Case Synopsis & Summary
The petitioner, Sabeer K.S., challenges the Kerala Public Service Commission (PSC) for not advising him against 15 Non Joining Duty (NJD) vacancies for the post of Mechanic in the Kerala Agro Machinery Corporation Ltd. (KAMCO). He was included in the Supplementary List and contends that, being a Muslim candidate eligible under rotation and reservation principles, PSC should have advised him to one of the NJD vacancies. PSC counters that a total of 233 candidates were advised; Abdul Karim (Muslim, rank 10 in Supplementary List) relinquished his claim, leaving rank No.200 in the Main List as the last advised, and that NJD vacancies reported by KAMCO on 13.03.2019 were filled in sequence. The petitioner argues that the Main Rank List did not expire and that the Supplementary List retains rights to advise; he even relinquished his claim for appointment but seeks either admission to an NJD vacancy or appointment in the vacancy corresponding to rank No.11. The court notes that according to Supreme Court jurisprudence, when the last person in the Main List is advised, the Rank List expires, and those on the Supplementary List have no right to further advices. It finds rank No.200 had already been advised and, with the NJD vacancies filled and four Open Competition turns pending, the petition lacks merit. The writ petition is dismissed. It is so ordered by Judge Devan Ramachandran.
Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner argues that despite his inclusion in the Supplementary List, he was not advised to any of the 15 NJD vacancies that were reported by the Managing Director of KAMCO. He asserts that as a Muslim candidate eligible under rotation and reservation, PSC ought to have advised him to one NJD vacancy and contends that the Main Rank List’s apparent expiry should not bar relief. He seeks to be advised to any NJD vacancy or to the vacancy corresponding to rank No.11, since he has relinquished his claim to appointment in the Main List.
Contentions of Respondents
The PSC submits that 233 candidates were advised, and that Abdul Karim (rank 10 in the Supplementary List, Muslim) relinquished his claim, leading to the deletion of his name. Only rank No.200 remained in the Main List to be advised; 15 NJD vacancies were reported on 13.03.2019. Two Supplementary List candidates were advised, and the 3rd (Open Competition) vacancy was filled by the person at rank 200. Therefore, once the last main-list candidate was advised, the Rank List expired, and Supplementary List candidates lost entitlement to further advices. Four Open Competition turns remain but cannot be filled as there is no one left in the Main List. The court should not compel more advices contrary to this position; the petition is devoid of merit.
