Case Synopsis & Summary
These intra court appeals challenge the 22 May 2017 judgment of a learned Single Judge in WP(C) Nos. 39977/2016, 38075/2017, 275/2017, 38075/2016, 275/2017, 39977/2016, concerning cadre strength of the Kerala State Higher Judicial Service (District Judges cadre). The State Government had notified a cadre strength of 169 posts after defining cadre strength by a 2014 notification and excluding 16 posts—7 deputation posts and 9 family court posts—on the ground that they were not permanent. Previously, in 2015, the Court had disapproved a notification reducing cadre strength from 146 to 130 for lack of reasons, and directed reconsideration. Following discussions, the State notified the definition of cadre strength and the High Court computed 169. Subordinate officers, represented by their associations, argued that temporary posts and deputations must not be counted in a permanent cadre and that the power to declare cadre strength rests with the State, not the High Court. The learned Single Judge held that the earlier order only regarding the 16 posts must be followed, and that the cadre includes only permanent posts, with the State’s power to notify cadre strength not delegable to the High Court. The Division Bench disagreed, noting the State’s plenary power, and held that temporary posts may be included in the cadre. It restored the 169 posts and GO 226/2016, directing posting from the cadre and remanding the list of cadre posts accordingly.
Legal Doctrines & Maxims
- Cadre means the strength of a service sanctioned as an independent unit, which may include posts of different kinds including temporary posts
- The State Government has plenary power to notify cadre strength within the constitutional framework, and such power can be exercised in consultation with the High Court
- It is open to the Government to include temporary posts in the cadre to be defined by them; a cadre may include temporary, work-charged, shadow or other posts creating an integrated cadre
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants (the High Court and the State) contend that the cadre strength is a matter of executive policy. The State has plenary power to notify cadre strength and to define 'cadre' under the 2014 notification in consultation with the High Court. They submit that temporary posts and posts deputed to other duties can be included in the cadre to form an integrated unit, and that the High Court's role is to publish the numerical strength once posts are identified by the State. They argue that the 2015 order requiring reconsideration did not constrain the State from exceeding the earlier cadre strength and that the Government's notification (G.O.(MS) No.226/2016) is within constitutional bounds and should stand.
Contentions of Respondents
The respondents contend that temporary posts should not be treated as part of a permanent cadre; the count must rest on permanent posts, and the State's power to notify cadre strength cannot be delegated to the High Court. The single Judge correctly directed notice to the 16 posts; the overall cadre strength should reflect only permanent posts. They argue that increasing cadre strength beyond the previous figure adversely affected the subordinate judiciary's promotions, and that the High Court cannot redefine cadre strength by itself.
