Case Synopsis & Summary
Vysakh George, the petitioner, challenges Ext.P6 (quashing of permanent building number) issued by the second respondent and seeks quashment of Ext.P7 stop memo (Ext.P7) in WP(C) No.26075/2015, and also seeks permanent building number for the building under construction in WP(C) No.5063/2022. The facts trace to a 24-04-2015 building permit (Ext.P1) followed by construction; the stop memo (20-08-2015) based on the property being Nilam halted works, and interim proceedings in the related case stayed the stop memo enabling construction to completion. Later, Ext.R2(b) cancelled the permit; the petitioner challenged before the Tribunal for Local Self Government Institutions, which allowed Ext.P8, setting aside the cancellation. The government authorities argued the property is Nilam and in the data bank, requiring sanction from the Revenue Divisional Officer before granting a permanent building number, and that Section 27A of the Conservation of Paddy Land and Wetland Act, 2008, came into force only from 30-12-2017 and cannot retroactively affect pre-2017 permits. The petitioner relies on Cheranalloor Grama Panchayath v. Joe Thattil to press the retroactivity argument. The judgment disposes of both petitions with directions to remove the property from the data bank (Ext.P9 decision) and to process Ext.P10 (Form No.5) within two months, followed by reconsideration of Ext.P4 for a permanent building number with a final decision within a further period, after ensuring opportunity of hearing. The Court cites the Cheranalloor decision to support limited retroactivity and grants time-bound directions for a coordinated resolution.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that (i) Ext.P1 building permit dated 24.04.2015 authorized the construction; (ii) Ext.P7 stop memo was issued in 2015 based on Nilam classification; (iii) interim orders stayed the stop memo enabling construction; (iv) Section 27A of the 2008 Act cannot apply to pre-2017 permits; (v) reliance on Cheranalloor Grama Panchayath v. Joe Thattil (2020(5) KHC 669) to claim retroactive relief and ensure a permanent building number; (vi) seeks quashment of Ext.P6, permanent building number, and removal from data bank (Ext.P9) with consideration of Ext.P10 Form No.5 within two months and final decision within a month after Ext.P10; opportunity of hearing prior to Ext.P7 action.
Contentions of Respondents
The respondents contend that the property lies in Nilam in revenue records and in the data bank; permanent building number cannot be issued without sanction from the Revenue Divisional Officer; Section 27A, effective from 30.12.2017, cannot be applied to pre-2017 permits; the decision to remove from the data bank should be anchored in the LLMC minutes and RDO order; Ext.P6 remains valid pending compliance; a measured approach is required to safeguard land use and wetland protections.
