Case Synopsis & Summary
Sundaram Home Finance Ltd, a housing finance company, obtained an equitable mortgage over the property as security for loans to the 5th respondent (and with 3rd and 4th respondents as her son and daughter-in-law). After default, the petitioner invoked the SARFAESI Act to recover the debt and initiate sale. In 2016, an attachment over the property was placed at the instance of the 4th respondent, who is a co-borrower and related to the 5th respondent. The petitioner contends the attachment is improper and collusive, since the 4th respondent is fully aware of the mortgage, and seeks erasure of the attachment so that Ext.P8, the Sale Certificate, can be registered in favor of the purchaser. The petitioner argues that the sale process has progressed and that the registration is blocked only due to the attachment. The State and other respondents submit that the Sub Registrar cannot oppose erasure, but registration of the Sale Certificate can occur only if a Tandaper/ROR certificate is produced by the petitioner or purchaser. The court, however, held that the bank’s right to proceed cannot be questioned and directed registration of Ext.P8 without insisting on an ROR certificate, while directing the Tahsildar to transfer registry and permit land tax payments without a Tandaper/ROR requirement and to erase the attachment within a week of Ext.P8’s registration.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner-bank asserts it holds an equitable mortgage created by the 5th respondent in 2013 as security for a loan facility; after default, it invoked SARFAESI proceedings. An attachment was placed over the property by the 4th respondent, a co-borrower, in 2016. The petitioner contends the 4th respondent’s action is collusive and improper since she is aware of the mortgage and is a co-borrower. It seeks erasure of the attachment so that Ext.P8 Sale Certificate can be registered and registration of sale completed in the purchaser’s favor. It argues that sale is ready, but registration is blocked by the attachment.
Contentions of Respondents
The Sub Registrar argued that erasure of the attachment may be allowed, but registration of the Sale Certificate requires a Tandaper Certificate or ROR certificate. The court was urged to dispose of the petition on terms allowing registration without ROR and to permit registry transfer and land tax payment without Tandaper. The Sub Registrar’s role and verification of property details were flagged, with the caution that Tandaper/ROR should not be insisted on unduly.
