Case Synopsis & Summary

This Public Interest Litigation (WP(C) No.20319/2019) before the Kerala High Court, a Division Bench comprising Chief Justice S. Manikumar and Justice Shaji P. Chaly, seeks to implement the Supreme Court’s directions dated 9 August 2019 in Pioneer Urban Land and Infrastructure Ltd. v. Union of India (W.P.(C) No.43 of 2019) to constitute a Real Estate Regulatory Authority (KRERA), its Adjudicating Officer, and the Real Estate Appellate Tribunal under the Real Estate (Regulation and Development) Act, 2016. Pursuant to those directions, the Government of Kerala issued GOs 65/2019 and 66/2019 to establish KRERA and appoint full-time members. The petition records steps taken and ongoing requirements to operationalize KRERA, including infrastructure, funds, and personnel. It tracks a status report (as of January 2020) noting that KRERA started functioning in Swaraj Bhavan, Thiruvananthapuram; a Real Estate Regulatory Fund was created; a Secretary (Legal) was appointed; and posts such as Deputy Director (Technical) and other technical/administrative staff were being filled. The Court directs expeditiously finalizing the selection for Judicial Member and Technical/Administrative Member of the Real Estate Appellate Tribunal and the appointment of an Adjudicating Officer under Section 71(1), within a month, so that KRERA functions effectively. The petition is disposed with these directions to hasten KRERA’s functional status.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner submits that the Supreme Court’s directions in Pioneer Urban Land and Infrastructure Ltd. v. Union of India mandated the constitution of the Kerala Real Estate Regulatory Authority (KRERA), its Adjudicating Officer, and the Real Estate Appellate Tribunal, along with requisite infrastructure and funds, to make the Act functional. Kerala’s GO 65/2019 and GO 66/2019 reflect steps toward establishment, but the petition emphasizes that mere notifications without full operationalization fail to meet the Court’s directive. The petitioner highlights ongoing steps for empanelling representatives, setting up KRERA, appointing staff, and the need for an Adjudicating Officer. It seeks expeditious action to finalize appointments and ensure KRERA’s functionality in a timely manner, including resources and space. The relief sought is a binding court direction to complete the regulatory framework so that homebuyers are protected under the Act and regulatory bodies are promptly functional.

Contentions of Respondents

The respondents contend that substantial progress has been made: GO 65/2019 and GO 66/2019 establish KRERA and appoint a Chair and Members; KRERA has begun functioning from Swaraj Bhavan; the Real Estate Regulatory Fund has been created; Secretaries (Legal) and technical/administrative posts have been arranged; steps have been taken to appoint an Adjudicating Officer under Section 71(1) and to constitute the Real Estate Appellate Tribunal. A Selection Committee has been formed and is actively processing applications, including vetting confidential and police/vigilance reports. The Government asserts that, with the committee’s recommendations, KRERA will be functional and that the Court’s direction cannot be fulfilled overnight, requiring time for due process in appointment and establishment of the appellate structure. The respondents request continued patience while the statutory machines are put in place.
