Case Details & Bench

Court
High Court of Kerala
Hon'ble Judges
  • The Hon'ble Mr. Justice Amit Rawal
Judgment Date
2022-03-30
Court Decision / Holding
Writ petitions are sans merit and are accordingly dismissed. The court emphasized that while private unaided schools enjoy autonomy in fixing fees, the court cannot generally intervene to micromanage day-to-day fee-structures, especially in the absence of income disclosures and in light of the schools’ own reductions during the pandemic. It also acknowledged that relevant directives from Indian School, Jodhpur (2021) exist but would not automatically govern the 2021-2022 cycle. The matter regarding fee reductions for 2022-23 remains to be seen in light of evolving circumstances.
Final Disposition
Writ petitions dismissed; no mandatory fee-reduction direction issued; court recognizes school autonomy but emphasizes minimal interference in private school fee decisions.

Case Synopsis & Summary

Two writ petitions were heard together: WP(C) No. 11410 of 2021 (and connected matters) filed by a large group of parents of wards studying in Global Public School, Thiruvaniyur, and other affiliated institutions, and WP(C) No. 14518 of 2021 filed by parents of students in Campion School, Edappally. The petitions sought a writ of mandamus directing the schools to grant a 15% reduction in fees for the academic years 2020-2021 and 2021-2022, with a further prayer for the schools to disclose expenditure for those years and for the CBSE and the Deputy Director of Education to ensure that only actual expenses are charged and that there is no profit. The petitions argued that COVID-induced income loss and increased online-education expenses made fee payment burdensome, and that schools should not profit during the pandemic. The court noted that the supremacy of school autonomy in fee fixation under unaided private schools is recognised by the Supreme Court in T.M.A Pai Foundation and Modern Dental College, and that the Indian School, Jodhpur decision directed a 15% reduction but in the context of that Court’s own facts. The Kerala High Court held that it cannot micromanage school fee structures, especially in the absence of income disclosures from petitioners, and that schools had already reduced fees in many instances. On this basis, the petitions were dismissed for lack of merit; the court clarified that the ratio from Indian School, Jodhpur would not automatically apply to 2021-2022.

Provisions of Law Cited

Constitution of India, Article 226

Legal Doctrines & Maxims

  • Autonomy of unaided private schools in fixing fees (T.M.A Pai Foundation v. State of Karnataka, 2002 (8) SCC 481)
  • Minimal interference by writ court in the administration and fee-structure decisions of private schools (as recognized in T.M.A Pai Foundation and Modern Dental College)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that the COVID-19 pandemic precipitated a sharp fall in income and increased online-education expenses, making full tuition-fee payment burdensome. They urged the Court to mandate a 15% fee reduction for 2020-2021 and 2021-2022 and to require the schools to disclose cost structures, with CBSE and the Deputy Director of Education ensuring that only actual expenditures are charged and no surplus/profit is earned by the schools. They relied on directions/observations in Indian School, Jodhpur and other judgments directing fee reductions during the pandemic.

Contentions of Respondents

The respondents argued for deference to the autonomy of unaided private schools in fixing fees under T.M.A Pai Foundation and Modern Dental College. They highlighted lack of income disclosures by petitioners, and that the Court should not micromanage day-to-day school operations or fee structures. They noted that the schools had already implemented fee reductions and instalment options; they cited the CBSE/State framework and prior judgments that private schools are primarily responsible for determining fees in light of pandemic disruptions.

TONY GEORGE KANNANTHANAM THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 30.03.2022, ALONG WITH WP(C).11410/2021, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: **WP(C) NO. 11410 OF 2021 and conctd.** **13** ## **JUDGMENT** This order of mine shall dispose of two writ petitions preferred by the parents of the wards, who is studying in two different schools ie., Global Public School, Thiruvaniyur, Chottanikkara and Campion School, Ponekkara, Edappally, Ernakulam seeking a writ of mandamus directing the school to grant reduction of fees to minimum of 15% for the academic year 2020-2021 and 2021-2022 with a further prayer of directing the schools to file statement regarding the expenditure incurred for the academic year 2020-2021 and proposed 2021-2022 as well as to Deputy Secretary and Regional Officer, CBSE and Deputy Director of Education to ensure that the private school defray only actual expenses and to make sure that the school should not charge any surplus or profitable amount. 2. The gist of both the writ petitions are that the petitioners are the parents of the students studying in different standards and owing to the COVID pandemic there has been a shortfall of the income and salaries and thus unable to pay the tuition fees in time. They are also constrained to spend more expenses for making alternative arrangements for the children to attend the ## **WP(C) NO. 11410 OF 2021 and conctd.** ## **14** online classes. Schools cannot indulge into a profiting by charging the entire fees in the pandemic situation. ## 3 . Supreme Court in _**Indian School, Jodhpur & ors. V. State of Rajasthan & Ors in Civil Appeal No.1724 of 2021**_ directed the schools to provide 15% of fees reduction to the parents. Most of the schools have already expressed willingness to reduce the fees. Reliance has been laid to one of the schools called 'Choice School' whereby notice dated 10.5.2021 has been issued granting the parents 75% of reduction with regard to the annual fee for the academic year 2021-2022. In support of the contention, judgment of this Court in W.P.(C) No.19023 of 2020 and various other writ petitions have been relied upon wherein the fees structure proposed by the school after reduction had been approved. Directions have been issued to concerned school to look into the fee structure as to whether it commensurate with the situation of COVID pandemic as well as the fact that no physical classes are being undertaken. Regular classes for children have not commenced and even third wave erupted at the fag end of 2020-2021, when efforts were being made to allow the students to attend the classes physically, it was deferred on account of the aforementioned fact. **WP(C) NO. 11410 OF 2021 and conctd.** ## **15** 4. On the other hand, Mr. Santhosh Mathew, learned counsel for the respondent school opposed the aforementioned prayer by raising objection that none of the parents have disclosed their income, vocation or business etc., particularly, few of the parents are stated to be working abroad. But in the absence of any particulars of the income the general directions as sought through intervention of this Court cannot be passed. In _**T.M.A, Pai Foundation v. State of Karnataka 2002 (8) SCC 481**_ , it has been held that “in the case of unaided private schools, maximum autonomy has to be with the management with regard to administration including the right of appointment, disciplinary powers, admission of students and the fees to be charged”. In Modern Dental College and Research Centre and Others v. State of Madhya Pradesh and Others (2016) 7 SCC 353, the same position was reiterated. The School owing to the imposition of the lock down had given a concession on charging of the annual fee of Rs.16,000/-, Rs.10,000/- for the academic year 2020-21 and also proposal was brought forth i.e. an instalment payment option to parents to pay the fees. School has not charged any fee for transport, day boarding, hostel or catering. School has also reduced an amount of Rs.8,500/- for **WP(C) NO. 11410 OF 2021 and conctd.** ## **16** the classes 10 to 12, which was charged for food, coaching in extra-curricular activities, extra classes etc. There was also a proportionate reduction of 25% in transport fee, hostel fee and day boarding fee for the month of March 2020. In addition to work for the academic year 2021-22 there had been further reduction of the fees to Rs.5,000/- as against Rs.16,000/- which was payable in 2019-2020, an overall reduction of Rs.11000 in the annual fees. 5. There has been an attempt to mislead this Court as few of the parents had preferred a writ petition through the counsel representing the petitioners herein in W.P.(C) No.5028 of 2021. On 9.4.2021, this Court had issued a direction to the school to allow the parents therein, considering the income to pay the balance fee for the academic year 2020-21, whose children are studying in 9[th] and 2[nd] standard respectively, in 10 equal monthly instalments commencing from 15.5.2021. It was also held by the court that the said direction was confined only to the academic year 2020-21 and the petitioners therein were directed to remit the fee for the year 2021-22 as and when directed by the school, Ext.R6(3). Six petitioners in the W.P.(C) No.11410 of 2021 have already approached the school for ## **WP(C) NO. 11410 OF 2021 and conctd.** ## **17** availing the instalment facility for the academic year 2020-2021. The ratio of decidendi culled out in the judgment of the Supreme Court in _**Indian School, Jodhpur & ors. (supra),**_ will not affect the collection of fees for the academic year 2021-2022 as the students were directed to pay as and when it had become due/payable and urged this Court for dismissal of the writ petition. 6. The scope of interference of writ court under Article 226 of the Constitution of India commanding the schools to reduce the fee structure should be minimum and cannot assume the role of an administrator and probe into the day to day functioning of the school by taking into consideration parameters like school building, faculty, maintenance, staff, garden, electricity, water charges etc. The role of the petitioners have been abysmal in as much as that they have not attempted to disclose the income, vocation, profession etc. In the absence of the same, this Court has been deprived as to whether they have been able to cope up with the expenditure of their wards admitted in a prestigious schools providing first class service and education. Reply of the respondents regarding the reduction of fees for the academic year 2020-21 and 2021-22 and in not charging certain expenses **WP(C) NO. 11410 OF 2021 and conctd.** ## **18** under the different heads have not been refuted either by way of reply or argument. It is appreciated that the school had already reduced the fees without intervention of any authority or this Court. As per the contention of the counsel representing the Central Board of Secondary Education that there was no role for monitoring or probing the fee structure of the school. In the judgment of the Supreme Court in _**T.M.A, Pai Foundation v. State of Karnataka**_ it was specifically mentioned that in the case of unaided schools an autonomy has been given to the management for fixing the fees. Much emphasis has been relied upon in the judgment of this Court,Ext.P2, which was as per the circumstances of the case and the fee structures submitted by them was approved by this Court. The Court cannot sit in the arm chair of the decision making authority of the school in arriving at a particular figure of charging the fees under various heads. It is a matter of record that only few parents have come forward for opting for payment of the fees by way of instalments despite that the school has not taken any stringent action against the students. For the academic year 2022-23 physical classes have started. Even for online classes would have to incur expenditures for keeping it open for the teachers who would ## **WP(C) NO. 11410 OF 2021 and conctd.** **==> picture [15 x 9] intentionally omitted <==** take the classes online, for that, the usage of power, water and other attendant staff is inevitable. For the reasons aforementioned, I am of the view that the direction as sought for cannot be granted. Writ petitions sans merit and are accordingly dismissed.
