Case Synopsis & Summary

The petitioner, Vargheese K.E., is an octogenarian landowner claiming ownership and possession of 189.58 acres of land in Re-Sy.No. 313/7 in Thalavady village, Kuttanad taluk. He contends that the land was reclaimed years ago and currently exists as purayidam, but the Data Bank incorrectly enumerates it as wetland under the Kerala Conservation of Paddy Land and Wetland Act, 2008. In 2019, proceedings under Section 13 of the Act were initiated (Ext.P5) on the premise of the land being described as wetland, and Ext.P7 was filed before the Local Level Monitoring Committee (LLMC) seeking deletion of the entry after learning of the erroneous description. Prior writ petition W.P. No. 26239/2019 resulted in Ext.P8 directing reconsideration by the District Collector, followed by Ext.P9 and Ext.P15, with consequent contempt proceedings and withdrawal. The LLMC failed to decide Ext.P7, and the petitioner filed Ext.P15 (Form 5) under the 2008 Rules seeking deletion from the data bank. The court held that with a proviso to Section 5(4)(i) of the Act, the Revenue Divisional Officer (RDO) is empowered to decide Ext.P15, and directed the RDO to decide in three months, following Rules 4(4E) and 4(4F) and KSREC report, independent of the LLMC’s findings. Section 13 proceedings are kept in abeyance, and the petitioner will be afforded an opportunity to submit documents.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that the land in question is not wetlands and is shown as purayidam in revenue records. He argues that Ext.P5 initiated Section 13 proceedings on the mistaken wetland description and that Ext.P7 before the LLMC should lead to deletion of the erroneous entry. With the introduction of the proviso to Section 5(4)(i), the RDO now has the power to decide Ext.P15 (Form 5) and delete the entry in the data bank, subject to KSREC’s report, and independently of LLMC’s order. He requests a decision in line with this legal framework within a time-bound period, while keeping the Section 13 proceedings in abeyance pending the RDO’s ruling.

Contentions of Respondents

The respondents submit that LLMC’s order and Ext.P9 reflect consideration of the Form 5 application. They argue that, post proviso to Section 5(4)(i), the RDO is empowered to decide Ext.P15 and must follow the 2008 Rules (4(4E), 4(4F)) and KSREC’s report. They emphasize adhering to due process and that LLMC’s prior actions have to be weighed against the statutory framework, with the final decision resting with the RDO after proper procedural compliance.

According to the petitioner, his property was reclaimed years back and is now lying as 'purayidom'. As per Ext.P5 order dated 01.07.2019, proceedings under Section 13 of the Kerala Conservation of Paddy Land and Wetland Act, 2008 ('the Act' for short) was initiated on the premise that the property is described as 'wetland' in the Data Bank and the petitioner had attempted to alter the nature of the land. By the said order, the petitioner was called upon to W.P.(C) No.43803 of 2023 -3- restore the property to its original condition. On coming to know that his property is wrongly described as 'wetland' in the Data Bank, the petitioner preferred Ext.P7 application before the Local Level Monitoring Committee (LLMC) for getting the entry deleted. The petitioner also challenged Ext.P5 order before this Court in W.P. (C) No.26239 of 2019, resulting in Ext.P8 judgment, setting aside the impugned order and directing re-consideration by the District Collector. Thereafter, Ext.P9 order was passed reiterating the earlier stand and thereupon, the petitioner initiated contempt of court proceedings which led to the order being withdrawn. Thereafter, the District Collector considered the matter afresh and directed the LLMC to dispose of Ext.P7 application pending before it. As the LLMC failed to pass orders on Ext.P7, the captioned writ petition was filed seeking the following reliefs; W.P.(C) No.43803 of 2023 -4- _“i) issue a writ of certiorari or any appropriate writ, order or direction calling forthe records leading to Ext. P9and quash the same._ _ii) declare that the provisions of Kerala Conservation Paddy land wetland Act 2008 are not applicable to the land owned and possessed by the petitioner comprised in Re. Sy No. 313/7 in block No. 36 Thalavady village._ _iii) issue a writ of mandamus or any appropriate writ, order or direction directing the 3[rd] respondent to consider and dispose of Ext.P7 application on the basis of Exts. P1, P2 and P14 and in the light Adani Infrastructures and Developers Pvt.Ltd. V. State of Kerala & Asma V. District Collector, Thrissur and others and make necessary corrections in the data bank by deleting the lands owned by the petitioner, comprised in Re.Sy No. 313/7 in block No. 36 Thalavady village from Ext P12 Data Bank of Thalavady Grama Panchayath.”_ After filing of the writ petition, the LLMC passed an order on 14.02.2024, rejecting Ext.P9 application. The petitioner thereupon filed Ext.P15 application under Form 5 of the Kerala W.P.(C) No.43803 of 2023 -5- Conservation of Paddy Land and Wetland Rules, 2008 ('the 2008 Rules' for short), seeking deletion of his land from the data bank. 2. Learned Counsel for the petitioner submitted that insofar as the petitioner has preferred Ext.P15 application, it is incumbent upon the Revenue Divisional Officer to take a decision on the application based on the Agricultural Officer’s report and Ext.P14 report of the KSREC. 3. Learned Government Pleader would submit that a reading of the order now passed by the LLMC would show that even the application under form 5 was taken into consideration. 4. Having heard the learned Counsel on either side, I find that even though the petitioner had filed Ext.P7 at the time when the LLMC alone was competent to consider the request for deletion of entries from the data bank, with the introduction of the proviso to Section 5(4) W.P.(C) No.43803 of 2023 -6- (i) of the Act, the Revenue Divisional Officer is now empowered to take a decision on the application. In view of the above development, it is only appropriate that Ext.P15 application under Form 5 be considered by the Revenue Divisional Officer. The writ petition is hence disposed of directing the second respondent to take a decision on Ext.P15, in accordance with the procedure prescribed under Rules 4(4E) and 4(4F) of 2008 Rules and with reference to the KSREC report. The said order shall be passed uninfluenced by the finding of the LLMC in its order dated 14.02.2024. The fact that the proceedings under Section 13 of the Act was initiated against the petitioner shall no stand in the way of the Revenue Divisional Officer taking an independent decision in the light of the decision of this Court in _**Bharathan**_ _**Ramanathan v. State of Kerala [2022(7) KHC 541]**_ **.** W.P.(C) No.43803 of 2023 -7- The decision, as directed above, shall be taken within three months of receipt of a copy of this judgment. Till orders are passed in the manner directed above, the proceedings under Section 13 of the Act shall be kept in abeyance. Considering that the petitioner is an octogenarian and the property is shown as ' _purayidam_ ' in the revenue records, the petitioner shall be afforded an opportunity to produce documents and make his submission before the second respondent. **==> picture [34 x 12] intentionally omitted <==** ## **V.G.ARUN JUDGE** Scl/ W.P.(C) No.43803 of 2023 -8- ## **APPENDIX OF WP(C) 43803/2023** |**PETITIONER EXHIBITS**|**PETITIONER EXHIBITS**| |---|---| |**Exhibit 1**|**A TRUE COPY OF THE PARTITION DEED DATED**| ||**10.07.1954**| |**Exhibit P2**|**A TRUE COPY OF THE RELEVANT PAGES OF**| ||**THE SETTLEMENT REGISTER**| |**Exhibit P3**|**A TRUE COPY OF THE RELEVANT PAGE OF THE**| ||**BTR**| |**Exhibit P4**|**A TRUE COPY OF THE TAX RECEIPTS DATED**| ||**12.07.2023**| |**Exhibit P5**|**A TRUE COPY OF THE ORDER DATED**| ||**01.07.2019 PASSED BY THE 1 ST**| ||**RESPONDENT**| |**Exhibit P6**|**A TRUE COPY OF THE RELEVANT PAGE OF THE**| ||**DRAFT BANK OF THALAVADY GRAMA**| ||**PANCHAYATH**| |**Exhibit P7**|**A TRUE COPY OF THE APPLICATION DATED**| ||**23.09.2019 SUBMITTED BY THE PETITIONER**| ||**BEFORE THE 3 RD RESPONDENT**| |**Exhibit p8**|**A TRUE COPY OF THE JUDGMENT IN W.P.
