Case Synopsis & Summary
These writ appeals arise from WP(C) 36709/2008 challenging the Kerala High Court’s 14 September 2012 judgment. The Kerala Public Service Commission (PSC) notified Operator vacancies in the Kerala Water Authority (KWA) with qualification of a National Trade Certificate (NTC) in Mechanic (Motor Vehicle/Electrician). In the selection, candidates with Diploma or Degree in Engineering were also considered, leading to a rank list that was challenged by writ petitioners. The learned single Judge held that the higher qualifications could not be treated as equivalent to the prescribed NTC, and consequently appointments already made, and those to be made, were to be restricted to those with the NTC. The appellants in WA 1874/2012, included in the rank list, argued that, given the hierarchy between subordinate and state service and the possibility of movement from lower to higher categories, higher qualifications can presuppose the basic NTC. They relied on Jyoti K.K. & Ors. v. Kerala Public Service Commission & Ors., and sought to apply equivalence. The Director of Technical Education’s equivalence committee recommended that certain diplomas/degrees be treated as equivalent to NTC for specific qualifications; the court accepted that higher qualifications mentioned in certain categories pre-suppose the basic NTC and that others may be treated as equivalent. Accordingly, the writ appeals were allowed, setting aside the impugned judgment, while preserving appointments already made.

- Doctrine: The principle of necessary parties and impleading all necessary parties in writ petitions.
- Precedent doctrine: Jyoti K.K. & Ors. v. Kerala Public Service Commission & Ors. (Positive value)
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants contend that the selection under the Kerala Public Service Commission for Operator in Kerala Water Authority relied on the prescribed National Trade Certificate (Mechanic) and that the inclusion of Diploma or Degree qualifications as higher qualifications should be recognized as equivalent in appropriate cases. They rely on Jyoti K.K. & Ors. v. Kerala Public Service Commission & Ors. to argue that higher qualifications in the same faculty can presuppose the basic qualification and that where an equivalence committee has found certain diplomas/degrees to be equivalent in practice, those equivalents should be reflected in the appointment process. They urge that the rank-list holders with higher qualifications should not be prejudiced and that the impugned judgment should be set aside to allow the benefit of equivalence.
Contentions of Respondents
The respondents, including the PSC and the State, argue that the post of Operator requires the National Trade Certificate as the baseline qualification and that higher qualifications cannot automatically create eligibility or equivalence, except where the directorate's Equivalence Committee has expressly recommended equivalence (as to specific diplomas/ degrees). They rely on the impugned judgment that restricted equivalence and opposed altering the rank list beyond the prescribed NTC. They maintain the hierarchy between subordinate and state service and emphasize the need to adhere to the rules (Kerala Public Health Engineering Service Rules and Subordinate Service Rules) unless explicitly overridden by statutory formulation or authorized equivalence.
