Case Synopsis & Summary

The petitioner, Usman C.B., claims joint ownership of 7.86 ares of land in Choornikkara Village (Block No. 34, Re-surveys 25/2-3, 24/2-3, 26/12-2, 24/1-2, 24/3-2, 24/3-3) and seeks a declaration that 4.91 ares (12.132 cents) lying within that land, though reportedly dry, is currently recorded as Nilam/paddy land in revenue data-bank and should be treated as dry land. He asserts it was converted or misclassified in the data-bank and should be deemed eligible for use for any purpose, including construction, under the Kerala Conservation of Paddy Land and Wetland Act, 2008 and its Rules. The petition seeks mandamus to direct the Local Level Monitoring Committee to correct the data-bank in light of Salim v. State of Kerala (2017) (1 KLT 392), and to consider and decide Ext.P4 (correction under Rule 4(6)) and Ext.P6 (change of nature) applications, with due regard to satellite imagery and FM B sketches, and to reassess land tax under Section 27C. The Respondents include the RDO, LLMC Choornikkara, Agricultural Officer, Tahsildar LR, and Village Officer. The court substitutes a pathway for correction, directing LLMC to decide Ext.P4 within four months, after obtaining satellite data and relevant sketches, and permitting Ext.P6 consideration by the 1st respondent, while reserving the petitioner’s right to seek further relief under law.

Legal Doctrines & Maxims

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that 4.91 ares (12.132 cents) out of 7.86 ares in joint possession with his wife is dry land, yet it is recorded as Nilam/paddy land in the data-bank. He has filed Ext.P4 under sub-rule (6) of Rule 4 of the Kerala Conservation of Paddy Land and Wet Land Rules, 2008 seeking correction of the data-bank. He asserts the land is dry land and should be permitted for other uses, including construction, and asks for reassessment of land tax and corrections in revenue records under Section 27C. He is prepared to remit fees for FM B sketches and satellite imagery as required in Ext.P4. He relies on Salim v. State of Kerala (2017) for precedent. He prays for mandamus to direct the LLMC to consider Ext.P4 and to correct entries in the data-bank.

Contentions of Respondents

The Government Pleader submits that Ext.P4 should be considered by the Local Level Monitoring Committee (LLMC) and disposed of in accordance with law. The respondents emphasize adherence to statutory procedures, including obtaining satellite imagery and FM B sketches, and inviting extant government orders (Ext.P5) to guide action. The 2nd respondent is to examine Ext.P4 in light of the rules and act within a time frame fixed by the court. The overall stance is to ensure lawful correction and prevent arbitrary alteration of data-bank entries.

State of Kerala [2017 (1) KLT 392], and also in the light of Ext.P5 Government Order and correct the Data Bank of Choornikkara Grama Panchayath and make necessary corrections in the data bank by deleting WP(C).No. 7647 of 2019 3 4.91 Ares (12.132 cents) of land comprised in Re.Sy.Nos. 25/2-3, 24/2-3, 26/12-2, 24/1-2, 24/3-2, 24/3-3 in Block No. 34 of Choornikkara Village, Aluva Taluk; direction to the 1[st] respondent to consider and dispose Ext.P6 application and grant permission to change of nature of the land and also, to utilize 4.91 Ares(12.132 cents) of land comprised in Re.Sy. According to the petitioner, though 4.91 ares out of 7.86 ares in the joint possession of the petitioner along with his wife is dry land, it is wrongly classified as 'Nilam' in the Revenue Records. Therefore, the petitioner made Ext.P4 application before the 2[nd] respondent, invoking sub-rule (6) of Rule 4 of the Kerala Conservation of Paddy Land and Wet Land Rules, WP(C).No. 7647 of 2019 4 2008, for correction of entry in the data-bank. 3. As per Clause (f) of Rule 2 of the Kerala Conservation of Paddy Land and Weltland Rules, 2008 inserted vide G.O.(P)No.85/2018/Rev. dated 15.12.2018, 'data bank' means the data bank of paddy lands and wetlands prepared under clause (i) of sub-section (4) of Section 5 of the Kerala Conservation of Paddy Land and Wetland Act, 2008.
