Case Synopsis & Summary
This writ petition challenges Ext.P9, a Government order denying exemption to Vasanthakumari P.C. for appointment as Senior Clerk in the 6th respondent Cherthala Taluk Aided Secondary School Employees' Co‑operative Society Ltd, under Rule 185(1) of the Kerala Co-operative Societies Rules. The petitioner was appointed as Senior Clerk on 25 May 1998 through direct recruitment after a selection process. When she applied for enrollment in the Kerala Co-operative Employees' Self Financing Pension Scheme (1994) and related Pension and Welfare schemes, her application was rejected on the ground that there was no sanctioned post for a Senior Clerk and that the Society, being a Class VI Society, did not permit relaxation. The petition sought to treat the appointment as legal and to enroll her in the pension schemes, as well as other reliefs. The third respondent contended that the Society had invited applications for Junior and Senior Clerk posts on 2 April 1998; after testing and interview, petitioner was appointed Senior Clerk; Molykutty, Junior Clerk, resigned, leaving no sanctioned Senior Clerk post. It was argued that Class VI allows only Secretary and Attender; hence the initial appointment was bad in law. The Court ultimately held there was no sanctioned post and relaxation could not be granted; nevertheless, it directed that the petitioner be treated as Lower Division Clerk with effect from 5 February 2001 and promoted, and that no salary recovery be effected. The petition is disposed of with these directions.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner’s counsel contends that if a promotion or direct recruitment is found to be irregular, but the employee has served for a long period, reversal should not be made without considering relaxation of Rules. Relying on Rajalakshmi v. State of Kerala, the argument is that prolonged service to a post created or allowed by laxity should not be easily undone. The writ petition seeks to declare the appointment legal and to include the petitioner in the Kerala Co‑operative Employees’ Self Financing Pension Scheme (1994) and the Kerala Co-operative Welfare and Development Scheme (2000), along with related reliefs. The petitioner also asks for regularization of service and grant of pension benefits.
Contentions of Respondents
The Government Pleader counters that the 6th respondent society is Class VI, with no sanctioned post of Senior Clerk; thus the appointment was not in a sanctioned vacancy and cannot be regularized. The Society had invited posts in 1998, but the absence of a sanctioned post and the limitation of Class VI employees precluded relaxation or exemption under Rule 185(1). The court is urged to dismiss the petition or, at least, to require proper alignment with the rules without creating a post that did not exist.
