Case Synopsis & Summary

These writ appeals challenge a Kerala High Court single-judge order (dated 29 September 2021) that allowed two writ petitions filed by CISF personnel stationed at Cochin Port Trust and directed the government to grant Transport Allowance (TA) notwithstanding the existence of government transport facilities. The petitioners contended that they commute from residence to the unit armory and from there to vantage points with armed transport, often returning after duty hours via the unit armory, and that the current policy requiring TA only where no campus or government transport exists led to discriminatory treatment. They relied on Ext. P1 (03.10.1997) which restricted TA to employees with campus housing within 1 km or on-campus work-residence proximity, and Ext. P2 (29.08.2008) issued after the 6th Central Pay Commission relaxing that distance rule, arguing TA should be available irrespective of distance if government transport was not provided for the entire journey. The petitioners highlighted that several CISF units in Kerala ( eleven cited) grant TA even where government transport is available for portions of the journey, signaling hostile discrimination against Cochin Port Trust personnel. The respondents contended that TA is not payable where government transport is provided and relied on case law and policy, including Delhi High Court precedents. The High Court bench ultimately held the matter requires fresh re-evaluation by executive authorities rather than judicial resolution of merits, directing a reconsideration by the Ministry of Home Affairs and permitting representations within three months, while setting aside the impugned judgment and disposing of the appeals.

 • Hostile discrimination under Articles 14 and 16 of the Constitution

Submissions & Arguments

Contentions of Appellants / Petitioners

The appellants argued that Transport Allowance (TA) is a welfare measure that should be available to CISF personnel irrespective of the presence of government transport facilities, especially when a significant portion of their journey (from residence to assembly point to duty posts) is outside campus or housing premises. They contended that Ext.P2 (29.08.2008) withdrew the strict distance criterion of Ext.P1 (03.10.1997), post-6th CPC, thereby enabling TA irrespective of distance where government transport is not provided. Citing the fact that eleven CISF units in Kerala grant TA even when government transport is in place, they argued that withholding TA at Cochin Port Trust constitutes hostile discrimination under Articles 14 and 16 of the Constitution. They highlighted ancillary duties and additional travel connected to official tasks to bolster their claim for TA and urged a policy-level resolution by the executive to maintain uniform welfare benefits across units.

Contentions of Respondents

The respondents argued that TA is not payable if government transport is provided, citing Ext.P2 Clause 2(ii) and the minimal distance from residence to assembly point (often less than 300 meters) as reasons. They relied on Delhi High Court authority (Rajeev Kumar v. Union of India) to justify the restrictive approach and contended that TA is a welfare benefit, not an entitlement to be extended whenever travel occurs. They asserted Kerala’s 11-unit anomaly does not equate to a legal requirement to grant TA at Cochin Port Trust and urged re-evaluation by the executive branch, with proper representation and factual assessment, rather than judicial override of policy.

No. 209 of 2022 _[arising out of judgment dated 29.09.2021 in WP(C) No.17061/2021 ] &_ ## W.A. No. 210 of 2022 _[arising out of judgment dated 29.09.2021 in WP(C) No.16755/2021 ]_ **---------------------------------------------------------------------** Dated this the 31st day of July, 2023 ## **J U D G M E N T** ## **C.Jayachandran,J.** The respondents in W.P(C) No.17061/21 and W.P(C) No.16755/21 are the appellants respectively in the afore-captioned writ appeals. Both these writ petitions were disposed of by the learned Single Judge as per judgment dated 29.09.2021, which allowed the writ petitions. The said judgment is under challenge in these appeals. The issue which was agitated before the Tribunal pertains to non grant of Transport Allowance to the petitioners, who are the CISF personnel posted at CISF Unit, Cochin Port Trust. There are as many as 103 petitioners in WP.(C)No.16755/21 and a single petitioner in W.P.(C)No.17061/21. Transport Allowance was denied on the premise that the petitioners W.A.Nos.209 & 210 of 2022 -: 2 :- were provided with Government transport facility to commute from the assembly point (quarter guard) to the place of duty and _viseversa._ Whereas, the same was claimed by the petitioners in the writ petitions, on the premise that they have to commute from their place of residence to the Unit Armory, from where only they are provided armed transport to vantage points. Similarly, after the duty hours, they are only taken back upto the Unit Armory, from where they have to proceed to their place of residence in their private vehicle. The petitioners also contended that, stipulation in Ext.P1 Office Memorandum dated 03.10.1997, which restricted Transport Allowance to those employees who are provided with Government accommodation within a distance of 1 km or within campus housing the place of work and residence, was done away with by Ext.P2 Office Memorandum dated 29.08.2008 issued pursuant to the 6[th] Central Pay Commission recommendation. Therefore, irrespective of the distance between the place of residence and irrespective of the fact whether an accommodation has been provided in a campus housing the place of work and ## W.A.Nos.209 & 210 of 2022 -: 3 :- residence, the employees are entitled to Transport Allowance, was the claim espoused. The Tribunal, by virtue of the impugned judgment, found that the Government transport facility is provided to the petitioners only to cover a part of their journey, for reason of which, they cannot be deprived Transport Allowance. It was found that the petitioners cannot be expected to expend from their pocket for commuting from their place of residence to the assembly point and _vise-versa_ . Accordingly, the writ petitions were allowed directing the respondents to grant Transport Allowance to the petitioners and to disburse the arrears in this regard within a period of two months from the date of receipt of a copy of the judgment. **2.** Heard Sri. K.S.Prenjith, learned Central Government Counsel on behalf of the appellants and Sri. T. Sanjay, learned Counsel for the respondents. Perused the records. **3.** The learned Central Government Counsel appearing for the appellants contended that, as per Clause 2 (ii) of Ext.P2 OM, Transport Allowance is not available to those Officers, who have W.A.Nos.209 & 210 of 2022 -: 4 :- been provided with Government transport facility, which is admittedly provided to the petitioners in the writ petition. Secondly, it was contended that, the distance from their place of residence up to the assembly point - from where transport facility is provided upto the place of duty and _vice-versa_ – is only less than 300 meters, for which reason, it cannot be contended that the petitioners are not provided with Government transport facility. In this regard, the learned Counsel placed heavy reliance upon the judgment dated 24.01.2011, of the High Court of Delhi in **Rajeev Kumar v. Union of India** (W.P.(C)No.10331/2009). **4.** Per contra, the learned counsel for the respondents herein (writ petitioners), primarily focused on the hostile discrimination meted out to the writ petitioners in the matter of grant of Transport Allowance. In the counter affidavit filed by the writ petitioners in these appeals, as many as 11 CISF Units in Kerala are made mention of, where the CISF personnel are all granted Transport Allowances, whereas, in the CISF Unit at Cochin Port Trust alone - where the writ petitioners are working - the facility is not granted. It was W.A.Nos.209 & 210 of 2022 -: 5 :- submitted that, Government transport facility is partially made available in these 11 units as well, leaving to the CISF personnel to commute by their own means from their residence upto the assembly point. This discrimination, according to the writ petitioners, invites the wrath of Article 14 and more particularly, Article 16 of the Constitution of India. Secondly, the learned Counsel focused on the withdrawal of Clause 3 (ii) of Ext.P1 Office Memorandum, thereby doing away with the stipulation as regards the distance between the place of work and the place where accommodation is provided. By virtue of Clause 2(iii) to Ext.P2, the above Clause, as contained in Ext.P1, was specifically withdrawn, wherefore, the argument is that the CISF personnel are entitled to Transport Allowance irrespective of the distance component, as between the place of work and the place of accommodation. In other words, if a Government transport facility is not provided from the very place of residence upto the place of work and _vice-versa_ , Transport Allowance is liable to be given. The learned Counsel also pointed out the various duties, in addition to their main duty, which ## W.A.Nos.209 & 210 of 2022 -: 6 :- the writ petitioners are duty bound to undertake, the details of which are as follows: |are as|follows:|| |---|---|---| |_SL_
_No_|_Nature of regimental duties_|_Frequency of attendance_| |_1_|_Morning Physical Training_|_Daily for all personnel_
_except “A” shift personnel._| |_2_|_Morning parade_|_Weekly twice. This argument was espoused on the W.A.Nos.209 & 210 of 2022 -: 7 :- premise that CISF personnel are always considered to be on duty, round the clock. **5.** Having heard the learned counsel appearing for both sides, we are of the opinion that, the matter requires re-evaluation at the hands of the high authorities of the executive cadre at the first instance, before attempting to judicially resolve the same. The core of the writ petitioners' argument is based on the concept of hostile discrimination, insofar as the CISF personnel employed in its Unit at Cochin Port Trust is concerned. The specific allegation is that the staff of all CISF Units, which are operating in Kerala, except the one at Cochin Port Trust, is being offered with the facility of Transport Allowance and the personnel deployed at the CISF Units attached to Cochin Port Trust alone are deprived of the facility. We will first notice the grounds 'F' & 'V' canvassed in this regard, in the subject writ petition, which are extracted here below.: _F. Ext.P4 order denying the benefit of Transport Allowance from the salary of the petitioners, when the same benefit is extended to other units of CISF is illegal arbitrary, discriminatory and unjust._ _xxx xxx xxx_ W.A.Nos.209 & 210 of 2022 -: 8 :- _V. The petitioners and others personnel posted at CISF Unit CPT Cochin are being discriminated by non-payment of Transport Allowance while their counterparts posted in other CISF Units in Kerala who are similarly situated are being paid the Transport Allowance._ _xxx xxx xxx_ **6.** In elaboration of this ground, the writ petitioners have filed a counter affidavit dated 26.06.2023 in these appeals, wherein the details of the 11 CISF Units operating in Kerala are seen narrated. Paragraph nos.14, 15, & 16 are extracted here below: “ _14. It is submitted that all these personnel are reaching from their respective barracks/residence which are within 200 meters and they move out to any duties in their own buses. 24 x 7 vehicle facilities i.e vehicles owned by these forces are available for any type of duties. However, since duty personnel are commuting from their respective place of residence to place of Quarter Guard (briefing point), all are getting Transport Allowance. Only Officers who are authorized with 24 x 7 special vehicles from their residence to any place are not drawing Transport Allowance._ _16. It is therefore submitted that the norm followed by all other CISF Units in Kerala (except CISF Unit CPT Cochin and CISF Unit BPCL Cochin) and all Central Armed Police Force personnel viz CRPF, BSF and ITBP is that since their personnel are commuting from their place of residence to the common briefing points by their own means, they are entitled for Transport Allowance irrespective of distance which is in fact within 500 meters in all these campuses. On the other hand, the appellants are now trying to re- introduce the conditions contained in Ext P-1 Office Memorandum regarding distance rule which are not maintainable. Transport Allowance is a part_ ## W.A.Nos.209 & 210 of 2022 -: 10 :- _of salary introduced as a welfare measure. It is trite that a beneficial provision cannot be allowed to be whittled down and its benefits culled, especially if it pertains to uniformed soldiers.”_ **7.** The above contention is not specifically seen dealt with in the counter affidavit filed on behalf of the respondents 1 to 6 in the writ petition (appellants herein). We have specifically perused the counter affidavit dated 17.09.2021, (date being available only in the index) and another affidavit filed at the appellate stage dated 08.07.2023. In both these affidavits, the issue with respect to hostile discrimination between the 11 CISF units operating in Kerala, _vis-a-vis_ , the one where the writ petitioners are engaged is not seen addressed. We are, therefore, of the opinion that the matter requires to be addressed at the hands of a higher dignitary at the first instance, before judicial intervention, since, the cause espoused by the writ petitioners certainly deserve serious consideration, if the factual premises canvassed by them to urge hostile discrimination is true and correct. **8.** Another aspect, which requires consideration of the authority concerned is with respect to the ancillary and incidental duties W.A.Nos.209 & 210 of 2022 -: 11 :- performed by the writ petitioners, which are narrated in a tabular column in paragraph no.4 of this judgment and which forms part of our interim order dated 12.06.2023. It is the writ petitioners' case is that, apart from the main duty attached to the Cochin Port Trust, for which alone transport facility is given, the petitioners have to perform other duties as narrated in the tabular statement referred above, for which purpose, the writ petitioners have to travel by their own means, expending money from their pocket. Inasmuch as, these duties are also very much part of the official duty liable to be performed by the writ petitioners, they are entitled to Transport Allowance, is the case espoused. In this regard the writ petitioners are relying on two judgments, namely, (1) _**Suresh Choudhary & Ors v.Union of India & Ors**_ of the Delhi High Court (W.P. (C)No.3132/2020 dated 12.10.2020), (2) _**Sri Diptimoy Sarkar v. Union of India & Ors**_ of High Court of Culcutta. (W.P. (C)No.25970 of 2010). **9.** We also notice that the respondents in the writ petitioner (appellants herein) are relying on another judgment of the Delhi W.A.Nos.209 & 210 of 2022 -: 12 :- High Court in _**Rajeev Kumar v.Union of India**_ ( W.P. (C)No.10331/2008). **10.** Inasmuch as, we are relegating the matter for fresh consideration of the above referred aspects, we are not expressing any view on merits of the claims of the parties. **11.** Resultantly, we direct the Secretary to Ministry of Home Affairs, Central Government to consider the claim of the respondents herein (writ petitioners) for Transport Allowance, particularly in the backdrop of the specific allegation of hostile discrimination as between the personnel employed in the 11 CISF Units in Kerala, _vis-a-vis_ , the writ petitioners engaged at Cochin Port Trust. In order to enable the same, we permit the respondents herein (writ petitioners) to file a detailed representation before the Secretary, Ministry of Home Affairs. We also grant liberty to the appellants herein (respondents in the writ petition), to place their objection, if any, to the same. The Secretary, Ministry of Home Affairs, shall consider such representation, after affording the W.A.Nos.209 & 210 of 2022 -: 13 :- parties an opportunity of being heard, through their representative or counsel, as the case may be, within a period of three months from the date of receipt of a copy of the representation. In view of the above directions, the judgment impugned is hereby set aside. The writ appeals are disposed of as above. Sd/- ## **ALEXANDER THOMAS, JUDGE** Sd/- **C.
