Case Synopsis & Summary

Vipinlal, accused no.15, seeks bail under Section 438 Cr.P.C. in Crime No.7/2019 of Ponnani Police Station, Malappuram District. The charges span IPC Sections 143, 147, 148, 323, 324, 332, 333, 326, and 307, read with 149, along with Section 3 of the PDPP Act. The case arises from a harthal protest connected to the entry of women in Sabarimala; around 200 workers from BJP, Sanga Parivar, and RSS allegedly assembled, damaged a car, and attacked a police officer, causing injuries and property loss. Petitioner argues non-involvement, noting that other accused have already been released on bail and that one accused was released under Section 438 Cr.P.C. The Public Prosecutor opposed bail, contending the overt act is attributed to the petitioner and his presence is required for investigation. The Court, noting the passage of 1½ years since the incident and the release of several co-accused on bail, considers imposing stringent conditions and grants bail on terms. Directions include appearance before the IO within ten days, a bond of Rs.50,000 with two solvent sureties, appearance as required, non-flight, non-commission of similar offenses, and deposit of Rs.2,500 before the jurisdictional court within 10 days after release, along with adherence to COVID-19 social distancing guidelines. The order reiterates bail as a rule and jail as an exception and permits cancellation of bail for violation of conditions.

The petitioner’s counsel argued non-involvement of Vipinlal, noting he is accused No.15 while others have been released on bail; one accused was released under Section 438 Cr.P.C. The defense urged that, given the lapse of time since the incident and parity with co-accused, bail should be granted under stringent conditions.

Contentions of Respondents

The Public Prosecutor opposed bail, contending a specific overt act is alleged against the petitioner and his presence is necessary for completion of investigation.
