Case Synopsis & Summary

The petitioner, Thresiamma Simon, sought to compel numbering of a building constructed in 2000 on her property based on Ext.P2 NOC issued by the Panchayat. For about 22 years the building has remained unnumbered, with the Panchayat citing multiple defects and a lack of adequate setback from the adjacent PWD road as grounds for inaction. Representations to the Panchayat and the District Town Planner for numbering and regularization were rejected, and the Panchayat contended that there are procedural and construction-related defects, including violations of Rules 47 and 104 of the Kerala Panchayat Building Rules, 2011, and Section 220(b) of the Kerala Panchayat Raj Act. The Tahsildar, after inspection by the Taluk Surveyor, reportedly opined that the petitioner has not encroached, and the petitioner asserts she has left a setback of 5.4 meters from the road. The State and other respondents argue caution and procedural compliance, and that numbering cannot be done without addressing these defects. The Court contemplated a resolution by district-level authorities, allowing the petitioner to file a representation before the 2nd respondent within two weeks, and directing the 2nd respondent to obtain reports, provide hearing, and pass orders within two months. It also requires issuance of notices for other defects and possible cure or explanation by the petitioner.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner submits that she constructed a building in 2000 on the strength of Ext.P2 NOC issued by the 6th respondent Panchayath. Despite the long lapse of 22 years, the building remains unnumbered. The petitioner asserts there is no encroachment and that Tahsildar’s report after inspection by the Taluk Surveyor confirms this. She contends that the setback from the PWD road is 5.4 meters, and that the Panchayat’s insistence on further verification of road width and boundaries is unwarranted. Representations made to the Panchayat and to the District Town Planner seeking numbering and Ext.P8 relief have been rejected. The petitioner seeks a mandamus directing the 6th respondent to number the building and to pass orders on Ext.P8 within two months, and directs the 2nd respondent to consider the representation after hearing and after obtaining reports from the PWD and Panchayat, with opportunity for all affected parties to be heard. She also seeks a prompt resolution by addressing other alleged defects. Her prayer is for a writ of mandamus or other appropriate relief in the interest of justice.

Contentions of Respondents

The respondents contend that the building violates set-back requirements with respect to the PWD road and that there are multiple defects under the Kerala Panchayat Raj Act, including Section 220(b), and Rules 47 and 104 of the Kerala Panchayat Building Rules, 2011. They submit that numbering cannot be done in isolation and require a district-level review, including reports from the PWD and Panchayat, and an opportunity for hearing. They argue that the 2nd respondent, after receiving representations, must obtain relevant reports and conduct a hearing before passing appropriate orders. They request due process and caution in applying the law, given the discrepancies in the setback, violations alleged under the Rules, and the potential need for corrective measures. They emphasize that Ext.P2 is not a final sanction and that compliance with statutory safeguards is essential before numbering and regularization can be granted.

The petitioner constructed a building in her property in the year 2000, on the basis of Ext.P2 NOC issued by the Panchayat. It is the case of the petitioner that, despite the lapse of about 22 years, the same is not numbered because of several reasons mentioned by WP(C) NO. 1695 OF 2021 4 the Panchayat. One of the reason for not numbering the building is that there is lack of sufficient distance from the PWD road abutting the property. It is the case of the petitioner that representations were submitted before the Panchayat as well as the District Town Planner for numbering the building, but the same were rejected stating that there is lack of 3 meters setback from the road margin. It is also stated in the writ petition that the Tahsildar on the basis of the inspection, measurement and report of the Taluk Surveyor, conclusively and categorically opined that the petitioner has not made any encroachment. It is also the case of the petitioner that the petitioner has left a setback of 5.4 meters from the road. It is the case of the petitioner that, even then the Panchayat is refraining from numbering the building. It is also stated that the Panchayat is unnecessarily enquiring the width and boundaries of the road to determine whether sufficient setback is available between the building and the road. The petitioner submitted a detailed representation before WP(C) NO. 1695 OF 2021 **==> picture [7 x 9] intentionally omitted <==** the 6[th] respondent, but even then there is no response. Hence this writ petition is filed. 3. Heard counsel for the petitioner, the learned Government Pleader and the learned Standing counsel appearing for the 6[th] respondent. 4. Counsel for the petitioner reiterated his contentions in the writ petition. Standing counsel appearing for the 6[th] respondent on the other hand submitted that there is lack of setback from the road and there are other reason also for not numbering the building. The Government Pleader takes me through paragraph 3 of the counter affidavit filed by the 3[rd] respondent. 5. This Court considered the contentions of the petitioner and the respondents. It is the definite case of the petitioner that the building is constructed in the year 2000 and even now the number is not given by the Panchayat. The case of the Panchayat is that there is several defects in the construction and one of the same is about the setback that is necessary from the PWD WP(C) NO. 1695 OF 2021 6 road as per Section 220(b) of the Kerala Panchayat Raj Act. The Standing counsel appearing for the 6[th] respondent submitted that there are other defects also namely violation of Rules 47 and 104 of the Kerala Panchayat Building Rules, 2011. Since there is a dispute about the setback provided by the petitioner to the PWD road, I think this is a matter to be looked into by the District Collector or an officer authorised by the District Collector. For that purpose, the petitioner can file a representation before the 2[nd] respondent narrating her grievance within a time frame, so that the District Collector or the officer deputed by him can consider the same, after getting a report from the PWD authorities and the Panchayat and also after giving an opportunity of hearing to the petitioner and the other affected parties. As far as the other defects are concerned, the Panchayat will issue a notice to the petitioner about the defects existing and the petitioner can take appropriate steps to cure the defects, if it is possible or the petitioner can give explanation to the notice. WP(C) NO. 1695 OF 2021 **==> picture [7 x 8] intentionally omitted <==** Therefore this writ petition is disposed of in the following manner: _i. The petitioner is free to submit a representation before the 2[nd] respondent, narrating her grievance, within a period of two weeks from the date of receipt of a copy of this judgment._ _ii. Once such a representation is received, the 2[nd] respondent/authorised officer will consider the same and pass appropriate orders in it, after giving an opportunity of hearing to the petitioner and respondents 6 and 7._ _iii. Before passing orders as directed above, the District collector/authorised officer will get a report from the 7[th] respondent and the Panchayat._ _iv. The 2[nd] respondent will pass appropriate orders as directed above, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a copy of this judgment._ _v. The 6[th] respondent is directed to issue notice to the petitioner about the other defects, if any, in the construction made by the petitioner within two weeks_ WP(C) NO. 1695 OF 2021 **==> picture [7 x 10] intentionally omitted <==** _from the date of receipt of a copy of this judgment._ _vi. If such a notice is received, the petitioner is free to cure the defects or if she has got any grievance against the same, she is free to submit her explanation, within a period of two weeks from the date of receipt of the notice._ _Vii. Once the explanation is received, 6[th] respondent will consider the same and pass appropriate orders in it, after giving an opportunity of hearing to the petitioner._ Sd/- DM **P.V.KUNHIKRISHNAN JUDGE** WP(C) NO. 1695 OF 2021 9 ## **APPENDIX OF WP(C) 1695/2021** PETITIONER EXHIBITS |EXHIBIT P1|A TRUE COPY OF THE PHOTOGRAPH OF THE| |---|---| ||PETITIONER'S BUILDING.| |EXHIBIT P2|A TRUE COPY OF THE NOTC DATED| ||4.12.1999 GRANTED BY THE 6TH| ||RESPONDENT FOR CONSTRUCTION OF THE| ||PETITIONER'S BUILDING.| |EXHIBIT P3|A TRUE COPY OF THE LETTER DATED| ||30.8.2018
ISSUED
BY
THE
3RD| ||RESPONDENT TO THE 6TH RESPONDENT.| |EXHIBIT P4|A TRUE COPY OF THE LETTER DATED| ||2.11.2018
ISSUED
BY
THE
4TH| ||RESPONDENT TO THE PETITIONER.| |EXHIBIT P5|A TRUE COPY OF THE LETTER DATED| ||19.6.2019
ISSUED
BY
THE
6TH| ||RESPONDENT TO AND THE 7TH RESPONDENT.| |EXHIBIT P6|A TRUE COPY OF THE LETTER DATED| ||19.6.2019
ISSUED
BY
THE
6TH| ||RESPONDENT TO THE 5TH RESPONDENT.| |EXHIBIT P7|A TRUE COPY OF THE LETTER DATED| ||3.10.2019
ISSUED
BY
THE
3RD| ||RESPONDENT TO THE 6TH RESPONDENT.| |EXHIBIT P8|A TRUE COY OF THE REPRESENTATION| ||DATED 25.6.2020 SUBMITTED BY THE| ||PETITIONER BEFORE THE 6TH RESPONDENT.| |EXHIBIT P9|A TRUE COPY OF THE RECEIPT DATED| ||25.6.2020
ISSUED
BY
THE
6TH| ||RESPONDENT TO THE PETITIONER.| RESPONDENTS EXHIBITS : NIL //TRUE COPY// PA TO JUDGE
