Case Synopsis & Summary

The petitioner, Sreevidhya Maniyan, is the Joint Secretary of the Temple Advisory Committee (Upadesaka Samithi) of Thiruvarppu Sri Krishna Swamy Temple, a temple under the Travancore Devaswom Board. He/she has filed this writ petition under Article 226 challenging Ext.P5, an order dated 15 June 2023 by the 3rd respondent Travancore Devaswom Board Commissioner, dissolving the Temple Advisory Committee. The petitioner seeks a writ of certiorari to quash Ext.P5 and a mandamus to reinstate the previous Temple Advisory Committee to complete its remaining tenure and undertake the Pariharapooja and related Devaprasnam activities. The case traces to proceedings under Clause 18 of the Rules (bye-laws) framed under sub-section (3) of Section 31A of the Travancore-Cochin Hindu Religious Institutions Act, 1950, against the Temple Advisory Committee for displaying a QR code link to its bank account, leading to UPI transactions. The 3rd respondent’s order cites alleged violations of the bye-laws and the Board’s powers to dissolve committees. The petitioner argues the QR code issue resulted from a bank manager’s mistake and that funds collected via UPI could be adjusted against sealed coupons, with reinstatement essential to fulfill commitments made during Devaprasnam. The respondents contend Ext.P5 is a valid exercise of power under Clause 18, with the committee’s term having expired and steps already underway to form a new mandalam. The court, relying on statutory provisions and precedent, ultimately dismisses the petition, upholding Ext.P5 and directing interim management by the 4th and 5th respondents while steps to form a new committee proceed.

Legal Doctrines & Maxims

  • Extraordinary jurisdiction of the High Court under Article 226 of the Constitution of India
  • Clause (18) bye-laws provide safeguards to prevent illegal collection of funds; QR-based fund collection without sealed coupons is a financial irregularity; reliance on precedent to uphold administrative actions within statutory framework

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner submits that Ext.P5 dissolving the Temple Advisory Committee was issued without proper justification and that the QR code-linked fund collection occurred due to a branch manager’s error. Funds collected via UPI could be offset against sealed-pariharakriyas; reinstatement of the committee is essential to complete Pariharapooja and Devaprasnam obligations, and the Court should reinstate the committee pending the remaining tenure.

Contentions of Respondents

The respondents contend Ext.P5 is a valid exercise under Clause (18) of the bye-laws and Section 31A, as the Temple Advisory Committee’s term ended; the Board’s mechanism for formation of a new mandalam is already in motion; the QR-code collection without sealed coupons violates bye-laws and constitutes financial irregularity; the Court should not interfere with the Board’s exercise of statutory powers under Article 226.

Narendran, J.** The petitioner, who was the Joint Secretary of the Temple Advisory Committee (Upadesaka Samithi) of Thiruvarppu Sri Krishna Swamy Temple, which is a temple under the management of the Travancore Devaswom Board, has filed this writ petition under Article 226 of the Constitution of India, seeking a writ of certiorari to quash Ext.P5 order dated 15.06.2023 of the 3[rd] respondent Commissioner, Travancore Devaswom Board, whereby the Temple Advisory Committee stands dissolved, for the reason stated therein. The petitioner has also sought for a writ of mandamus commanding the 3[rd] respondent Commissioner and the 4[th] respondent Assistant Devaswom Commissioner to reinstate the previous Temple Advisory Committee (Upadesaka Samithi) to complete its remaining tenure and the remaining ‘Pariharapooja’ and such other related activities, thereby fulfilling the promise made by the said committee to the deity, during ‘Devaprasnam’. 2. The pleadings and materials on record would show that proceedings under the provisions of Clause 18 of the Rules (byelaws) for the constitution of the Temple Advisory Committees in temples under the management of the Travancore Devaswom Board, framed under sub-section (3) of Section 31A of the TravancoreCochin Hindu Religious Institutions Act, 1950, was initiated against 4 W.P(C)No.1972 of 2024 the Temple Advisory Committee of Thiruvarppu Sri Krisha Swami Temple, in which the petitioner was the Joint Secretary, for displaying in the temple premises ‘QR code link’ to its bank account, which contained the name ‘e-hundi’, leading to certain UPI transactions. The President and Secretary of the Temple Advisory Committee were issued with show cause notice, to which the Secretary submitted an explanation dated 20.05.2023. The 3[rd] respondent Devaswom Commissioner called for a report dated 29.05.2023 of the 4[th] respondent Assistant Devaswom Commissioner. Thereafter, the 3[rd] respondent issued Ext.P5 order dated 15.06.2023, whereby the Temple Advisory Committee stands dissolved for the reasons stated therein. 3. On 31.01.2024, when this writ petition came up for admission, this Court allowed I.A.No.2 of 2024, whereby the Deputy Director, Kerala State Audit Department, Travancore Devaswom Board Audit was impleaded as the additional 6[th] respondent. 4. Heard the learned counsel for the petitioner, the learned Senior Government Pleader for respondents 1 and 6 and the learned Standing Counsel for Travancore Devaswom Board for respondents 2 to 4. 5. The issue that requires consideration in this writ petition is as to whether any interference is warranted on Ext.P5 order dated 5 W.P(C)No.1972 of 2024 15.06.2023 of the 3[rd] respondent Devaswom Commissioner, whereby the Temple Advisory Committee of Thiruvarppu Sri Krishna Swamy Temple stands dissolved, for displaying in the temple premises ‘QR code link’ to its bank account, leading to certain UPI transactions. The reasoning of the 3[rd] respondent Devaswom Commissioner in the last paragraph of Ext.P5 order reads thus; “തിരുവാർ്ᩔ് ദേവസ്വം ഉപദേശക സ്മിതിയുടെ സ്മാധാനം പരിദശാധി്ചതിൽ നിന്ും ഉപദേശക സ്മിതി സ്ൂചന (1) പ്പകാരമു്ᩦ വി്ᨺാപന്ᩈിടെ നിബ്യനകൾ്ക് വിരു്ധമായി വയ്വമായ സ്ാ്ᩘ്ᩈിക പ്കമദ്കെുകൾ പ്ശ്ധയിൽട്ᩔ്ᨾി്ᨾു്ᩦതും ദേപ്ത വരുമാനം രസ്ിത് നൽകാടത ഇ-കാണി്ക വഴി കയൂആർ ദകാഡ്, ്ⵄകാൻ ടചയത ഉപദേശക സ്മിതിയുടെ അ്കൗ്ᩂിദെ്ക് സ്വീകരി്കുന്തിന് ദയാഗം ദചരുകദയാ മിനി്⴫്ⵄ ദരഖട്ᩔെു്ᩈി തീരുമാന്ᩈിന് ദേവസ്വം ദബാർഡിൽ നിന്ും അനുമതിയ്ക് യാടതാരു അദപേയും ഉപദേശക സ്മിതി ടച്ᩞാതിരുന്തിെൂടെ പണം സ്മാഹരണം െഭി്കുടമന ഉറ്ᩔുട്ᩂ്ഝിെും ദേവസ്വം ദബാർഡിൻ്്ടറ അനുമതി ഇെലാടത എ്ബുമാകാടമന്താണ് ഉപദേശക സ്മിതിയുടെ പ്പവർ്ᩈന്ങളിൽ നിന്ും വയ്വമാകുന്ത് കൂൊടത സ്ൂചന (1) ബബൊയിടെ നിബ്യന 18 ന്ടറ വയ്വമായ െംഘനം നെ്ᩈിയി്ᨾു്ᩦതിനാൽ തിരുവാർ്ᩔ് ദേവസ്വം ഉപദേശക സ്മിതിടയ ദേവസ്വം ദബാർഡിൻ്്ടറ അധികാര അവകാശ്ങൾ (നിബ്യന 12) വിനിദയാഗി്ച് പിരി്ച് വി്ᨾ് ഉ്ᩈരവാകുന്ു.” 6. The learned counsel for the petitioner would submit that the display of ‘QR code link’ to the bank account of the Temple Advisory Committee of Thiruvarppu Sri Krishna Swamy Temple, in the temple premises, leading to certain UPI transactions, was on account of a mistake committed by the Branch Manager, State Bank of India, Thiruvarppu Branch, as evident from Ext.P4 communication dated 19.05.2023 of the Branch Manager, addressed to the 4[th] respondent Assistant Devaswom Commissioner. For 6 W.P(C)No.1972 of 2024 ‘Pariharakreeyas’, the 4[th] respondent Assistant Devaswom Commissioner has authorised the Temple Advisory Committee to collect a total sum of Rs.2,25,000/-, against sealed coupons. Therefore, any money collected in the bank account of the Temple Advisory Committee through UPI transactions, on account of the display of ‘QR code link’ in the temple premises, can be adjusted against those sealed coupons. As such, the collection of money from the devotees through UPI transactions is no serious irregularity. The Temple Advisory Committee has to complete ‘Pariharakreeyas’, in terms of the ‘Devaprasnam’ conducted in March 2023, for which its reinstatement is highly essential. 7. Per contra, the learned Standing Counsel for Travancore Devaswom Board would submit that Ext.P5 order passed by the 3[rd] respondent Devaswom Commissioner is issued in view of the provisions under Clause (18) of the Rules (bye-laws) framed by the Travancore Devaswom Board for the formation of Temple Advisory Committees in the temples under its management. That order warrants no interference in the exercise of the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India. The learned Standing Counsel would point out that the term of the Temple Advisory Committee of Thiruvarppu Sri Krishna Swamy Temple is already over on 02.10.2023. Since the annual 7 W.P(C)No.1972 of 2024 festival of the temple is scheduled to commence on 14.04.2024, the 4[th] respondent Assistant Devaswom Commissioner has taken steps for convening the General Body of the devotees in the ‘registered mandalam’. For that purpose, a notification has already been issued, inviting applications for new membership. 8. Section 31A of the Travancore-Cochin Hindu Religious Institutions Act deals with the formation of Temple Advisory Committees. As per sub-section (1) of Section 31A, a Committee for each temple, in the name “Temple Advisory Committee” (name of the temple), may be constituted in order to ensure the participation of Hindu devotees. As per sub-section (2) of Section 31A, the Temple Advisory Committee constituted under sub-section (1) may be approved by the Board. As per sub-section (3) of Section 31A, the composition of an Advisory Committee under sub-section (1) shall be in such manner as may be prescribed by rules made by the Board, not inconsistent with any practice, prevailing, if any. 9. In the exercise of the powers under sub-section (3) of Section 31A of the Act, the Travancore Devaswom Board framed Rules (bye-laws) for the formation of Temple Advisory Committees in the temples under its management, which has been approved by this Court, by the order dated 03.11.2011 in DBA No.153 of 2009. 8 W.P(C)No.1972 of 2024 ## 10. In **Sunil Kumar C. and others v. Travancore Devaswom Board and others [2022 (4) KHC 663]** a Division Bench of this Court in which one among us [Anil K. Narendran, J] was a party, held that the provisions under Clause (18) of the Rules provide sufficient safeguards to prevent illegal collection of funds by the Temple Advisory Committee for development activities in a temple. 21. Clause (18) of the Rules (bye-laws) framed under subsection (3) of Section 31A of the Travancore-Cochin Hindu Religious Institutions Act, 1950 prohibits the Temple Advisory Committee from collecting funds in connection with any ceremonies in the temple by placing kanikkavanchi or hundies. When coupons are printed for development activities in the temple, with the approval of the Department, only coupons for the specified amount shall be printed. No receipts without the seal of the Assistant Commissioner shall be used for collecting funds. 22. In view of the provisions under Clause (9) of the Rules (bye-laws) framed under sub-section (3) of Section 31A of the Travancore-Cochin Hindu Religious Institutions Act, 1950 and the 16 W.P(C)No.1972 of 2024 law laid down by this Court in **Sunil Kumar C. [2022 (4) KHC 663]** , the collection of funds by the Temple Advisory Committee of a temple under the management of the Travancore Devaswom Board, in connection with any festival or ceremonies in the temple, or otherwise, by placing Kanikka Vanchi or Hundis or collection of funds without sealed coupons issued by the Assistant Commissioner, will amount to a financial irregularity by the Temple Advisory Committee. In view of the provisions contained in Clause (18) of the Rules (bye-laws), which provides for sufficient safeguards to prevent illegal collection of funds by the Temple Advisory Committee, an Advisory Committee cannot display QR Code link of its bank account in the temple premises and collect money from the devotees. As per Clause (9.1), the President of the Temple Advisory Committee has to supervise the collection of funds at the initiative of the Advisory Committee and he has to ensure that the functioning of the Committee is in accordance with the directions issued by the Travancore Devaswom Board. As per Clause (9.3), the Secretary of the Advisory Committee has to get the approval of the Department for collection of funds, who has to cause the accounts relating to collection of funds. In the instant case, the procedure adopted by the Temple Advisory Committee, as discernible from Ext.P5 order dated 15.06.2023, while collecting money from the devotees 17 W.P(C)No.1972 of 2024 through QR link to its account which contained the name ‘e-hundi’, is in violation of the provisions under the aforesaid clauses of the Rules (bye-laws) and in such circumstances, the decision taken in Ext.P5 cannot be said to be either arbitrary or illegal, warranting an interference in exercise of the extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India. 23. It is for the 4[th] respondent Assistant Devaswom Commissioner to expedite the steps taken to convene the meeting of ‘Registered Mandalam’, for electing new members to the Temple Advisory Committee of Thiruvarppu Sri Krishna Swamy Temple. Till the constitution of such a Committee, the entire activities in the temple shall be managed directly by the 4[th] respondent Assistant Devaswom Commissioner and the 5[th] respondent Sub Group Officer. In the result, this writ petition fails and the same is accordingly, dismissed, subject to the directions contained hereinbefore. **Sd/-** **Sd/-** **G.
