Case Synopsis & Summary
Usha Shyam, the appellant, challenged the Motor Accidents Claims Tribunal’s award in OP(MV) No. 2070/2011 before the Kerala High Court in MACA No. 2835 of 2014. The accident occurred on 25 July 2011 when she, then a 43–45-year-old Fusing Supervisor employed by Schjiffilies India Ltd., riding a scooter on the Aluva–Ernakulam road near Appolo Tyres, was struck from behind by a car driven negligently at high speed and was jammed under a lorry proceeding from south to north. She sustained severe injuries including amputation of the right leg below the knee and other disfiguring injuries. The MACT awarded Rs. 20,18,200 with 8% interest per annum. The appellant contended that the income used for calculating compensation was understated; Ext.A12 suggested a monthly income of Rs. 11,500 but was not properly proved, and the notional income following Ramachandrappa (2011) should be Rs. 8,000. With 55% permanent disability and 25% future expense addition, the court recalculated disability compensation as Rs. 9,24,000. It added Rs. 25,000 for disfigurement, Rs. 25,000 for future treatment, and Rs. 25,000 for loss of amenities, and Rs. 1,92,000 for loss of earnings for two years. Thus, the enhanced total became Rs. 11,91,000, yielding an enhancement of Rs. 7,25,400 over the Tribunal award. The appeal is allowed with enhanced compensation at 8% interest; other Tribunal findings were upheld, with directions for NEFT/RTGS payment and set-off where applicable.
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant contended that the Tribunal erred in fixing the monthly income at Rs. 4,000 when Ext.A12 suggested Rs. 11,500; in reliance on Ramachandrappa (2011), the notional income for a labourer (coolie) should be Rs. 8,000. With 55% disability after below-knee amputation and a 25% addition for future expenses, the calculation yields higher disability compensation (Rs. 9,24,000). She claimed Rs. 25,000 for disfigurement, Rs. 25,000 for future treatment, and Rs. 25,000 for loss of amenities, plus Rs. 1,92,000 for two years’ loss of earnings, totaling Rs. 11,91,000. The appellant urged enhanced compensation and payment by NEFT/RTGS with set-off for already paid sums.
Contentions of Respondents
The respondents argued the accident resulted from the scooter rider’s carelessness and that the Tribunal’s findings on liability and quantum be maintained, contending evidence did not support the claimed higher income or disability figures; the insurers contested liability to pay beyond the admitted policy, and some respondents contested the head of damages and the amount awarded by the Tribunal.
