## **COMMON JUDGMENT**
The petitioner in W.P(C).No.3203 of 2021 is a member of the 5[th] respondent society with membership number 1102. The society is a class X society and it was being administered by a managing committee of seven elected members. On the basis of the report of the Unit Inspector on 04.01.2019, the Joint Registrar issued a proceeding and a part time administrator was appointed. By Ext.P3, order dated 10.02.2020, it was substituted by an administrative committee comprised of 3 persons, which included the 7[th] respondent, one K.Geetha. In Ext.P3, the said Geetha was referred as “membership No.76” residing at Oriyarikonam, Plavila Veedu, Karipur P.O, Nedumangad. According to the petitioner, in fact the 7[th] respondent is not Geetha with membership No.76, whose address was shown as “Grace Bhavan, Karipur P.O, Nedumangad. The 7[th] respondent is a totally different person. The 7[th] respondent is one Geethakumari and is an elected member of the Nedumangad Municipality. Original Geetha, whose membership was No.76, belongs to Harijan community, whereas the 7[th] respondent herein belongs to Nair community. It was also contended that, the father's name of 7[th] respondent was Appukuttan Nair. Accordingly, the specific contention of the petitioner was that, the 7[th] respondent Geetha Kumari was not K.Geetha who was allotted membership No.76. It was also contended that the 7[th] respondent
W.P(C).Nos.3203 and 1725 of 2021
7
is hence not a member of the society. She has usurped the authority and is continuing the power based on forged documents. It was also stated that the admission register of the society was tampered with and the name and address of “Geetha, Grace Bhavan” was changed to suit the address of the 7[th] respondent.
2. In the meanwhile, pursuant to a decision of the administrative committee, Ext.P9 election notification was issued. The date of publication of voters list was on 15.01.2021. However, on that day, the draft voters list was not published under the directions of the Electoral Officer. It was understood that the draft list was published only on 25.01.2021. It was further contended that, the total member of voters in the previous election was 977 as evident from Ext.P10. After that election, the managing committee enrolled 148 new members increasing the total membership to 1125 members. Thereafter, the present administrative committee enrolled 125 new members and their names were also included in the draft voters list. Though Ext.P12 detailed objection was submitted to the Electoral Officer on 19.01.2021, no action was taken thereon.
3. According to the petitioner, since the committee has constituted with forged records, all decisions taken by the committee was non-est and liable to be interfered. According to the petitioner, notification was issued pursuant to the decision of the administrative committee which had no authority to take a decision. Hence, the prayer
W.P(C).Nos.3203 and 1725 of 2021
8
sought in the Writ Petition was to declare Ext.P9 notification as invalid, legally unsustainable and to quash it.
4. The writ petitioner in WP(C).No.1725 of 2021 has also filed W.P(C).3203 of 2021 along with five other members. The case of all the writ petitioners was that, the election to the administrative committee was proposed to be held on 20.01.2021. The petitioners appeared before the Secretary at 10.30p.m., on 04.02.2021, the date notified for receipt of nominations and submitted amount required to be deposited along with the nomination. However, it was not accepted. Thereafter, they submitted the nomination, which was accepted. In this circumstance, they were constrained to file nomination without deposit. The Secretary was acting under the dictates of the Managing Committee. Returning Officer by proceeding dated 06.02.2021, rejected the nominations on the ground that, they failed to remit the election deposit. The writ petitioner also raised objection regarding the 125 members who were added by the administrative committee. They challenged Ext.P3 and the decision of Electoral Officer in rejecting the nominations.
5. Heard both the writ petitions together. Heard the learned senior counsel as well as the counsel appearing for all the respondents.
6. In W.P(C).No.1725 of 2021, the first respondent has filed a statement denying all the above allegations. It was stated in the above statement that, all the proceedings were completed in accordance with law and no illegality was committed. The election was proposed to be
W.P(C).Nos.3203 and 1725 of 2021
9
conducted in accordance with law.
7. The third respondent/Electoral Officer submitted a detailed statement in W.P(C).No.1725 of 2021 that the draft voters list submitted by the Administrative Committee consisted of 563 members. The Electoral Officer received objections from the petitioner as well as from another person. The objections were considered and disposed of on 23.01.2021. Those objectors were not present at the time of scrutiny. It was found that, 125 members included in the preliminary list were admitted by the administrative committee and hence, the Electoral Officer excluded those members. Ext.R1(a) was the photocopy of the order rejecting the objection about exclusion of members from the draft voters list. Hence, the final voters list consists of 438 members, which included 563 members in the preliminary voters list minus 125 members excluded by the Returning Officer.
8. A detailed statement was filed by the 1[st] respondent in W.P(C).No.3203 of 2021 also. Pursuant to the notification, draft electoral list was published on 15.01.2021. The allegation that, notice was not published in time was absolutely false. The draft voters list consists of 563 members, including those admitted by the administrative committee. Scrutiny and objections were done by the Electoral Officers at the society office on 23.01.2021 between 11 a.m. and 1 p.m. None of the petitioners who had submitted their objections were present at that time whereas Geethakumari presented before the Electoral Officer at 1.15p.m. on that
W.P(C).Nos.3203 and 1725 of 2021
10
day. Annexure-R3(e) was the attendance with date. By that time, the entire scrutiny process was over. However, considering the objections and perusing the draft voters list, the Electoral Officer published the final voters list in Form-35 in the notice board on 25.01.2021 at 11 a.m. after removing 125 member who are admitted by the administrative committee. The petitioner had not submitted any evidence before the authorities, there was no objection. None of the member other than the petitioner and Geetha submitted any objection as to their exclusion in the draft voters list and both of them were included in the list. They have approached this Court without submitting a proper objection before the authority. The third respondent relied on the decision in **Shri Sant Sadguru Janardan Swami (Moingiri Maharaj) Sahakari Dugdha Utpadak Sanstha, and Another v. State of Maharashtra and Others**
**(2001 KHC 1667)** to contend that, in case of such disputes, it will be open to the aggrieved person to challenge the election of the Returning Officer by means of an Election Petition before the Election Tribunal. It was hence contented that there was absolutely no reason for interfering with the election.
9. The 5[th] and 6[th] respondents have jointly filed objection statement wherein it was contended that, the 7[th] respondent was a member of the society alloted with electoral No.76. She was residing in that address, earlier. Subsequent to it, she shifted to various other houses. It was asserted that, Geetha with the membership No.76 and 7[th]
W.P(C).Nos.3203 and 1725 of 2021
11
respondent are the one and same person and her name and address were shown in the final voters list as Geetha, Plavila Veedu, Oriyarikkonam, Karipoor Village, Nedumangad. Originally, the person shown as membership No.76 in the draft voters list was residing in the earlier address of Grace Bhavan. She thereafter shifted to the various houses. A request was submitted by the 7[th] respondent dated 11.01.2021 produced as Ext.R5(a) to change her address. Consequent to that, the address of the 7[th] respondent was corrected in the original petition and Ext.R5(b) was the true copy of the final voters list. It was asserted that, there was no interpolation in the admission register as alleged. A copy of the name and address of the 7[th] respondent as shown in the admission register was produced as Ext.R5(c). It was further contended that, the election was proposed to be held on 21.02.2021 and all the arrangements were made. The draft voters list was published on 15.01.2021 and after rectifying all mistakes, final voters list was published on 25.01.2021.
10. 7[th] respondent, Geetha @ Geetha Kumari, in her affidavit stated that, the allegation that, she was not a member of the 5[th] respondent society was absolutely false. It was asserted that, she was the same person shown with membership No.76. In the previous voters list, her address was shown as Grace Bhavan, Karipur, Nedumanagd. It was entered in the admission register in 1993. At that time she was residing in that address. She was born in the parental home in 1969 and the address shown in SSLC book was Plavila Veedu, Karipur P.O,
W.P(C).Nos.3203 and 1725 of 2021
12
Nedumangad. A copy of the SSLC book was produced as Ext.P7(a). After marriage, she continued to reside with her husband in his house at Palode. Her address shown in Electoral ID card, Adhaar card and ration card was the address of Kukku Bhavan, Karipur P.O, Nedumangad, wherein she was residing at that point of time. The above documents were produced as Exts.R7(b) to R7(e). It was asserted that, the allegation that the original Geetha with membership No.76 was a Harijan was absolutely false. She also relied on Ext.R7(f), which was a certificate issued by the Village Officer after ascertaining the details mentioned that, the 7[th] respondent was residing in Plavila veedu, Karipur P.O., Nedumangad. She asserted that the allegations of the petitioners were absolutely false.
11. In W.P(C).No.3203 of 2021, specific averments were made by 5[th] and 6[th] respondents, that to their knowledge, petitioners did not submit the election fee. They came at the last moment and filed the nomination paper. Hence the authority was justified in not accepting it. It is fatal that, though the last date for submitting the nomination was 04.02.2021 between 11 a.m. to 1 p.m., the petitioners reported at the last moment without a prescribed fee. Present allegation that the fee was refused to be accepted is absolutely false since they came up with the objection only much later and approached this Court only on 08.02.2021. They have not brought it before the authorities at the relevant time which itself falsifies the allegation.
W.P(C).Nos.3203 and 1725 of 2021
13
12. It is evident that the specific contention of the petitioner in W.P(C).No.1725 of 2021 that Geetha mentioned in membership No.76 of the electoral list is not the 7[th] respondent and that 7[th] respondent has impersonated herself and forged documents is absolutely false in the light of several materials placed by 7[th] respondent and the society. It seems that, petitioner has come up with wild, reckless and baseless allegations. Prima facie, the materials produced by the respondents and the assertions made by all the respondents completely belie the contention of the petitioner. A last minute disparate attempt was made by the petitioner to delay the election process by raising a cloud regarding the identity of the 7[th] respondent. This is a fit case, in which, cost should have imposed on the petitioner for raising such false allegations. However, I refrain from doing this, considering the facts.
13. After analyzing the materials on record in W.P(C).No.3203 of 2021, there are all reasons to believe that the contention of the petitioners therein that the fee was not accepted along with the nomination seems to be absolutely false. The rejection of nomination paper was on 05.02.2021 and rejection was informed by Ext.P3 dated 06.02.2021. W.P(C).No.3203 of 2021 was filed on 08.02.2021. The writ petitioners have no case that, after Secretary refused to accept the nomination fee, they complained to the society. This is fatal. Had they got any such case, definitely, they would have come up with objection either on that day or atleast on the next day. These Writ Petitions seems to be
W.P(C).Nos.3203 and 1725 of 2021
14
an afterthought. I find no reason to grant the prayers made in the writ petitions.
Accordingly, both the writ petitions are dismissed.
