Case Synopsis & Summary
MACA No. 483 of 2015 is a Motor Accidents Claims Appeal filed by the legal heirs of Anilkumar against the award of the Motor Accidents Claims Tribunal, Thalassery, in OP(MV) 404/2008. The accident occurred on 03.07.2007 when the deceased, standing near the Elayavoor Panchayat Office, was struck by a mini lorry driven rashly from Kannur side, sustaining fatal injuries. The Tribunal found the first respondent at fault and held respondents 1 to 3 (the insurer) liable to pay compensation amounting to Rs 8,77,300. The claimants contended that the notional income used by the Tribunal was too low and that the family, being three legal heirs, was entitled to higher sums for loss of consortium and other heads. Counsel for the appellants sought enhancement of dependency benefits, funeral expenses, and loss of estate, and argued that the higher notional income and 40% future prospects should be adopted in light of Ramachandrappa and Pranay Sethi. The insurer argued that the Tribunal’s allowance for loss of love and affection and pain and suffering should be curtailed once adequate dependency is demonstrated. The High Court, applying Ramachandrappa and Pranay Sethi, fixed the deceased’s notional income at Rs.6,000 per month, allowed 40% future prospects, and computed dependency with a 16-year multiplier while deducting one-third for personal living expenses. It then struck down double counting of certain heads in light of Somwati and Satinder Kaur, and enhanced the total compensation to Rs.3,56,400 beyond the original award. The appeal was allowed in part with directions for deposit and distribution.

Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants contended that the Tribunal’s quantum is too low and the notional income fixed by the Tribunal is not in conformity with the ratio in Ramachandrappa. With three legal heirs, Rs.40,000 each for loss of consortium was claimed; funeral expenses claimed to be Rs.15,000; argued that loss of love and affection and pain and suffering should be considered where appropriate but not duplicative with dependency.
Contentions of Respondents
The respondents’ counsel submitted that if there is sufficient dependency, the Tribunal’s allowance for loss of love and affection and pain and suffering should be struck down and the award should not be inflated by duplicative heads.
