Case Synopsis & Summary

This Bail Application before Justice C.S. Dias concerns the sole accused in Crime No. 3/2024 of the Kottarakkara Excise Range Office, Kollam, charged under Section 55(i) of the Kerala Abkari Act for illegal sale of three litres of Indian Made Foreign Liquor and possession of Rs 500 in sale proceeds. Arrested on 11 January 2024, the petitioner seeks bail under Section 439 CrPC, arguing innocence, false implication, completed investigation, and absence of criminal antecedents; recovery has already been effected, and continued detention is argued to be unnecessary. The Public Prosecutor concedes the detention period but opposes bail on the gravity of the offence and potential public policy implications; she notes the investigation is practically complete. After careful consideration, the judge finds that the detention since 11 January 2024, the completed investigation, the absence of antecedents, and the recovery made justify bail. Accordingly, the court allows the bail application, directing the petitioner to furnish a bond of Rs 50,000 with two solvent sureties, and to comply with conditions including weekly appearances before the Investigating Officer for two months or until the final report is filed, refraining from any inducement or tampering, and surrendering any passport. The order permits investigation and recoveries to continue under the IO’s supervision, in line with Supreme Court guidance. An annexure records the order of the Judicial First Class Magistrate Court No.I, Kottarakkara dated 12.02.2024.
