Case Synopsis & Summary
V.S. George, a stage carriage operator, held a regular permit for the Thiruvalla–Kottayam route and sought to vary the route to Thiruvalla–Pathanamthitta with permission for additional trips. The Regional Transport Authority allowed the variation, which this Court had previously clarified in Ext. P1 as being temporary in nature. The petitioner contends that the variation, even if granted, is permanent in effect and that the timings have not been settled, preventing operation under the varied permit. He approached the State Transport Appellate Authority (ST A T) in M.V.A.R.P. No. 179 of 2013 for permission of two additional trips; that matter was stayed. KSRTC objected to the two added trips on the basis that they fall on the notified route, and the stay from STA T further complicated the matter. The petitioner argues that the delay in finalizing timings causes substantial loss and that the variation already exists. The Government Pleader opposes operation until a timing conference is held and a decision is made to avoid timetable clashes and ensure hearings of objections. The Court notes no material showing objections to Ext. P4 timings and directs the RTA to convene a timing conference and settle timings within 15 days, excluding the two additional trips. If not settled, the petitioner may operate per Ext. P4 timings with those two trips excluded, and the additional trips may proceed subject to the outcome of M.V.A.R.P. No. 179/2013.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that though the variation of route was permitted, the timings have not been settled and the proposed timings in Ext. P4 should be allowed to operate, subject to the stay order in M.V.A.R.P.No.179/2013. He argues the two conferences were held and there is no objection to the proposed timings; variations are of a temporary nature per Ext. P1; delay causes substantial loss; petitioner seeks relief to operate as per Ext. P4 timings pending decision.
Contentions of Respondents
The Government Pleader opposes granting operation before a timing conference is held and a decision is taken to avoid timetable clashes and ensure hearing of objections.
