Case Synopsis & Summary

This combined DBP 17/2024 and WP(C) 2783/2024 concerns the Thrikkaviyoor Mahadeva Temple and alleged irregularities in the Temple Advisory Committee (TAC), a body constituted under Section 31A of the Travancore-Cochin Hindu Religious Institutions Act, 1950, and its bye-laws approved by the Court. Suo motu proceedings were initiated on 06.02.2024 based on complaints dated 02.02.2024 and 03.02.2024 by temple devotees. WP(C)2783/2024 seeks mandamus against respondents to take action under Clause 18 of the bye-laws against the TAC and to consider representations dated 23.11.2023. The State and Travancore Devaswom Board justify the governance framework, citing an ongoing police complaint against TAC, the absconding TAC president with Rs.4.5 lakh, resignation of seven members, and a Board-ordered detailed enquiry by the Chief Vigilance and Security Officer. The court analyzes Sections 31A(1)-(3) and the bye-laws, including Clauses 2 (objectives), 3 (membership), 9 (officers), 12 (Board’s powers), and 18 (prohibitions), alongside Sunil Kumar C. and others v. Travancore Devaswom Board (2022 (4) KHC 663). It directs the convening of a new TAC within three weeks, places temple activities under the ADCS and Group Officer pending audit, and requires action under the rules with Ombudsman oversight within three months.

Submissions & Arguments

Contentions of Appellants / Petitioners

Petitioners contend for mandamus to direct respondents 1-3 to take action against the Temple Advisory Committee under Clause 18 of the bye-laws, and to consider Ext.P1/Ext.P2 representations dated 23.11.2023. They seek action to address alleged irregularities in funds collection and temple management at Thrikkaviyoor Mahadeva Temple, and to constitute or reinstate a new Temple Advisory Committee. They request orders on representations and oversight of accounts, arguing for transparency, accountability, and compliance with the statutory regime under Section 31A and the bye-laws.

Contentions of Respondents

Respondents submit that governance is being regulated under the statutory framework, with a police complaint already filed against the TAC, and that the Board has directed enquiry through the Chief Vigilance and Security Officer. They point to absconding TAC President with Rs. 4.5 lakh and resignations of seven members, resulting in questions of quorum. They contend Clause 18 provides safeguards and urge adherence to due process, with steps to convene a new TAC after enquiry and to audit the accounts under the Board’s oversight.
