Case Synopsis & Summary
This is a Motor Accident Claims Appeal from MACA No. 1856 of 2008 arising out of an award of the Motor Accidents Claims Tribunal, Muvattupuzha, in OPMV.293/2004. The claimants — Sophy George (wife), Joffin George and Anumol George (children), and Thressiamma (aged mother) — sought compensation following the death of K.P. George, a 42-year-old nursing assistant, who succumbed four days after a road accident on 2 February 2004. The Tribunal awarded a total of Rs. 7,29,900 across heads including loss of earnings, transportation, medical and funeral expenses, loss of estate, pain and suffering, and loss of love and affection to dependants. The appellants challenged the quantum particularly under loss of dependency and loss of consortium, arguing for higher compensation in light of Sarla Verma v. Delhi Transport Corporation (2009) 6 SCC 121 which prescribes multiplier, future prospects, and personal expenses deductions. The State insurer was held liable, and the appeal succeeded in part. The High Court increased the loss of consortium from Rs. 15,000 to Rs. 25,000, applied a multiplier of 14 with a 30% prospectus enhancement, and retained a 1/3 personal expense deduction. It recomputed dependency to Rs. 2,59,416 (over the Tribunal’s Rs. 6,48,400 deduction), yielding a total enhanced compensation of Rs. 9,99,316 and directing interest as per the Tribunal. The appeal was partly allowed with directions upheld on other aspects.
Legal Doctrines & Maxims
- Sarla Verma v. Delhi Transport Corporation (2009) 6 SCC 121 — multiplier, future prospects and personal expenses deduction applied in determining compensation under the Motor Vehicles Act.
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants contended that the Tribunal’s quantum under loss of dependency and loss of consortium was inadequate. They urged adoption of Sarla Verma guidelines, arguing for the correct multiplier (14) and a 30% enhancement for future prospects. They also contended for a higher loss of consortium (Rs. 25,000) and a revision of personal expenditure deduction in light of a five-member family.
Contentions of Respondents
The respondent insurer argued that the Tribunal’s award should be maintained as the base for quantum and liability; the appeal sought excessive enhancement under heads of loss of dependency and loss of consortium, which the insurer contended should be restricted in line with the Tribunal’s calculations.
