Case Synopsis & Summary
Telma P.G. and others, wife, daughter, father and mother of the deceased Birthalomia, challenge the Motor Accidents Claims Tribunal, Ernakulam’s 2011 award in OP(MV) 501/2008 for a road-traffic death. The Tribunal awarded Rs 5,38,175 in compensation, well short of the appellants’ claim of Rs 16 lakh. The appellants contended that the deceased was earning Rs 12,000 per month as a driver, while the Tribunal had fixed monthly income at Rs 3,500. They urged applying the Ramachandrappa approach to fix a higher income and the 25% addition for a person below 50 years as per Pranay Sethi. The respondents contested the quantum. The High Court, allowing the appeal in part, fixed the deceased’s monthly income at Rs 6,500 (citing Ramachandrappa). With the 25% addition, the notional monthly dependency became Rs 8,125. Applying 12 months, a 13-year multiplier, and a 3/4 deduction yielded Rs 9,50,625 as loss of dependency. The Tribunal’s Rs 4,09,500 on this head was deemed short, entitling the appellants to Rs 5,41,125 more. Additional enhancements under conventional heads per Pranay Sethi, and reductions per Satinder Kaur on pain, suffering and love/affection were considered. The appeal is allowed; total compensation is Rs 12,69,300, with Rs 5,38,175 already awarded and Rs 7,31,125 enhanced, payable with interest, deposit within two months by the insurer.
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants contended that the deceased was earning Rs 12,000 per month as a driver and that the MACT award fixed only Rs 3,500 monthly income. Relying on Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Co. Ltd. (2011) 13 SCC 236, they urged a higher monthly income. They also urged applying the 25% addition for a person below 50 years as per Pranay Sethi (2017) 16 SCC 680 and sought enhancements under conventional heads in line with Pranay Sethi, including pain and suffering and loss of love and affection, and loss of consortium.
Contentions of Respondents
The respondents disputed the quantum; they opposed the higher income fixation and argued against substantial enhancement of the award. The KSRTC contended that the Tribunal’s findings should be maintained, contesting the proposed amendments under heads of compensation; they formally opposed the submissions for increased income and consequential enhancements.
