Case Synopsis & Summary
The petitioner, Sherin Varghese, claims absolute ownership and possession of 36.82 acres of land in Naduvila Village, Vaikom Taluk, presently reflected in the Data Bank under the Kerala Land Utilisation Order (KLUO) as paddy land (nilam). He seeks permission to use the land for non-paddy purposes after correcting the revenue entries, invoking clause 6 of the KLUO and the regularisation framework under Act 28 of 2008. The petition traces back to a prior W.P. No. 21338/2014, and an Advocate Commissioner (Ext.P3) reported that the land lies with a natural pathway, is surrounded by residential structures, and that there has been no agricultural activity for more than 20 years. The Court, in Ext.P4, directed the Local Level Monitoring Committee (LLMC) to consider correction in the Data Bank, noting that the land was unfit for paddy cultivation and that permission could be granted subject to conditions. LLMC subsequently decided to correct the Data Bank to reflect the land as reclaimed prior to three years. The Revenue Divisional Officer opposed the petition, arguing reclamation occurred around 2011, supported by seizure mahazar and satellite imagery. The core issue concerns whether reclamation occurred before the 2008 Act. The Court ultimately directs that the land be declared irreversibly converted before enactment, permits regularisation under Act 28 of 2008 on satisfying formalities, and maintains status quo until regularisation, with a pathway to reassessment post-regularisation.

Contentions of Appellants / Petitioners
The petitioner contends that he is the absolute owner of 36.82 ares of land in Naduvila Village and that the Data Bank entries declaring the land as nilam/paddy are erroneous. He seeks permission to use the land for non-paddy purposes after correction of revenue records under Clause 6 of the Kerala Land Utilisation Order, 1967. He relies on Ext.P3 (Advocate Commissioner’s report) showing limited to no agricultural activity for over two decades, a pathway traversing the land, and surrounding residential structures, indicating suitability for alternate use. Following this Court’s earlier Order in W.P.(C).No.21338/2014 (Ext.P4), the LLMC was directed to consider correction in the Data Bank and to evaluate permission conditioned by the Government Pleader’s guidance. The Commissioner’s findings supported the view that the land is unfit for paddy and that reclamation and use for other purposes could be considered subject to statutory requirements. The petition seeks timely regularisation under Act 28 of 2008, with a view to converting the land to purayidam/dry land in accordance with law and advancing the petitioner’s ownership rights under the KLUO. The respondents argue that the reclamation occurred around 2011, as evidenced by seizure mahazar and satellite imagery, and that no action under Section 13 of Act 28 of 2008 was taken. They contend that the Data Bank still classifies the land as paddy, and that the application for regularisation should be rejected unless a clear, legally recognised pre-2008 reclamation is established.
Contentions of Respondents
The respondents contend that reclamation occurred around 2011, evidenced by seizure mahazar and satellite imagery, and that no action under Section 13 of Act 28 of 2008 was taken. They argue the data bank still reflects paddy (nilam) status, and that the petitioner has not established reclamation prior to the 2008 Act. They rely on official records and LLMC’s earlier view that reclamation was not conclusively proven to have occurred before the enactment. They further submit that the petitioner’s earlier sale of portions of land and pending applications before LLMC for construction of residences indicate competing interests and require careful regulatory handling under the statutory scheme. The respondents urge adherence to the statutory process, reject the applicant’s broad rights to convert, and emphasize that any regularisation must follow strict compliance with KLUO and Act 28 of 2008, including the formation of necessary data corrections and due consideration by the appropriate authorities within the statutory timelines.
