Case Synopsis & Summary

The writ petition, filed by Saji Andrews, seeks mandamus to the Joint Regional Transport Officer to accept an application for renewal of Ext.P2 contract carriage permit without requiring a No-Objection Certificate from the financier (2nd respondent). The vehicle, a contract carriage bus KL-33/E-8794, had a permit valid until 28.11.2018. The petitioner relies on Article 226 of the Constitution and the principles laid down in Shabu Sukumaran v. RTO, TVM and others (2018 (2) KHC 470), which hold that under Section 51(8) of the Motor Vehicles Act, 1988 the registered owner must provide the financier’s certificate or a declaration if no communication has been received within seven days, and that the financier’s objections do not automatically bar renewal; the registering authority must afford an opportunity of hearing and decide in light of any objections. The petitioner produced Ext.P6 (postal receipt) evidencing dispatch of Ext.P3 (NOC request) and Ext.P4 (declaration under Section 51(8)). The Government Pleader maintains renewal depends on obtaining the NOC or a communication from the financier. The Court disposed of the petition with directions: file a renewal application within two weeks with prescribed documents; if in order and fees paid, the 1st respondent shall consider and pass orders after hearing both sides, within six weeks. The judgment emphasizes balancing statutory requirements with the financier’s concerns and due process.
