infirmity in the cancellation of the candidature of the petitioner in W.P.(C).No.16162 of 2022 in the EWS quota. In the factual circumstances of the instant case and in view of W.P.(C).Nos.30183/21 & 16162/2022 **==> picture [12 x 8] intentionally omitted <==** the pleadings advanced on either side, the order under challenge in the writ petition also cannot be considered. W.P. (C).No.16162/2022, therefore, fails and the same is accordingly dismissed. W.P.(C).No.30183 of 2021 is allowed.
