Case Synopsis & Summary

Two writ petitions filed by the University of Kerala challenge a common order of the Kerala Upa Lok Ayukta dated 27 July 2022 in Complaints 84/2022 and 86/2022. The petitions,WP(C) Nos.25663/2022 and 25695/2022, were heard together by a Division Bench of the Kerala High Court (Chief Justice S. Manikumar and Justice Murali Purushothaman) on 11 April 2023. The core grievance is that the Lok Ayukta’s common order directed or permitted action in connection with alleged malpractice and/or evaluation of Sixth Semester examinations, and the petitioners contend that the Lok Ayukta has no jurisdiction to interfere with internal university processes or to issue interim directions regarding examination or revaluation, which are governed by statutory regulations and university statutes. The Controller of Examinations submitted that no rules permit special examinations for candidates accused of malpractice and that the Syndicate is the authority to decide malpractice matters; the written comments asserted malpractices and maintained that evaluation decisions follow established norms. The court admitted the petitions, stayed the Lok Ayukta order, and, invoking University of Kerala Parvathy Krishna (2014) (2) KHC 199; 2014(2) KLT 233, held that the Lok Ayukta cannot issue interim directions contrary to statutory provisions. The petitions were disposed as indicated, with the interim stay made absolute and the jurisdictional limits of the Lok Ayukta reaffirmed.

Submissions & Arguments

Contentions of Appellants / Petitioners

The University challenges Ext.P1 (common order of the Kerala Upa Lok Ayukta) on grounds of lack of jurisdiction to entertain or decide matters relating to university examinations and evaluation. It contends that, under statutory regulations and the Kerala Lok Ayukta Act, 1999, the Lok Ayukta cannot issue interim directions or interfere with the university’s evaluation process; the remedy lies within the University’s statutes, and the court should defer to statutory regulations (citing University of Kerala Parvathy Krishna to support jurisdictional limits). The writ petitions seek quashing of the common order and preservation of status quo in examination matters.

Contentions of Respondents

The respondents defend the Lok Ayukta’s inquiry into alleged malpractice and contend that the university withheld hall tickets and that the Syndicate is the competent authority to decide malpractice. Written comments describe specific malpractice allegations against candidates and maintain that the university acted in accordance with norms. The respondents also rely on the Lok Ayukta’s jurisdiction to ensure accountability in public functioning and argue that interim relief cannot undermine the evidentiary process and statutory regulations.
