Case Synopsis & Summary

This Criminal Misc. Case (Cr.M.C. No.882 of 2024) before the Kerala High Court of Ernakulam concerns an accused in Crime No.2163/2018 at Muvattupuzha Police Station seeking to quash the final report (Annexure A1) and the subsequent proceedings in CC No.1393/2018 before the Judicial First Class Magistrate, Muvattupuzha, under Section 482 Cr.P.C. The petitioners—seven individuals named as petitioners (Shinaj, Lishad, Lissam, Libin, Libina, Amina, Fathima)—are alleged to have assaulted respondents during a visitation at the matrimonial/parental home of the defacto complainant’s brother. The respondents include the State of Kerala (via Public Prosecutor) and respondents 2–11, among them Jaseena, Aisha, Makkar, Jasmine, Fathima, Sajitha, Abina Subair, Adhabiya Subair, Afida, and Noufal. During the hearing, petitioners and respondents 2–11 submitted that a settlement had been reached; affidavits (Annexures A2–A11) attest to the settlement, with respondents not intending to pursue the prosecution. The Public Prosecutor concurred, confirming settlement. Relying on Gian Singh v. State of Punjab and State of Madhya Pradesh v. Laxmi Narayan, the Court held that quashing is warranted on settlement. The result: the petition is allowed and Annexure A1 Final Report and further proceedings in CC No.1393/2018 are quashed.

The prosecution allegation is that when the petitioners came to the parental house of the defacto complainant, which is the matrimonial house of the 5[th] petitioner, to take away the child of the defacto complainant’s brother, the petitioners assaulted the respondents. 3. When the matter is taken up for consideration, learned counsel for the petitioners submitted that the matter stands settled between themselves and respondents 2 to 11. Respondents 2 to 11 entered appearance through counsel, and submitted that the matter stands settled. Annexures A2 to A11 are the affidavits filed by them, Crl.M.C. No.882 of 2024 5 endorsing the settlement. Neither they have any intention to proceed with the prosecution nor any objection in quashing Annexure A1 Final Report, and the proceedings in C.C.No.1393 of 2018. 4.
