Case Synopsis & Summary

VASU THILLERI, a former Lecturer and later Associate Professor at PSMO College, Thirurangadi, challenged Ext.P11, an order denying reckoning of his prior Central Government service for pension calculation. He served in the Office of the Accountant General (A&E) Kerala from 14.05.1986 to 08.10.1996, then joined a leave vacancy at PSMO College on 09.10.1996 and later held a regular vacancy from 16.11.1998, retiring on 30.04.2018. The petition questions the non-reckoning of his period of service in the leave vacancy as qualifying service for pension and seeks to count his earlier Central Government service. The Government issued a 2014 order stating that prior public service should be reckoned as qualifying service after condoning the non-qualifying “sandwiched” service as a break, thus excluding the leave vacancy period. The petitioner argues this mechanism should apply to his case, supported by settled law. The respondents rely on Rule 29(a) and 29(b) of Part III KSR and contend the non-qualifying service can be condoned only as per the stated rule, with Ext.P11 correctly reflecting government policy. The Kerala High Court ultimately allows the petition, quashes Ext.P11, and directs fresh orders reckoning the petitioner’s prior service (1986–1996) as qualifying service for pension, to be issued expeditiously, within two months.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that his prior Central Government service from 1986–1996 should be reckoned as qualifying service for pension, notwithstanding the leave-vacancy period. He relies on the 2014 Government order condoning non-qualifying sandwich periods and on established jurisprudence (Valsan P. v. State of Kerala and Haridasan) to count pre-existing service toward pension. Ext.P11 denying reckoning should be quashed, and fresh orders must reflect the entire prior service.

Contentions of Respondents

The department argues that under Rule 29(a) and 29(b) of Part III KSR, a break in public service or resignation for another appointment is treated as forfeit of past service unless explicitly condoned. The 2014 order allows reckoning of prior service after condoning non-qualifying breaks, but the calculation must adhere to the rules and records. Ext.P11 reflects the Government’s position, and fresh orders must be issued after verifying records. The court’s task is to harmonize statutory rules with the Government order and precedents.

He worked there till 15.11.1998. On 16.11.1998, he was appointed to a regular vacancy. He retired from the college on 30.04.2018, as an Associate Professor. Prior to his joining the PSMO College as a Lecturer, he had worked in the Office of the Accountant General (A&E) Kerala from 14.05.1986 to 08.10.1996. He has approached this court aggrieved by Ext.P11 order of the second respondent, refusing to reckon his prior Central Government Service for calculation of pensionary benefits. 2. The basic facts regarding the period of service of the petitioner in the Office of the Accountant General, then in a leave vacancy in the PSMO College and thereafter in the regular vacancy as noticed above, are not in dispute. 4. Though in the writ petition challenge is raised regarding non-reckoning of the period of service in leave vacancy as qualified service, the same is not pursued realising that the law is otherwise. 5. As regards the reckoning of the petitioner’s prior service in the Central Government, with reference to Rule 29(a) of Part III KSR, the Government had issued an order on 24.09.2014 which reads thus: - _“As per Rule 29(a) Part III Kerala Service Rules, resignation of the Public Service or dismissal or removal from it, entails forfeiture of past service. As per Rule 29(b) of ibid, resignation of an appointment to take up another appointment the service in which counts is not resignation from public service and the break between two appointments_ **W.P.(C) No.42406 of 2022** -: 3 :- _should not exceed the joining time admissible under the service rules plus public holidays._ _2) Several requests have been received in Government to reckon the prior qualifying service for pension after condoning the non-qualifying sandwiched service as break without forfeiture of past service._ _3) Government have examined the matter in detail and are pleased to order that the prior public service shall be reckoned as qualifying service for pension after condoning the sandwiched non qualifying service as break between the two services.”_ Therefore, the period of non-qualifying service, which in the instant case is the service in the leave vacancy, is to be excluded and the prior public service is to be reckoned as qualifying service for pension. The petitioner worked in the Office of the Accountant General from 14.05.1986 till 08.10.1996. He was appointed in the leave vacancy in the College from 09.10.1996. He worked till 15.11.1998. He was appointed to the regular vacancy on 16.11.1998. Therefore, his ## **W.P.(C) No.42406 of 2022** **==> picture [34 x 9] intentionally omitted <==** period of services excluded the period during which he worked in the leave vacancy, is liable to be reckoned as qualifying service for pension. The law in the said regard has been laid by the Apex Court in _**Valsan P. v. State of Kerala and Ors. [2021 (6) KLT 287]**_ and by this Court in _**State of Kerala v. Haridasan [2015 (2) KlT 145]**_ . 6. In the light of the above, Ext.P11 order declining to reckon the prior services of the petitioner in the Office of the Accountant General, for the purpose of reckoning his pensionary benefits, cannot be sustained. Fresh orders need to be passed after reckoning the said service also. Resultantly, the writ petition is allowed. Ext.P11 order of the second respondent is quashed. The second respondent shall pass fresh orders on verifying the relevant records, reckoning the prior service of the petitioner in the Office of the Accountant General (A&E Kerala) from 14.05.1986 to 08.10.1996 also as qualifying **W.P.(C) No.42406 of 2022** **==> picture [34 x 9] intentionally omitted <==** service for computing the pensionary benefits. Let fresh orders be passed as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this judgment.
