Case Synopsis & Summary

These writ petitions challenge unauthorised parking of autorickshaws along the Poovar–Neyyattinkara Highway at Olathani Junction, Neyyattinkara, and the resulting traffic congestion, obstruction to ingress and egress of business premises, and threats to public order. The petitioners in WP(C) 7453 of 2021 are local shop owners who contend that the systematic parking of autorickshaws in front of their buildings blocks access to their shops and gives rise to disputes among drivers. The adjacent WP(C) 38191 of 2022 is filed by three residents similarly aggrieved by autorickshaw parking near Olathani Junction, alleging violations of Rule 6 of the Kerala Panchayat Raj (Landing Places, Halting Places, Cart Stands and Other Vehicle Stand) Rules, 1995 and a disregard for pedestrian safety. Both petitions seek a direction to the authorities to curb unauthorised parking and to explore an alternative parking space. The court relies on the Division Bench decision in Noushad M. v. State of Kerala to support the constitution of a Traffic Regulatory Committee under Section 72 of the Kerala Police Act in Local Self Government. Given that a Committee has been constituted for Neyyattinkara, the court relegates the issue to that body, with directions to hear stakeholders, consider a feasible alternative, and gather pedestrians’ views. An interim order remains in force until a final decision, and a six-week deadline is set for resolution.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that unauthorised parking of autorickshaws at Olathani Junction causes traffic congestion, obstructs ingress/egress to their premises, and leads to disputes among drivers, adversely affecting business and public order. They seek a direction to curb parking and to explore an alternative parking facility, citing Rule 6 of the Kerala Panchayat Raj Rules and the authority of a Traffic Regulatory Committee under Section 72 of the Kerala Police Act. They urge timely action, transparency, and hearing of stakeholders including pedestrians.

Contentions of Respondents

The respondents point to the already constituted Neyyattinkara Traffic Regulatory Committee and rely on the statutory framework (Kerala Police Act, Kerala Police Rules, and Motor Vehicles Act) to regulate traffic. They advocate deferring to the Committee for a balanced resolution, emphasize due process, and seek to involve all stakeholders and ensure compliance with existing orders. They argue that immediate action must be coordinated through the lawful conduit of the Traffic Regulatory Committee rather than ad hoc measures.

The petitioners are doing business in the buildings on the side of Poovar-Neyyattinkara Highway, near Olathani junction. They are aggrieved by the parking of autorickshaws on the side of Poovar-Neyyattinkara road at Olathani junction causing traffic congestion. According to the petitioners, due to the parking of autorickshaws in front of their buildings, the ingress and egress to the shop rooms is obstructed and this has adversely affected their business. The petitioners also point out that on the issue of parking of autorickshaws, there always occur altercations between the drivers ## **WP(C) Nos.7453 of 2021 & 38191 OF 2022** **8** and the shop owners resulting in law and order situation. Accordingly, the petitioners have sought for a direction to respondents to take appropriate action to avert the unauthorised parking of autorickshaws on the side of the PoovarNeyyattinkara road at Olathani Junction. ## **W.P.(c) No. 38191 of 2022.** 3. This writ petition is filed by three residents residing on either side of the Poovar-Neyyattinkara Road near Olathani junction. They have approached this Court aggrieved by the unauthorised parking of autorickshaws by respondents 8 to 26 at Olathani Junction. According to them, autorickshaws are parked on the side of Poovar-Neyyattinkara Road near Olathani junction without leaving sufficient space for the pedestrians to walk safely and in total disregard to the provisions contained under Rule 6 of the Kerala Panchayat Raj (Landing Places halting **WP(C) Nos.7453 of 2021 & 38191 OF 2022** **9** places, Cart stands and other vehicle stand) Rules, 1995. The petitioners, therefore, pray for a direction to respondents 1 to 6 to initiate immediate action against respondents 8 to 26 for the unauthorised parking of autorickshaws on the side of PoovarNeyyattinkara Highway at Olathani Junction and for other allied reliefs. 5.
