Case Synopsis & Summary

Thrissur District SC/ST Small Scale Industries Merchants Association, a body representing SC/ST entrepreneurs involved in small-scale industries, filed WP(C) No. 4060 of 2019 seeking constitutional redress. The petition challenges the Thrissur District Mini Industrial Estate Co-Operative Society Ltd (3rd respondent) for collecting rent from its members despite the allotment orders by the District Industries Centre (DIC) under the Government SCP fund program, which purportedly did not include rent obligations. The petition asserts that the government land and public land allotted for the welfare of SC/ST entrepreneurs, after construction of the sheds, were to be allotted to SC/ST members, with ownership ultimately to be transferred upon payment of reasonable consideration. The 3rd respondent is alleged to discriminate against SC/ST members by charging exorbitant rents and by ceding some plots to general category members. The petition relies on a prior Kerala High Court decision in Maradu Market Traders’ Association v. State of Kerala (2018) to argue that relief should be granted on behalf of the members. Ext.P6, a representation dated 2.8.2018 before the Director of Industries and Commerce, seeks handover of ownership and cessation of rent, which is the subject of scrutiny. The court, while hearing counsel for the petitioners and respondents, disposed of the matter with directions guiding a timely consideration and reporting process, ultimately directing a two-month timeframe for decision after hearing, and transferring the matter toward final disposal with protective orders.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that the SC/ST association members were allotted industrial sheds by the District Industries Centre under the SCP scheme, with the construction funded by public resources; the allotment orders do not stipulate rent; the 3rd respondent cooperative society is collecting rent from members, including SC/ST members, and some rooms were sold to general category members—causing discrimination. Ext.P6 seeks handover of ownership upon reasonable consideration and cessation of rent; the petition seeks mandamus compelling the respondents to grant relief and to decide Ext.P6 via a fair hearing.

Contentions of Respondents

The respondents’ argument is reflected in their defense via the appearance of the Senior Government Pleader; the document indicates that the 2nd respondent’s report was sought and that the 1st respondent should examine Ext.P6 with due process. The court’s observations indicate reliance on existing allotment and fund utilization records, while directing inquiry, hearing, and timely decision rather than a final adjudication on merits at this stage.
