Case Synopsis & Summary

This is a consolidated review petition proceeding before the Kerala High Court relating to the Travancore Devaswom Board’s failure to implement a 2012 order (DBP No.5 of 2012) directing the constitution of a Temple Advisory Committee for Thrichattukulam Sree Mahadeva Temple and a related Ombudsman report (DBP No.80 of 2022) on non-compliance. The petitioners, two officers of the Travancore Devaswom Board (Assistant Devaswom Commissioner and Sub Group Officer), seek review of the 2012 order and seek directions consistent with bye‑laws and statutory provisions under Section 31A of the Travancore Devaswom Board Act. The court surveys the statutory framework—Section 31A and the bye-law rules (Clauses 2, 3, 9, 11, 12, 18, 21) framed under it—and binds the temple governance to a system whereby Temple Advisory Committees must reflect representation from three Karayogams and local Hindu denominations, with election from the registered mandalam. It cites Santharam Roy TS, Sunil Kumar C., Chandu K., Major Vellayani, and Rajalekshmi P. to interpret membership, term limits (two years with possible extension), and the duty to supervise committee activities. The Court ultimately disposes of RP 719/2023 by directing modifications to Clause 3 of the bye-laws to protect Karayogam and local-denomination rights and orders elections within tight timeframes, while DBP No.80/2022 is disposed in line with these directions.

Provisions of Law Cited

Section 31A of the Travancore Cochin Hindu Religious Institutions Act (as applicable to TD Board)Temple Advisory Committee Rules (bye-laws) framed under sub-section (3) of Section 31A: Clauses (2), (3), (9), (11), (12), (18), (21)

Legal Doctrines & Maxims

  • Cordiality in Hindu Society has to prevail (as stated in the 2012 order directing the Temple Advisory Committee)
  • Temple Advisory Committee is statutory under Section 31A and its membership/duties are governed by bye-laws
  • Two-year term for Temple Advisory Committee with possible extensions (one year or two years in specific cases) but not beyond two years
  • Development/renovation works within the purview of Temple Advisory Committees and must be undertaken through the Committee under Board supervision
  • Membership in ‘registered mandalam’ is primarily for local devotees within 5 km of the temple; election from registered mandalam in meetings convened by the Assistant Commissioner (Group) under the Rules

Submissions & Arguments

Contentions of Appellants / Petitioners

The applicants (review petitioners) contend that the 2012 order (DBP No.5/2012) ought to be reviewed and the Temple Advisory Committee’s membership must be redefined in line with bye-laws, ensuring representation for the three Karayogams and other Hindu denominations; they also seek expedited elections and compliance with statutory provisions. They rely on the Act’s Section 31A and the Rules’ clauses to argue for a constitution that protects traditional rights and ensures functioning under Board supervision.

Contentions of Respondents

The respondents argue that the Temple Advisory Committee is statutory, with membership determined by 31A and the bye-laws; they emphasize adherence to the Rules (especially clauses on membership, office bearers, term, funding controls, and prohibitions) and the need for elections and supervision by officers under the Board. They rely on precedents such as Chandu K., Major Vellayani, Sunil Kumar C., and Santharam Roy TS to justify operations within the statutory framework and to support Board authority over temple development and committee functioning.

The order of this Court dated 13.06.2012, in DBP No.5 of 2012 reads thus; “Heard the learned counsel for the complainant and for the respondents which are the three NSS Karayogams. We are in complete agreement with the suggestion of the learned Ombudsman that cordiality in Hindu Society has to prevail and therefore it would be appropriate to have a Temple Advisory Committee constituted with people of different denominations from among the Hindus being involved. In fact, the local people would obviously be thankful to the NSS Karayogam for having taken care of the affairs of the temple RP No.719 of 2023 in DBP No.5 of 2012 & con.case **==> picture [22 x 9] intentionally omitted <==** to the extent they have done as is reflected in the report of the learned Ombudsman. We therefore, direct the Travancore Devaswom Board to treat this as a special situation in connection with the constitution of Temple Advisory Committee and thereby constitute a Temple Advisory Committee comprising of the representatives of the three Karayogams and members of the local public representing different denominations among Hindus. The manner in which the festivals will be conducted by distributing the days etc., will be done in the best interest of the temple, also taking into consideration the practice followed until now. This means that the Karayogams will have the right to conduct the festival for three days and the remaining five days to be conducted appropriately by the Temple Advisory Committee. Ultimately, all limbs of the Hindu Society would treat this opportunity to nurture cordiality in the society. We also record the submission on behalf of the Karayogams that hereafter funds would be collected for the purpose of the temple festivals only utilising sealed receipts issued by the competent authority of the TDB. In so far as the ornaments adorned by the Deity are concerned, the Board will take appropriate decisions. If further clarificatory orders are necessary, the parties will be entitled to move with interlocutory applications in this matter.” (Underline supplied) 5. In **Sunil Kumar C. and others v. Travancore Devaswom Board and others [2022 (4) KHC 663]** a Division Bench of this Court in which one among us [Anil K. It would certainly be open to the Travancore Devaswom Board to undertake such construction, repair or renovation work in a temple, directly by its Maramath Department. However, when the Board has chosen to undertake such construction or repair or renovation work in a temple through a committee, under the supervision of the officials in Maramath Department, it has to be undertaken through the Temple Advisory Committee constituted under Section 31A of the Act, under constant supervision and scrutiny by the concerned officers of the 1[st] respondent Board, in order to ensure that the activities of the committee is in compliance with the directions issued by the Board. When the provisions under Section 31A of the Act contemplates constitution of a Temple Advisory Committee in the temples under the management of the Board, which is assigned with various duties as per the Rules, which includes undertaking various developmental activities in the temple, the normal rule is that any developmental activity in a temple, which is not undertaken directly by the 1[st] respondent Board through its officials in the Maramath Department, has to be undertaken through the Temple Advisory Committee. In **Chandu K. v. Travancore Devaswom Board [2021 (3) KHC 379]** a Division Bench of this Court held that, with the insertion of Section 31A to the Travancore Cochin Hindu Religious Institutions Act the formation of Temple Advisory Committees in temples has become statutory. In the said decision, the Division Bench noticed that the Travancore Devaswom Board, in exercise of the rule making power under clause (a) of subsection (2) of Section 35 of the Act, has framed rules for the formation of Temple Advisory Committees in temples under the Travancore Devaswom Board and this Court has approved the draft bye-laws by the order dated 03.11.2011 in DBA No. 153 of 2009. Clause (11) of the Rules deals with the term of office of the Temple Advisory Committee. As per Clause (11), the term of office of the Temple Advisory Committee shall be two years from the date of approval of the election by the Devaswom Commissioner. The Devaswom Commissioner has the authority to extend the term of the committee by one year in case of development works or unavoidable rituals in the temple. The Board will have the power to extend the term by a further period of one year. The term shall not to be extended beyond the period of two years. Thus, the term of the committees is statutorily fixed. The term can be extended RP No.719 of 2023 in DBP No.5 of 2012 & con.case **==> picture [28 x 9] intentionally omitted <==** by one year or up to two years under certain unavoidable circumstances and no longer. The object of providing duration of office of Temple Advisory Committees in the approved bye-laws is to see that timely elections are held and the constitution of the Committees are not delayed. The power of the Devaswom Commissioner or the Board to extend the term of the Temple Advisory Committee, which is fixed as per the approved bye-laws, shall not be exercised as a matter of course. They shall call for report regarding the developmental work going on in the temple concerned or the unavoidable rituals to be carried out in the temple concerned and apply their mind to the materials and form a decision as to whether extension of term has to be given or not. 19. As per Clause (21) of the Rules, in case there is practical difficulties in constituting a Temple Advisory committee in a temple, the Devaswom Commissioner shall have the power to decide, with the approval of the Board, not to constitute a Temple Advisory Committee in that temple. In special circumstances, the Board shall have the power to approve any other Samithi functioning in the Devaswoms as the Temple Advisory Committees RP No.719 of 2023 in DBP No.5 of 2012 & con.case ..23.. of that temple. 25. In **Sunil Kumar C. [2022 (4) KHC 663]** , a Division Bench of this Court noticed that a reading of the provisions under Clause (21) of the Rules make it explicitly clear that the said provisions can be invoked only in the case of a temple in which there is any practical difficulty for the formation of a Temple Advisory Committee, in which event, the 1[st] respondent Board is vested with the power to approve any other committee functioning in that temple, considering the special circumstances prevailing in that temple. The provisions under Clause (21) would not enable the Travancore Devaswom Board or the Commissioner to approve an Ad-hoc Committee, in the place of a Temple Advisory Committee, for the purpose of undertaking construction or repair or renovation work in a temple. ## 26. In **Major Vellayani Devi Temple Advisory** **Committee v. State of Kerala [2023 (2) KHC 290]** a Division Bench of this Court in which one among us [Anil K. Narendran, J] was a party held that in view of the provisions of the TravancoreCochin Hindu Religious Institutions Act, the Travancore Devaswom Board is duty bound to see that the regular traditional rites and ceremonies according to the practice prevalent in Vellayani Bhadrakali Devi Temple are performed promptly; and to establish RP No.719 of 2023 in DBP No.5 of 2012 & con.case ..24.. and maintain proper facilities in Vellayani Bhadrakali Devi Temple for the devotees. Subject to the provisions of Part I of the Act and the Rules made thereunder, the Board shall manage the properties and affairs of Vellayani Devaswom and arrange for the conduct of the daily worship and ceremonies and of the festivals in Vellayani Bhadrakali Devi Temple according to the usage. The Temple Advisory Committee of a temple under the management of the Travancore Devaswom Board, which consists of devotees who fall under the eligibility criteria prescribed in Clause (3) of the Rules framed under sub-section (3) of Section 31A of the Act, is duty bound to render necessary assistance to the Board and its officials for the smooth functioning of the temple activities and festivals according to the usage. 27. The law laid down in **Major Vellayani Devi Temple Advisory Committee [2023 (2) KHC 290]** was reiterated in **Rajalekshmi P. v. State of Kerala [2023 (3) KHC 491]** . 28. The learned counsel for respondents 5 and 6 in R.P.No.719 of 2023 would submit that till 2018, the Temple Advisory Committee in Thrichattukulam Sree Mahadeva Temple was consisting of three members form the Karayogams, two Ex- Officio members and nine members as representatives of devotees. For reasons best known to the Travancore Devaswom RP No.719 of 2023 in DBP No.5 of 2012 & con.case ..25.. Board, after 2018 no Temple Advisory Committee has been constituted in Thrichattukulam Sree Mahadeva Temple. 29. The direction contained in the order of this Court dated 13.06.2012 in DBP No.5 of 2012 is for constitution of the Temple Advisory Committee of Thrichattukulam Sree Mahadeva Temple, comprising of the representatives of three Karayogams and members of local public representing different denominations among Hindus. In the said order it was made clear that the manner in which the festivals will have to be conducted by distributing the days, etc., will be done in the best interest of the temple and also taking into consideration the practice followed until now. 30. In view of the provisions under sub-section (3) of Section 31A of the Act the composition of a Temple Advisory Committee under sub-section (1) shall be in such manner as may be prescribed as the Rules made by the Board, not inconsistent with any practice, prevailing, if any. Therefore, while constituting a Temple Advisory Committee of Thrichattukulam Sree Mahadeva Temple, in terms of the directions contained in the order of this Court dated 13.06.2012 in DBP No.5 of 2012 the Travancore Devaswom Board has to make specific provision in the Rules (bye- laws) framed under sub-section (3) of Section 31A of the Act, RP No.719 of 2023 in DBP No.5 of 2012 & con.case **==> picture [28 x 9] intentionally omitted <==** regarding membership, in order to protect the right of the representatives of three Karayogams and the members of the local public representing different denominations among Hindu. The entire activities of that Temple Advisory Committee shall be governed by the provisions under the Rules (bye-laws), i.e., Clause (9), which deals with office bearers and their duties, Clause (11), which deals with term of office, Clause (18), which deals with prohibitions and other Clauses in that Rules (bye-laws). Clause (3) of the Rules (bye-laws), which deals with membership, alone requires modification, for making specific provision regarding membership of the Temple Advisory Committee, in view of the provisions under sub-section (3) of Section 31A of the Act. In the result, R.P.No.719 of 2023 is disposed of by modifying the order of this Court dated 13.06.2012 in DBP No.5 of 2012 to the extent indicated above. The Travancore Devaswom Board is directed to make specific provisions regarding membership in the Temple Advisory Committee of Thrichattukulam Sree Mahadeva Temple, in modification of the provisions contained in Clause (3) of the Rules (bye-laws) framed under sub-section (3) of Section 31A of the Act, in order to protect the right of the representatives of three Karayogams and the members of the local public representing different denominations among Hindu, as RP No.719 of 2023 in DBP No.5 of 2012 & con.case **==> picture [28 x 9] intentionally omitted <==** expeditiously as possible, at any rate within a period of one month from the date of receipt of a certified copy of this order.
