## **ORDER**
## Anil K. Narendran, J.
This DBP is registered suo motu, vide proceedings dated 16.06.2023, based on a complaint dated 06.06.2023 made by the petitioner-complainant, who is a devotee of Major Chengalathukavu Devi Temple, which is a temple under the management of the 2[nd] respondent Travancore Devaswom Board, alleging various irregularities committed by the Temple Advisory Committee of that temple.
2. On 20.06.2023 when this DBP came up for consideration, the learned Standing Counsel for the Travancore Devaswom Board sought time to get instructions as to whether Sri.Sanil Kumar, the person against whom allegations are made in the complaint dated 06.06.2023, is presently the President of the Temple Advisory Committee.
3. On 07.08.2023, the learned Standing Counsel submitted that the Board has already taken steps for convening the meeting of the registered mandalam of the devotees to elect the members to the Temple Advisory Committee of Chengalathukavu Devi Temple. It was also pointed out that the person by name, Sanil Kumar, referred to in the complaint dated 06.06.2023, was the President of the Temple Advisory Committee, which was holding the office till 07.09.2022. In the order dated 07.08.2023, this Court noticed that in the printed

notice of ‘Sreemadh Devi Bhagavatha Navahanjanayanjam’, which forms part of that complaint, Sanil Kumar is shown as the President of the Temple Advisory Committee.
4. By the order dated 09.08.2023, the said Sanil Kumar was _suo motu_ impleaded as the additional 7[th] respondent and notice was ordered by speed post, returnable within four weeks.
5. The additional 7[th] respondent has filed a counter affidavit dated 09.09.2023. Paragraphs 2 to 7 of that counter affidavit read thus;
“2. The very complaint itself is dubious, suspicious and without any bonafides which had been preferred by certain persons having vested interest who have an axe to grind against me is writ-large in as much as there is no such Complainant by name ‘C.P.Bhadradevi’ and the address shown as ‘Devaswom Parambil’ etc. are highly suspicious. The 1[st] Paragraph of the Complaint itself is incorrect and the postal endorsement of the letter sent to the petitioner by this Court which was returned itself will reveal the nature of the Complaint. The allegation in Paragraph No.1 of the Complaint that I was the president of the Samithi is not fully correct and hence denied. It is also incorrect to say that I was continued for a long term as President of 6[th] Respondent – Temple Advisory Committee. It is to be noted that one Santhosh Moothedath was elected as the President of TAC, who later in 2020 dissociated with the TAC that I was elected to the committee in later half of 2020, and by the time, the Covid-19 pandemic struck the country and the entire activities of the temple was paralyzed. The allegation that I was ruling like an autocrat etc. are false and fancible allegations of the hidden Complainant. It is also to be noted that for nearly 2 years, there was absolutely no activities

could be undertaken by the TAC on account of the Covid situation. It is in the said circumstances, that the existing committees of the temple were extended by the Commissioner and thereafter by the board on a case to case basis having regard to the local situation requiring the continuance of the Committees for the completion of the ongoing constructions.
3. The entire allegation in Paragraph 2 of the so-called Complaint is false and hence denied. This Respondent has never associated with any construction of any stage and 'pandal'. The 'pandal' which was constructed was fully sponsored by a devotee by name 'V.S Ganapathi Namboodiri'. The allegation that I have sought extension of the term of the Committee citing the construction of 'pandal' is absolutely baseless. The extension was sought for only on account of total non-function of the TAC due to Covid-19 situation. Therefore the entire allegation is baseless and false.
4. The entire allegations in Paragraph 3 of the so-called complaint is absolutely incorrect and hence denied. It is to be noted that as far as conduct of 'Navaaham' is concerned, the total amount sanctioned for printing the sealed receipts is worth Rs.1,80,000/-. The sealed receipts were issued, sold and properly accounted and the balance unsold receipts were returned with proper statistics. The Copy of accounts of the TAC for the period 01.01.202131.01.2023 is produced herewith and marked as Exhibit-R7A. In addition to the above, it is to be noted that in connection with the conduct of 'Navaaham, expenses have to be incurred for the conduct of the same. As far as the nine days' Navaaham' is concerned, group of persons having numbers 21, 32, 42 etc. submitted group request for conducting poojas on each of the days of 'Navaaham'. Such requests were allowed by the Board and the entire expenses were met by the those persons and this has nothing to do with the affairs of the TAC. The allegation that for conducting 'Annadanam', poojas and 'pushpalankaram' no receipt has been issued to the 'Vazhipaadukaran' is absolutely incorrect.
```
6
```
DBP No.50 of 2023
No such things had happened as alleged. The allegation relating to the 'Chattam' are farfetched and the same are absolutely incorrect and hence denied. I never misrepresented any person in relation to the fact there was no sufficient fund with the Devaswom to purchase the 'Chattam' nor I have collected any money in respect of any of those issues. I never collected any money not purchased any chattam as alleged in the Complaint. The so-called Complainant totally mislead this Court by giving false and frivolous allegations without any basis.
5. The entire allegation in the Complaint that I have misappropriated money and have collected money from abroad for the purpose of galvanization with brass of the 'Sopanam' and ‘Namaskara Mandapam'. It is submitted that I was never expelled from the Committee at any point of time for any reason and the allegations in that regard are absolutely false and emphatically denied.
6. The intention of the Complainant who is hiding in the dark which transparently evidences the wickedest and the spite and ill-will that was nursed by certain sectarian people against me who did not wanted any development to happen in the temple is behind the present false complaint.
7. In view of the above, this Respondent is ready to submit all the books of accounts and details if warranted in relation to the period during which he was the president of TAC. This Respondent has not committed any act of nonfeasance or misfeasance. The present Complainant is nothing but on account of personal vengeance and to malign the reputation of this Respondent. Therefore, the present Complaint and all further proceedings may be closed. Prayed accordingly.”
6. On 20.10.2023, when this DBP came up for consideration, the learned Standing Counsel for Travancore Devaswom Board, on
instructions, submitted that the audited accounts of the 6[th]

respondent Temple Advisory Committee for the year 1198 ME is yet to be submitted before the 5[th] respondent Assistant Devaswom Commissioner. The learned Standing Counsel also sought time to get instructions as to whether the account for the previous periods have already been subjected to statutory audit. Regarding the formation of the Temple Advisory Committee, the learned Standing Counsel submitted that though meetings of the registered mandalam were convened on 21.08.2023 and 05.10.2023, there was no consensus. Thereafter, in the meeting of the registered mandalam held on 13.10.2023, the members of the Temple Advisory Committee were elected and the list of members have already been forwarded to the 3[rd] respondent Devaswom Commissioner for approval.
7. Heard the learned Senior Government Pleader for the 1[st] respondent, the learned Standing Counsel for Travancore Devaswom Board for respondents 2 to 5 and also the learned counsel for the additional 7[th] respondent.
8. Section 31A of the Act, which deals with formation of Temple Advisory Committees, reads thus;
“31A. Formation of Temple Advisory Committees.- (1) A Committee for each temple in the name “Temple Advisory Committee” (name of the temple) may be constituted in order to ensure participation of Hindu devotees.
(2) The Temple Advisory Committee constituted under subsection (1) may be approved by the Board.

(3) The composition of an Advisory Committee under subsection (1) shall be in such manner as may be prescribed by rules made by the Board, not inconsistent with any practice, prevailing, if any.” (underline supplied)
9. In exercise of the powers under sub-section (3) of Section 31A of the Act, the Travancore Devaswom Board framed Rules (bye-laws) for the formation of Temple Advisory Committees in temples under its management, which was approved by this Court in the order dated 03.11.2011 in DBA No.153 of 2009.

Bench of this Court in which one among us [Anil K. Narendran, J.] was a party noticed that, a reading of the provisions under Clause
(9) of the Rules make it explicitly clear that the construction or repair or renovation work that has to be undertaken in a temple is not outside the purview of the Temple Advisory Committees constituted under Section 31A of the Act. It would certainly be open to the Travancore Devaswom Board to undertake such construction, repair or renovation work in a temple, directly by its Maramath Department. However, when the Board has chosen to undertake such construction or repair or renovation work in a temple through a committee, under the supervision of the officials

Temple Advisory Committee constituted under Section 31A of the Act, under constant supervision and scrutiny by the concerned officers of the Travancore Devaswom Board, in order to ensure that the activities of the committee is in compliance with the directions issued by the Board. When the provisions under Section 31A of the Act contemplates constitution of a Temple Advisory Committee in the temples under the management of the Board, which is assigned with various duties as per the Rules, which includes undertaking various developmental activities in the temple, the normal rule is that any developmental activity in a temple, which is not undertaken directly by the Travancore Devaswom Board through its officials in the Maramath Department, has to be undertaken through the Temple Advisory Committee. In view of the provisions contained in Clause (2), Clause (9) and Clause (11) of the Rules, and also the law laid down by this Court in **Chandu K.**
**v. Travancore Devaswom Board [2021 (3) KHC 379]** , we find that the construction, repair or renovation work that has to be undertaken in a Temple is not outside the purview of the Temple Advisory Committees constituted under Section 31A of the Act.

19. As per Clause (11) of the Rules, the term of the Temple Advisory Committee shall be two years from the date of approval of the Committee by the Department. The Devaswom Commissioner is empowered to extend the term of the Temple Advisory Committee for a further period of one year on the ground of any development works or unavoidable rituals. On the aforesaid grounds the Travancore Devaswom Board can extend the term for a further period of one year. 20. In **Chandu K. v. Travancore Devaswom Board [2021 (3) KHC 379]** a Division Bench of this Court held that, with the insertion of Section 31A to the Travancore Cochin Hindu Religious Institutions Act the formation of Temple Advisory Committees in temples has become statutory. in exercise of the rule making power under clause (a) of subsection (2) of Section 35 of the Act, has framed rules for the formation of Temple Advisory Committees in temples under the Travancore Devaswom Board and this Court has approved the draft bye-laws by the order dated 03.11.2011 in DBA No. 153 of 2009. Clause (11) of the Rules deals with the term of office of the Temple Advisory Committee. As per Clause (11), the term of office of the Temple Advisory Committee shall be two years from the date of approval of the election by the Devaswom Commissioner. The Devaswom Commissioner has the authority to extend the term of the committee by one year in case of development works or unavoidable rituals in the temple. to be extended beyond the period of two years. Thus, the term of the committees is statutorily fixed. The term can be extended by one year or up to two years under certain unavoidable circumstances and no longer. The object of providing duration of office of Temple Advisory Committees in the approved bye-laws is to see that timely elections are held and the constitution of the Committees are not delayed.
