Case Synopsis & Summary

This writ petition challenges alleged unauthorised land acquisition and possession for the Kaippattoor–Pathanamthitta road widening project in Omalloor, Pathanamthitta. The petitioners claim their properties were taken possession by respondents for road construction without following the due process of law and without proper acquisition under the Land Acquisition Act. They seek measures to confirm the present status of the road project, ascertain whether any portions of their land were used for construction without formal acquisition, and, if so, secure compensation. They pray for mandamus relief to ensure fair procedures and to restrain forcible possession until compliance with legal norms. The respondents contend that the road work is already completed and that no properties have been taken for the project. They propose measurement of disputed properties by the District Collector’s office, after which details will be shared with petitioners and they will be afforded an opportunity of hearing. If any property has indeed been acquired, compensation would be paid under the law. The court, after hearing, disposed of the petition by directing measurement, hearing, and expeditious subsequent action, clarifying that compensation will be paid if acquisition is proven.”

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that the Kaippattoor–Pathanamthitta road widening project proceeded without proper acquisition procedures, and that portions of their land were taken for construction, effectively dispossessing them without due process. They request the court to direct respondents 2 and 3 to undertake a study to determine the present position of the road and to assess whether widening is feasible without encroaching on petitioners’ lands. If any portion is required, they seek initiation of proceedings under the Land Acquisition Act before possession is taken. They also urge the 4th respondent Panchayath be restrained from forcible possession pending lawful acquisition, and they seek compensation if any land has been taken, as per law. Lastly, they seek costs of the petition.

Contentions of Respondents

The respondents submit that the road work is already completed and that no properties have been taken for the project. They propose that respondents 2 and 3 measure the disputed properties, after which petitioners would be given an opportunity of hearing. The 2nd respondent would then issue orders expeditiously, and if any land is actually acquired, compensation would be paid in accordance with law.
