Case Synopsis & Summary

This common judgment of a Division Bench of the Kerala High Court consolidates four original petitions seeking supervisory interference under Article 227 of the Constitution of India with orders passed by Sub Judge, Chavakkad and Thrissur in O.S.709/2013 and connected I.A.s. The petitions challenge the identity of parties impleaded and arrangements for temple administration in the Sree Pathiyarkulangara Bagavathy Temple disputes, as well as the status of hereditary trustees. The proceedings trace a sequence from Ext.P26 identity issue (in O.S.709/2013) to Ext.P2 and Ext.P3 orders and the interim governance arrangements proposed by the Court, including appointment of an Advocate Commissioner for temple festival management. The Court records multiple petitions, including OP(C)2416/2014 (Unnikrishnan), OP(C)1570/2014 (Pazhanchery Unnikrishnan), OP(C)2861/2013 (Narayana Menon), and OP(C)4115/2013 (Pazhanchery Unnikrishnan), presenting a common factual matrix: a temple trust dispute with hereditary trustees and competing claims. The judgments in these matters reveal the Court’s cautious approach to pending interlinked litigation, the overarching supervision of temple administration, and the protection of hereditary status of trustees while considering festival arrangements. Ultimately, the Court dismisses the petitions as infructuous without making determinations on the lis or the factual contentions raised by the parties.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners seek to set aside the challenged orders (Exts. P2, P3, and related interim orders) on the ground that the identity of the person impleaded in O.S. No. 709/2013 is falsely determined and that the supervisory jurisdiction under Article 227 is invoked to correct grave mistakes in impleading and governance of the temple. They contend the orders affect the status of hereditary trustees and the management of the temple, including the festival arrangements and interim relief, and seek quashing or modification of the impugned orders and a proper identification of the rightful trustees.

Contentions of Respondents

The respondents/statuary authorities emphasize the propriety of the Sub Court’s orders and the necessity to resolve ongoing disputes about temple administration and hereditary trusteeship. They rely on the court's earlier orders and the protective framework to manage temple affairs, including appointing an Advocate Commissioner for festival arrangements and approving expenditure under supervision, while denying premature or piecemeal adjudication of the trustee status in a manner that could disrupt temple functioning.

On 01.09.2014, when the above matters came up for further consideration, the learned Advocate Commissioner submitted that in tune with the interim order passed by this Court, efforts are being taken to conduct repair works and he sought time to file a report. 10. Today, when these original petitions are taken up consideration, it is brought to the notice of this Court that O.S.No.709 of 2013 on the file of the Sub Court, Chavakkad has already been decreed in favour of the supplemental 2[nd] plaintiff, namely Pazhancherry Unnikrishnan. The operative portion of that order reads thus; “a) It is declared that the Order No.A4-1715/98 dated O.P.(C)No.2416 of 2014 and con.cases -15- 13.06.1998 passed by the second defendant is void and it is not binding on the supplemental plaintiff No.2 for defeating his status as the present hereditary trustee of the Sree Pathiyarkulangara Bagavathy Temple. - b) It is declared that the Order No.R.P.11/98 dated 31.12.1998 passed by the first defendant is void and it is not binding on the supplemental plaintiff No.2. - c) It is declared that the 3[rd] defendant or 10[th] defendant are not the hereditary trustees of Sree Pathiyarkulangara Bagavathy Temple. - d) It is declared that the present hereditary trustee of Sree Pathiyarkulangara Baghavathy Temple being the eldest Mootha Nair of the Pazhanchery tharvad is Unnikrishnan, who is the supplemental second plaintiff. - e) The prayer of declaration of death of P. The learned counsel for the petitioners would submit that in view of the disposal of O.S.No.709 of 2013, nothing survives in these original petitions. Therefore, the original petitions may be dismissed as infructuous. 12. The learned Standing Counsel for Malabar Devaswom Board would point out the pendency of O.A.No.42 of 2006 before the Deputy Commissioner, Kozhikode. -16- ## O.P.(C)No.2416 of 2014 and con.cases In such circumstances, based on the above submissions, these original petitions are dismissed as infructuous, without expressing anything on the legal and factual contentions raised by both sides.
