Case Synopsis & Summary

Two OP (CAT) petitions filed by the Union of India challenge CAT-era transfer orders of Enforcement Directorate officers from Kochi to Kolkata/Ranji, contending the actions violated transfer guidelines. The Kerala High Court, sitting as a Division Bench, examines whether the Tribunal erred in intervening on grounds that the transfer was not in accordance with guidelines derived from a Supreme Court decision (T.S.R. Subramanian v. Union of India). The Court notes that the Civil Service Board at ED Headquarters is the competent all-India transfer authority for Enforcement Officers and Assistant Directors, and that Annexure A2 sets the transfer process. The Department’s specific contentions in OP 297 (that the Director of Enforcement as Chair of the Transfer Placement Committee decided based on Establishment Section inputs) and OP 303 (that the order was issued by circulation) are central. Clause 2.4 of Annexure A2 prohibits decisions by circulation; the Tribunal’s finding that the Board’s decision was not in strict compliance with the guidelines is upheld to an extent. Ultimately, the Court rejects the petitions, but reserves transfer viability if the Board adheres to guidelines, with costs to be borne by the parties. The decision underscores strict compliance with transfer guidelines and the need for Board meetings for such actions.

Submissions & Arguments

Contentions of Appellants / Petitioners

The Union of India argues that the tenure prescribed in the transfer guidelines constitutes a minimum period (three years) and that transfers must be decided by the Civil Service Board through a formal meeting. It asserts that Annexure A2, constituting the transfer guidelines, requires Board deliberation and signing by all members, not action by circulation within 24 hours of a meeting. Points are raised about ensuring uniformity and fairness (noting that some senior officers have not been touched while others have). The applicants emphasize that a meeting-based decision is essential to comply with the guidelines and EDHQ’s all-India transfer framework, as missteps undermine consistency across offices and can lead to arbitrary transfers. They also stress the Tribunal’s misapplication of guidelines in substituting for the Board’s decision.

Contentions of Respondents

The respondents contend that the transfer orders were issued under the approved guidelines and that the difference between a meeting decision and a circulated decision should not nullify compliance. They highlight that the decision was taken with inputs from the Establishment Section and reflect an intent to adhere to the ED’s transfer policy. In OP 303, the contention was that the order was circulated, which Clause 2.4 of Annexure A2 expressly prohibits; the respondents argue that the administrative process, not merely the form of the decision, should decide validity. They urge deference to executive prudence and argue that the guidelines are sufficient to justify the transfers, pending formal meeting approvals.

The applicants before the Tribunal, who are the respondents herein, challenge their transfer; one an Enforcement Officer (O.P.(CAT) No.297 of 2019) and the other, an Assistant Director (O.P.(CAT) No.303 of 2019) to Kolkata and Ranji respectively. Both are said to be working in Kochi beyond the permissible period; from 2014 and staying beyond their normal tenure. 2. The applicants have a contention that the tenure prescribed even as per the guidelines is a minimum of three years and there are people, who are senior to them, who have not been touched but retained. O.P.(CAT) Nos.297 & 303 of 2019 -4- 3. We notice that the Tribunal has interfered with the transfer on the ground that it is not in accordance with the guidelines, ie, on the recommendation of the Civil Service Board at the Enforcement Directorate Headquarters. Admittedly, the guidelines have been issued on the basis of the decision in _**T.S.R.Subramanian v. Union of India [AIR 2014 SC 263].**_ The Civil Service Board in the Enforcement Directorate, who is competent to transfer employees in the cadre of an Assistant Director and an Enforcement Officer, on an all India basis, as per Annexure A2, is comprised of the Director of Enforcement as Chairman and the Special Director of Enforcement (HQ) and Joint Director (Admn.) as Members. 4. The specific contention taken by the Department in O.P.(CAT) No.297 of 2019 is that the Director of Enforcement, who is also the Chairman of the Transfer O.P.(CAT) Nos.297 & 303 of 2019 -5- Placement Committee has taken the decision based on the recommendations of Establishment Section of Directorate of Enforcement. The decision so taken, under the guidelines at Annexure A2 produced along with the O.A, requires the Board itself to take a decision in a meeting and not by circulation, signed by all the members within 24 hours of the meeting. In O.P.(CAT) No.303 of 2019, the specific contention taken up by the Department was that the decision was taken by circulation. Clause 2.4 of Annexure A2 specifically prohibits such a decision to be taken by circulation. 5. In such circumstances, we find the transfer to be against the norms. We reject the original petitions, but, however, making it clear that if the Board takes the decision in accordance with the guidelines, the respondents are liable to transfer, but leaving open the other contention, which O.P.(CAT) Nos.297 & 303 of 2019 -6- though noticed by us has not been considered. The respective costs are to be borne by the parties. **Sd/K.VINOD CHANDRAN JUDGE** **Sd/-** **V.G.ARUN** **JUDGE** Scl/ 28.11 O.P.(CAT) Nos.297 & 303 of 2019 -7- ## **APPENDIX OF OP (CAT) 297/2019** ## **PETITIONER'S/S EXHIBITS:** **EXHIBIT P1** **TRUE COPY OF OA NO 180/00590/2018 FILED BY THE PETITIONER DATED 6.7.2018 BEFORE THE HON'BLE CAT, ERNAKULAM BENCH** **EXHIBIT P1(A1) TRUE COPY OF THE ORDER (ADMN ) NO 231/2018 DATED 22.6.2018 ISSUED BY THE SECOND RESPONDENT** **EXHIBIT P1(A2) TRUE COPY OF LETTER BEARING K NO 11022/62/2013-AD ED DATED 16TH NO 2015, INCORPORATING THE TRANSFER GUIDELINES** **EXHIBIT P1(A3) TRUE COPY OF THE REPRESENTATION DATED 27.6.2018 ADDRESSED TO THE SECOND RESPONDENT** **EXHIBIT P2 TRUE COPY OF THE REPLY STATEMENT FILED BY THE PETITIONER IN OA NO 180/00590/2018 DATED 21.12.2018** **EXHIBIT P3 TRUE COPY OF THE REJOINDER FILED BY THE APPLICANT IN OA NO 180/00590/2018 DATED 14.1.2019 BEFORE THE CAT, ERNAKULAM BENCH.** **EXHIBIT P4 TRUE COPY OF THE STATEMENT FILED BY RESPONDENTS IN REPLY TO THE REJOINDER DATED 8.3.3019 BEFORE THE HON'BLE CAT, ERNAKULAM BENCH** **EXHIBIT P5 TRUE COPY OF THE ORDER IN OA NO 180/00590/2018 DATED 16.4.2019 OF THE CENTRAL ADMINISTRATIVE TRIBUNAL, ERNAKULAM BENCH** O.P.(CAT) Nos.297 & 303 of 2019 -8- ## **APPENDIX OF OP (CAT) 303/2019** **PETITIONER'S/S EXHIBITS:** **EXHIBIT P1** **TRUE COPY OF OA NO.180/00591/2018 FILED BY THE PETITIONER DATED 06.07.2018 BEFORE THE HON'BLE CAT, ERNAKULAM BENCH.** **EXHIBIT P2 TRUE COPY OF THE REPLY STATEMENT FILED BY THE PETITIONER IN OA NO.180/00591/2018 DATED 08.01.2019.** **EXHIBIT P3 TRUE COPY OF THE MA NO.1251/2018 DATED 14.11.2018 FILED BY THE APPLICANT BEFORE THE CAT, ERNAKULAM BENCH.** - **EXHIBIT P4 TRUE COPY OF THE MA NO.1251OF 2018 DATED 04.02.2019 FILED BEFORE THE CAT,ERNAKULAM BENCH.** - **EXHIBIT P5 TRUE COPY OF THE REJOINDER FILED BY THE APPLICANT TO THE REPLY STATEMENTS FILED BY THE RESPONDENTS BEFORE THE CAT, ERNAKULAM BENCH.** - **EXHIBIT P6 TRUE COPY OF THE STATEMENT FILED BY RESPONDENTS IN REPLY TO THE REJOINDER BEFORE THE HON'BLE CAT, ERNAKULAM BENCH.** - **EXHIBIT P7 TRUE COPY OF THE ORDER IN OA NO.180/00591/2018 DATED 16.04.2019 OF THE CENTRAL ADMINISTRATIVE TRIBUNAL, ERNAKULAM BENCH.** - **EXHIBIT P1(A1) TRUE COPY OF THE ORDER (ADMN) NO.231/2018 DATED 22.6.2018 ISSUED BY THE SECOND RESPONDENT.** **EXHIBIT P1(A2) TRUE COPY OF LETTER BEARING K NO.11022/62/2013-AD.ED DATED 16TH NO.2015, INCORPORATING THE TRANSFER GUIDELINES.** O.P.(CAT) Nos.297 & 303 of 2019 -9- **EXHIBIT P1(A3) TRUE COPY OF THE REPRESENTATION DATED 27.6.2018 ADDRESSED TO THE SECOND RESPONDENT.**
