Case Synopsis & Summary

The Kerala High Court, in S.A. No. 840 of 1997, heard a second appeal by Defendants 6, 8–12 and the legal representatives of the deceased seventh defendant, challenging a partition decree in a suit for partition relating to a family property originally owned by Cheeru. The suit property was claimed to have been orally leased to Pokkan and Kannan, who were in joint possession. The trial court dismissed, holding Kannan as exclusive tenant. On appeal, the appellate court held Pokkan and Kannan to be joint tenants and decreed partition in their favour as legal representatives of Pokkan and Kannan. The appellants argued that the plaintiffs failed to lead evidence; relied on rent receipts (Exts B1–B5) and Ext B8 (Land Acquisition), and pointed to Ext B7 (a partition deed) to show exclusivity. They also invoked Vidhyadhar v. Manikrao for presumption against non-appearance in court. The respondents argued that Ext A1 shows a joint tenancy admission by Kannan; Ext A2 corroborates this; Raman v. Somanathayyan was cited to show that partition deeds cannot preclude existing rights. The High Court, applying Raman and distinguishing Vidhyadhar, held that admitted documents show joint tenancy and that Ext B7’s partition statements do not negate remaining joint rights. The court found no merit in the second appeal and dismissed it, upholding the partition decree.

Provisions of Law Cited

Order 41 Rule 27 of the Code of Civil ProcedureSection 58 of the Indian Evidence Act, 1872Section 114 of the Indian Evidence Act, 1872

Legal Doctrines & Maxims

  • Presumption against a party who does not enter the witness-box (Vidhyadhar v. Manikrao)
  • Right in immovable property can be lost only by transfer inter vivos, or by adverse possession and prescription (Raman v. Somanathayyan)
  • A partition deed stating that no other properties remained to be partitioned does not conclusively negate the existence of other properties (Raman v. Somanathayyan)
  • Admitted documents need not be proved under Section 58 of the Indian Evidence Act, 1872

Submissions & Arguments

Contentions of Appellants / Petitioners

The appellants argued that the suit property, alleged to be held by Pokkan and Kannan under an oral lease, shows via Ext A1 that Kannan admitted only a half-right in the property; Ext A2 (landlord's objection) does not refute joint tenancy. They relied on Ext B7 partition deed to claim exclusivity and contended lack of oral evidence should render the plaintiffs' case suspect per Vidhyadhar. They also invoked rent receipts (Exts B1–B5) and B8 as support for exclusive tenancy and argued some properties were partitioned in Ext B7.

Contentions of Respondents

Respondents contended that Ext A1 and Ext A2 establish joint tenancy by Pokkan and Kannan; the contention that B7 proves exclusive tenancy fails since partition deeds cannot negate surviving rights; Raman v. Somanathayyan supports the view that partition deeds cannot preclude other properties; admitted documents need not be proved under Section 58 of the Evidence Act; the appellate court's conclusion on joint tenancy should be affirmed.

No.840 of 1997** -------------------------------------------------- ## **Dated this the 25[th] day of July, 2018** ## **JUDGMENT** Defendants 6, 8 to 12 and legal representatives of the deceased seventh defendant, are the appellants in the second appeal. 2. The suit was one for partition. There is only one item of property involved in the suit. There is no dispute between the parties to the fact that the suit property originally belonged to Cheeru. The case of the plaintiffs is that Cheeru entrusted the suit property by way of oral lease to Pokkan and Kannan and they were accordingly in joint possession of the property. Kannan is the son of Pokkan. Pokkan and Kannan are no more. The plaintiffs, defendants 1 to 4, Kannan and another person namely Pokkinan were the children of Pokkan. S.A.No.840 of 1997 : 2 : Defendants 5 to 12 are the legal representatives of Kannan and defendants 13 to 16 are the legal representatives of Pokkinan. Defendants 17 to 19 are the assignees of the property from some of the defendants. The relief claimed in the suit was for partition of the share of the plaintiffs in the suit property in their capacity as the legal representatives of Pokkan. Defendants 5 and 6 to 12 filed separate written statements. The stand taken by the said defendants in the written statement is that the suit property was one exclusively held by Kannan as lessee; that Pokkan had no right in the property and that the plaintiffs have, therefore, no right in the property. The defendants 2, 3, 4, 13 and 16 filed written statement supporting the stand taken by defendants 5 to 12. There was no oral evidence on the side of the plaintiffs. Instead, the document produced on the side of the plaintiffs was admitted in evidence as Ext.A1. The fifth defendant gave evidence on behalf of the contesting S.A.No.840 of 1997 : 3 : defendants as DW1. The documents produced by the contesting defendants have been admitted in evidence as Exts.B1 to B10. The trial court dismissed the suit holding that Kannan was the tenant of the suit property and that the plaintiffs have, therefore, no right in the property. The plaintiffs took up the matter in appeal. In the appeal, two additional documents were produced by the plaintiffs along with an application under Order 41 of Rule 27 of the Code of Civil Procedure. Though an objection was filed by the contesting defendants to the said interlocutory application, the genuineness of the document was not disputed. Consequently, the said documents have been accepted in evidence by the appellate court and marked as Exts.A2 and A3. Later, on a re-appraisal of the materials on record, the appellate court came to the conclusion that the suit property was held on lease jointly by Pokkan and Kannan and consequently passed a decree for partition as prayed for by the plaintiffs. The S.A.No.840 of 1997 : 4 : defendants 6, 8 to 12 and legal representatives of the deceased seventh defendant are aggrieved by the said decision of the appellate court. Hence the second appeal. 3. Heard the learned counsel for the appellants as also the learned counsel for respondents 1 to 3 and respondents 46 to 49. 4. The learned counsel for the appellants attacked the impugned judgment on several grounds. It was contended by the learned counsel that it is a case where the plaintiffs have not mounted the box to give evidence in support of the case set out by them and the suit, in the circumstances, ought to have been dismissed on that sole ground. The learned counsel placed reliance on the decision of this court in _**Vidhyadhar** v._ _**Manikrao**_ [(1999) 3 SCC 573], in support of the said contention. It was also contended by the learned counsel that defendants 2 to 4 who are also children of Pokkan have filed a written statement admitting that Kannan was the S.A.No.840 of 1997 : 5 : exclusive tenant of the property. It was also contended by the learned counsel that no documents whatsoever has been produced by the plaintiffs to show that Pokkan and Kannan were the tenants of the property and that documents have been produced on behalf of the contesting defendants showing that Kannan was the tenant of the property. The learned counsel has placed reliance on Exts.B1 to B5 rent receipts, in support of the said contention. The learned counsel also contended that a portion of the suit property has been acquired for the purpose of a road and the compensation for the same has been given to Kannan in his capacity as the owner of the property. Ext.B8 proceedings of the competent authority under the Land Acquisition Act was relied on in support of the said contention. In addition, it was contended by the learned counsel that there was a partition in the family of Pokkan evidenced by Ext.B7 in which plaintiffs are also parties, partitioning the properties originally held by S.A.No.840 of 1997 : 6 : Pokkkan and his wife and the suit property is not the subject matter of the said partition deed. It was pointed out that there is a recital also in the said partition deed to the effect that no property of Pokkan and his wife are left out from the said partition. The following is the passage contained in Ext.B7, on the basis of which the aforesaid contention was raised: “ നമളട അമ വഴയയ അചൻ വഴയയ നമൾക സദച വസകടള സബനച മറ നമൾ മലള എല! അവകശകര%ങള ഇനൽ )രകയ ഇപ+കര ഭഗച ഓഹര ടകണ നമൾ +രസ+ര .” 1പട3കയ ട4യ According to the learned counsel, in so far as the suit property is not included in Ext. B7 partition deed and in so far as it is recited in Ext. B7 that no property of Pokkan is left out from the said partition, it has to be presumed that the same is not the one originally held by Pokkan as claimed by the plaintiffs. According to the learned counsel, the appellate court has not adverted to the aforesaid aspects of the matter while rendering the S.A.No.840 of 1997 : 7 : ## impugned judgement. 5. Per contra, the learned counsel for the contesting respondents submitted that Ext.A1 is a joint application preferred by Pokkan and Kannan before the Rent Court, Vatakara for fixation of rent in respect of the leasehold. According to the learned counsel, the said document contains an admission made by Kannan that he is holding only ½ right in the property. It was also contended by the learned counsel for the contesting respondents that in Ext.A2 objection filed by Cheeru, the landlord, the case set out by Pokkan and Kannan in Ext. A1 application has not been refuted and that the objection is filed as if both of them were holding tenancy rights over the property jointly. As regards the contention raised by the learned counsel for the appellants based on Ext. B7 partition deed, it was argued by the learned counsel that merely for the reason that it is stated in the said partition deed that no other property is left out to be S.A.No.840 of 1997 : 8 : partitioned, it cannot be contended that no properties are left out from partition. The learned counsel placed reliance on the decision of this Court in **R** _**aman v. Somanathayyan**_ [1973 KLT S.N. Page No.32] in support of the said contention. 6. I have considered the rival contentions of the parties. 7. Exts. B1 to B5 are the rent receipts issued to Kannan by the landlord in respect of the suit property. These documents are not disputed by the contesting respondents. It has come out on record that Pokkan died during 1956. Exts.B1 to B5 are the rent receipts issued long after the death of the Pokkan. From the rent receipts issued by the landlord in favour of one of the tenants after the death of the other, it cannot be inferred that the tenant shown in the rent receipts is the sole tenant of the property. Likewise Ext.B8 document produced by the contesting defendants indicates that S.A.No.840 of 1997 : 9 : compensation in respect of the portion of the property acquired for widening the road has been received by Kannan. This is also a proceedings issued after the death of Pokkan and as such, merely for the reason that Kannan had received compensation for the acquired land on the strength of the oral lease, it cannot be inferred that he was the exclusive tenant of the property. In **Raman** (supra), in an identical case, it was clarified by this court that the right possessed by a person over an item of immovable property can be lost only by transfer inter vivos, or by adverse possession and limitation and a mere statement in the document of partition that no other properties remained to be partitioned, will not lead to an inference that no other properties remained to be partitioned, if there exists in reality other properties of the common ancestor which have not been partitioned. The arguments of the learned counsel for the appellants based on Ext.B7, therefore, fails. The contention raised by S.A.No.840 of 1997 : 10 : the learned counsel for the appellants that some of the children of Pokkan have supported the case of the contesting defendants is also not of any substance. If Pokkan was also the tenant of the property as a matter of fact, merely for the reason that some of the children of Pokkan have stated that Kannan was the exclusive tenant of the property, the remaining children of Pokkan are not precluded from contending that Pokkan was also the tenant of the property. 8. As noted, Ext.A1 is an application jointly preferred by Kannan and Pokkan for fixation of the rent in respect of the leasehold. This is a document admitted by the contesting defendants. Both Kannan and Pokkan have signed on the said application. As rightly contended by the learned counsel for the respondents, Ext.A1 contains an admission from Kannan that he has only one half right in the suit property. When Kannan admits that he has only one half right in the suit property in the statutory S.A.No.840 of 1997 : 11 : proceedings for fixation of the rent along with other tenant, according to me, his legal representatives are precluded from contending that Kannan was the exclusive tenant of the property. The said fact is reinforced by the statement contained in Ext.A2. Ext.A2 is the objection filed by the landlord in Ext.A1 proceedings. The landlord does not have a case in Ext.A2 that Kannan alone was the tenant and Pokkan has nothing to do with the oral lease referred to therein. The landlord being the most competent person to say as to who is a tenant, according to me, the factual conclusion arrived at by the appellate court that Pokkan and Kannan were joint tenants of the property cannot be faulted. 9. The learned counsel for the appellants placed reliance on paragraph 17 of the judgment of the Apex Court in _**Vidhyadhar**_ (supra) to contend that want of oral evidence on the side of the plaintiffs is fatal to their case. Paragraph 17 reads thus: S.A.No.840 of 1997 : 12 : “ **17.** Where a party to the suit does not appear in the witnessbox and states his own case on oath and does not offer himself to be cross-examined by the other side, a presumption would arise that the case set up by him is not correct as has been held in a series of decisions passed by various High Courts and the Privy Council beginning from the decision in _Sardar Gurbakhsh Singh_ v. _Gurdial Singh_[1] ~~.~~ This was followed by the Lahore High Court in _Kirpa Singh_ v. _Ajaipal Singh_[2] and the Bombay High Court in _Martand Pandharinath Chaudhari_ v. _Radhabai Krishnarao Deshmukh_[3] ~~.~~ The Madhya Pradesh High Court in _Gulla Kharagjit Carpenter_ v. _Narsingh Nandkishore Rawat_[4] also followed the Privy Council decision in _Sardar Gurbakhsh Singh case_[1] ~~.~~ The Allahabad High Court in _Arjun Singh_ v. _Virendra Nath_[5] held that if a party abstains from entering the witness-box, it would give rise to an adverse inference against him. Similarly, a Division Bench of the Punjab and Haryana High Court in _Bhagwan Dass_ v. _Bhishan Chand_[6] drew a presumption under Section 114 of the Evidence Act, 1872 against a party who did not enter the witness-box.” The extracted paragraph of the judgment of the Apex Court referred to above only indicates that if there is no formal evidence on the side of the plaintiffs, there can be a presumption that the case set up by the plaintiffs is S.A.No.840 of 1997 : 13 : incorrect. Insofar as it is established, based on admitted documents which need not be proved in the light of Section 58 of the Evidence Act, that Pokkan was also one of the tenants in the property, I do not think that the aforesaid judgment would come to the aid of the appellants. In the said view of the mater, I do not find any merit in the second appeal and the same is accordingly, dismissed. **sd/P.B. SURESH KUMAR, JUDGE** SKS
