Case Synopsis & Summary

This is a consolidated bail-application order of the High Court of Kerala (Ernakulam) concerning the second, fifth, ninth, and other accused in multiple crimes involving Kannur Urban Nidhi Ltd. The petitioner, Shoukathali M.M., seeks regular bail under Section 439 CrPC for offences including cheating and conspiracy under IPC sections 409/420 read with 34. The petitions arise from multiple FIRs: Crime Nos. 407/2023 (Karikottakari PS), 467/2023 (Valapattanam PS), 235/2023 (Mattannur PS), 590/2023 (Mattannur PS), 453/2023 (Mattannur PS), 236/2023 (Mattannur PS), and 570/2023 (Mattannur PS). The court notes that the charge-sheets have not yet been filed, and there is no material suggesting imminent flight or tampering with evidence; bail is thus permissible with conditions. The prosecution contends bail should be denied given the offence’s scale and depositors’ losses, while the defense argues innocence and non-applicability of detention. The judge observes that 139 cases list the petitioner as an accused and 130 have granted bail, and that a lone bail grant would not undermine the investigation. The order ultimately allows bail with standard conditions, including bond, sureties, reporting, non-interference with witnesses, no foreign travel without permission, and surrender of passport where applicable, while noting police powers to investigate even on bail in light of Sushila Aggarwal (2021) 1 KHC 663.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner-tethered counsel contends the accused is innocent and falsely implicated with ulterior motives. The case records show that bail has been granted in 130 of 139 proceedings where the petitioner is an accused, and that no charge sheet has been filed in any of the connected crimes, indicating the absence of a compelling circumstance to deny bail. The defense highlights the lack of a custodial threat and asserts that the petitioner would comply with conditions and not misuse liberty. The accused emphasizes that depositors’ losses stem from a broader scheme led by Kannur Urban Nidhi Ltd. rather than the petitioner alone, and his prior arrest dates are admitted without a record of flight risk. Respondents:"The State submits that the scale of alleged cheating and the involvement of management in Kannur Urban Nidhi Ltd. warrant no bail, citing numerous cases and non-repayment of deposits; however, charge sheets are pending, and there is every likelihood of interference with witnesses and evidence if released. Bail should be refused or restricted to safeguard the investigation and depositors’ interests."

Contentions of Respondents

The State contends that the accused participated in a large-scale deposit-taking scam; release on bail could undermine investigations and witness credibility. It emphasizes the ongoing nature of investigations and the need to prevent further tampering with documents or flight risk. The State points to the absence of charge sheets and the history of many co-accused being granted bail as a factor, but argues for prudent conditions if bail is granted.

All these crimes were registered when the accused did not return the principal amount or the interest and allegedly cheated the depositors. It is pointed out that there are 139 cases where the petitioner has been arrayed as an accused and in 130 of them the petitioner was granted bail. 10. The learned counsel appearing for the petitioner would say that the petitioner is innocent and falsely implicated with ulterior motives. 11. The learned public prosecutor opposed the petition and points out that the petitioner is not entitled to bail. Learned Public Prosecutor further submits that there are several cases against the Directors and persons in management of Kannur Urban Nidhi Ltd., who obtained huge amounts from the depositors by promising at least 12.5% interest. Neither the principal amount nor the interest was repaid and cases were filed by the depositors. 12. After considering the rival submissions and the fact that the petitioner was arrested on 24/08/2023 in Crime No.407/2023, 26/09/2023 in Crime No.467/2023 and in the other crimes on 11/09/2023 and the fact that charge sheet has not been filed in any of these cases and also since there is no apprehension raised by the prosecution that if released on bail, the petitioner is likely to abscond, I hold that bail can be granted to the B.A.Nos.9091, 9093, 9094, 9097, 9102, 9103 & 9104/2023 **==> picture [32 x 8] intentionally omitted <==** petitioner.
