Case Synopsis & Summary

This is a second appeal under SA No. 855 of 1999 before the Kerala High Court, arising from a partition suit concerning a 2 acres 27 cents property originally belonging to Akkara Ouseph Ouseph. The property was subjected to a sale in execution of decree O.S.60 of 1113 ME in the District Court, Thrissur, and was purchased by Ollur Little Flower Bank. Despite the sale, possession of the suit property continued with the successors of Akkara Ouseph Ouseph. Mathew, the plaintiffs' predecessor, purchased the property from the bank as per Ext. A1 and filed O.S. 497 of 1966 for recovery of possession; that suit was dismissed. The plaintiffs claim that the rights in the suit property have remained with Akkara Ouseph Ouseph and his successors and that the property is liable to partition among the successors of the two sons, Ouseph and Mathew. The trial court decreed 48/216 share in favor of the plaintiffs; the appellate court affirmed the decision except regarding mesne profits. The appellants contend that because the property was sold and possession was not transferred to the purchaser, the plaintiffs are not entitled to partition; they also challenged the averred adverse possession. The High Court held that there was no valid ouster and that the plea of adverse possession was not tenable, citing a ruling in KT Kurungottukandi Rarichakutty v. Aranda Rarichan. Consequently, the second appeal was dismissed.

Legal Doctrines & Maxims

  • Ouster
  • Adverse possession
  • Possession (doctrine)

Submissions & Arguments

Contentions of Appellants / Petitioners

The appellants contended that since the suit property and related holdings were sold in execution of decree O.S No.60 of 1113 ME and the purchaser did not obtain possession, the plaintiffs cannot claim partition. They argued that possession remained with the successors of Akkara Ouseph Ouseph and that the purported plea of adverse possession is not tenable and that there was no ouster by the defendants, thereby challenging the trial and appellate decrees granting partition.

Contentions of Respondents

The respondents argued that possession of the suit property continued with the successors of Akkara Ouseph Ouseph; even though the property was sold, possession remained with the original possessors; the plaintiffs seek partition of the possessory rights and, having held possession, are entitled to a share notwithstanding the sale. They contended that the pleas of adverse possession and ouster were not proven and that the lower courts correctly decreed partition or affirmed it in principle, except for mesne profits.

The property sought to be partitioned is an item measuring 2 acres and 27 cents. The said property originally belonged to one Akkara Ouseph Ouseph. Akkara Ouseph Ouseph had two sons namely Ouseph and Mathew. The plaintiffs and defendants 38 and 39 are the successors of Mathew and defendants 1 to 37 are the successors of Ouseph. The case set out by the plaintiffs in the plaint is that the properties held by Akkara Ouseph Ouseph including the suit property were brought to sale by one of his creditors in execution of the decree in O.S No.60 of 1113 ME on the files of the District Court, Thrissur, and M/s.Ollur Little Flower Bank purchased the properties in the said proceedings. It is also their case that the purchaser of the properties did not obtain possession of the suit property in furtherance to the purchase and consequently the property remained in the possession of the successors of Akkara Ouseph Ouseph who died in the meanwhile. It is the further case of the plaintiffs that though their predecessor Mathew later purchased the suit property from M/s Ollur Little Flower Bank in terms of Ext.A1 SA.No. 855 of 1999 11 assignment deed and filed a suit as O.S No.497 of 1966 for recovery of possession of the same from the successors of Ouseph, the said suit was dismissed. According to the plaintiffs, the suit property which has been in the uninterrupted possession of Akkara Ouseph Ouseph and his successors is liable to be partitioned among the plaintiffs and defendants, who are the successors of his two sons, Ouseph and Mathew. 2. Defendants 1, 8, 10 to 12, 14, 19, 21, 34, 35 to 37 contested the suit contending that in so far as the rights, if any, of Akkara Ouseph Ouseph over the suit property was sold in execution of the decree in O.S No.60 of 1113 ME, the plaintiffs are not entitled to claim partition of the suit property in their capacity as the successors of Akkara Ouseph Ouseph. They also contended that they are in exclusive possession of the suit property and the right, if any, of the plaintiffs over the suit property is lost by adverse possession and limitation. 3. The trial court accepted the case of the plaintiffs and decreed the suit declaring the 48/216 share of the plaintiffs in the suit property. Though defendants 10 to 12, 14, 19 and 34 to 37 preferred an appeal challenging the decision of the trial court, the appellate court affirmed the decision of the trial court except in so far as it relates to the mesne profits. As noted, defendants 4, 5, 7, 10 to 12, 15, SA.No. 855 of 1999 12 19, 31, 34, 36, 37 and the legal representatives of the deceased third defendant are aggrieved by the decision of the trial court as affirmed by the appellate court. 4. The learned counsel for the appellants contended that in so far as it is admitted by the plaintiffs that the suit property was sold in execution of the decree in O.S No.60 of 1113 ME, the plaintiffs are not entitled to claim partition of the suit property in their capacity as the successors of Akkara Ouseph Ouseph. 5. As noted, the property sought to be partitioned is one which belonged to Akkara Ouseph Ouseph. There is no dispute to the fact that the properties held by Akkara Ouseph Ouseph including the suit property were sold in execution of the decree in O.S No.60 of 1113 ME and the same were purchased by M/s.Ollur Little Flower Bank. Likewise, there is also no dispute to the fact that though the suit property was sold, the possession of the same continued with the successors of Akkara Ouseph Ouseph as the purchaser has not obtained possession of the property pursuant to the sale through the process of the court. There is also no dispute to the fact that though Mathew purchased the property from M/s.Ollur Little Flower Bank in terms of Ext.A1 assignment deed and instituted O.S. No.497 of 1966 on the strength of the said document for recovery of possession of the suit property from the successors of his brother Ouseph who died in SA.No. 855 of 1999 13 the meanwhile, the said suit was dismissed. Ext.A5 is the plaint in O.S No.497 of 1966 and Ext.A6 is the written statement filed by the defendants in the said case. The stand taken by the defendants in Ext.A6 written statement is that they are in uninterrupted possession of the suit property as the successors of Akkara Ouseph Ouseph and that the acquisition of the suit property by Mathew from M/s.Ollur Little Flower Bank is on their behalf as well. A notice was caused to be issued by Mathew prior to the institution of O.S No.497 of 1966 to the defendants. Ext.A4 is the reply sent by the defendants who are the successors of Ouseph to the said notice. In Ext.A4 reply, it is stated by them that they are holding the suit property as co-owners and that they are, therefore, entitled to one half share in the property. It is seen that since the predecessor of the plaintiffs Mathew was not successful in recovering the suit property from the defendants who are the successors of Ouseph on the strength of Ext.A1 assignment deed, the present suit is filed thereafter claiming their share in the suit property as conceded by the defendants in O.S No.497 of 1966. Though the suit property was sold in execution of the decree in O.S No.60 of 1113 ME, the specific case of the defendants in O.S No.497 of 1966 was that possession was not obtained by the purchaser and the possession of the property continued to be with the successors of Akkara Ouseph Ouseph. It is beyond dispute that the purchaser of the property in SA.No. 855 of 1999 14 court auction sold the property back to Mathew, son of Akkara Ouseph Ouseph, and Mathew though instituted a suit for recovery of possession of suit property from the remaining successors of Akkara Ouseph Ouseph, he could not succeed in the said case. In other words, the possession of the property continued with the successors of Akkara Ouseph Ouseph. The present suit is one for partition of the possessory rights over the property. As noted, the stand taken by the contesting defendants in O.S.No 497 of 1966 is only that they are co-owners of the property entitled to one half share. Of course, if the contesting defendants could establish that they have ousted the plaintiffs from possession, they can certainly contend that the plaintiffs are not entitled to the decree for partition sought in the suit. The only question, therefore, is as to whether the defendants have established ouster of the plaintiffs from the property and thereby prescribed title to the property. There is no plea of ouster in the written statement filed by the contesting defendants in the suit nor do they plead the overt acts on the basis of which hostile possession over the property is attempted to be established. Of course, the defendants have pleaded adverse possession. The said plea as contained in paragraph 10 of the written statement reads thus : " അനനനയകനരര സസബനനചനടതതനളസ തശഷസ വഹകളനല അവരകക എത കകവശസമലസഉടമസനവകനശസസനദനചനടരണങനലഅതതനനയമപകനരസതരന പടനകവഹകളനലഈപതനകളകസപരണഅവകനശസസനദനചനടളതനണക.” The aforesaid is an alternative plea of adverse possession. In so far as SA.No. 855 of 1999 15 the defendants have no case that they are holding possession of property under a different title, the aforesaid alternative plea of adverse possession cannot even be regarded as a valid plea of adverse possession (See **K.T. Kurungottukandi Rarichakutty** v. **Aranda Rarichan and Ors.** [2018(4) KLT 944]). In the said view of the matter, I do not find any infirmity in the decisions of the courts below. The second appeal, in the circumstances, is without merits and the same is, accordingly, dismissed. **Sd/-** **P.B.SURESH KUMAR** **JUDGE** Mn
