Case Synopsis & Summary

This judgment of a single-judge bench of the Kerala High Court deals with two writ petitions arising from construction by Sanroyal Builders and Contractors Pvt Ltd and by Jayachandran in Thrissur, alleged to be in violation of the Kerala Panchayat Building Rules, 2011. WP(C) No.10500/2019 filed by Sanroyal seeks (i) quashing Ext.P8, a 29-09-2018 notice; (ii) a declaration of deemed occupancy for the Residential Apartment 'Sanroyal Sukriti Chittilappilly' under Rule 25(3) of the KB Building Rules, 2011; (iii) a writ of Mandamus commanding issue of an Occupancy Certificate and allotment of building numbers; and (iv) such other reliefs. WP(C) No.33027/2018 filed by Jayachandran challenges alleged violations of the KB Building Rules and seeks appropriate reliefs. The Panchayat had initiated action for violation of the Rules, and no final order has been passed yet. The court observed that regularization cannot proceed before a final Panchayat order and occupancy cannot be granted pending a decision. It directed the Panchayat to pass a reasoned order after hearing both petitioners within six weeks, and cautioned against coercive action or new construction in the interim. The petitions are disposed of accordingly, with occupancy and regularization to be considered only post the statutory decision after due process.

Provisions of Law Cited

Kerala Panchayat Building Rules, 2011, Rule 25(3)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that Ext.P8 notice is not legally sustainable as the construction has obtained requisite permits and approvals (building permit and sanctions for electrical, EC/OP, fire safety, etc.) as evidenced by Exhibits P1–P6. They assert there is no final order of violation; they seek occupancy certificates and a deemed occupancy under Rule 25(3) of the KB Building Rules, 2011, urging regularization if permissible by law, while relying on due process and inspection-based verifications. They request quashing of Ext.P13/P14 and related proceedings to enable occupancy and formalization of the complex, while urging that construction remain within approved boundaries pending final decision.

Contentions of Respondents

The respondents submit that construction proceeded in flagrant violation of the Kerala Panchayat Building Rules, 2011. They argue that occupancy certificates cannot be issued where violations are alleged and that a final order from the Panchayat is essential before any regularization. They emphasize the necessity of hearing both petitions, issuing a reasoned order, and taking action in accordance with law if violations are found. They contend that the measures taken so far reflect due process and that coercive actions should be avoided only until a final decision is rendered. The court is urged to allow the Panchayat to complete its proceedings within six weeks, after which occupancy or penalties may be determined.

The petitioner approached this Court seeking the following reliefs:- “ _i. Issue a writ of certiorari or any other writ and quash Ext.P8 notice dated 29.09.2018 issued by the 1[st] respondent._ _ii. Declare that the petitioner is having deemed occupancy for the Residential Apartment “Sanroyal Sukriti Chittilappilly” as per rule 25(3) of Kerala Panchayat Building Rules 2011._ _iii. Issue a writ of Mandamus directing the respondents 1 and 2 to issue occupancy certificate to the Residential Apartment of the petitioner's named “Sanroyal Sukriti Chittilappilly”, and allot building number to the apartments complex of the petitioner._ _iv. pass such other writs, orders or directions as this Hon'ble Court may deems just, fit and necessary in the facts and circumstances of this case._ _v. Call for the records leading to Ext.P13 and P14 and quash the same and all other proceedings leading to it, by issuance of a writ of certiorari.”_ ## 2. The matter is related to the construction undertaken by the writ petitioner in WP(C) No.10500/2019. 3. WP(C) No.33027/2018 is filed by Jayachandran alleging [ WP(C).10500/2019, WP(C).33027/2018 ] **==> picture [7 x 8] intentionally omitted <==** the violation of the Kerala Panchayat Building Rules, 2011 while construction being undertaken by the petitioner in WP(C) No.10500/2019. 4. WP(C) No.10500/2019 was filed when Panchayat issued a notice to stop construction pointing out the violation of the Building Rules. 5. It is to be noted that no final order has been passed in the matter by the Panchayat. The writ petitioner in WP(C) No.10500/2019 seeks occupancy certificate as well for the building constructed by them. 6. The party respondents in this case would submit that the building was constructed by the writ petitioner in WP(C) No.10500/2019 in flagrant violation of the Kerala Panchayat Building Rules. 7. In the light of the matter the Panchayat had already initiated action, it is appropriate that action is culminated to the final order after hearing both writ petitioners. Issuance of occupancy certificate would arise only after a decision is taken by the Panchayat in regard to the alleged violation of the Kerala Panchayat Building Rules. If the Panchyat is of the view that the construction is in violation of the [ WP(C).10500/2019, WP(C).33027/2018 ] 6 Kerala Panchayat Building Rules, it cannot be regularized, they are free to take an appropriate action in accordance with law as against the construction. 8. In the light of above, the Panchayat is directed to pass a reasoned order after adverting to the objections and relevant Kerala Panchayat Building Rules within a period of six weeks. Needless to say that both writ petitioners as well as the party respondents also be heard before passing final order. All other requests in the matter by the writ petitioner in WP(C) No.10500/2019 would depend upon the decision to be taken by the Panchayat. It is made clear that the petitioner in WP(C) No.10500/2019 shall not take any new construction, in the meanwhile. The Panchayat also shall not take any coercive action until final order is passed in this matter. The writ petitions are disposed of as above. **Sd/-** ## **A.MUHAMED MUSTAQUE** ## **JUDGE** 25/09/2020 [ WP(C).10500/2019, WP(C).33027/2018 ] 7 ## **APPENDIX OF WP(C) 10500/2019** ## **PETITIONER'S EXHIBITS:** **EXHIBIT P1 TRUE COPY OF THE BUILDING PERMIT BEARING NO.
