Case Synopsis & Summary

The Kerala High Court, Ernakulam, in Crl.M.C. No. 10677 of 2023, disposed by a single-judge bench of Justice Bechu Kurian Thomas on 31 January 2024, addressing a petition under Section 482 Cr.P.C to quash proceedings in CC No.142/2023 arising from Crime No.471/CR/EOW III/KKD/11 of CBCID Kozhikode. The petitioners, accused Nos. 1-6, 9-23 and 26-39, faced offences including Section 420 IPC and Sections 3 and 4 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978. The respondents included the State (Public Prosecutor) and defacto complainants. The petitioners contended that the dispute had been amicably settled, and continued prosecution would serve no public interest. The respondents supported the prayer, filing affidavits (Annexures II-VIII) asserting genuineness of the settlement, with the deponents standing by the terms. Relying on Supreme Court rulings in Gian Singh, Narinder Singh, and Yogendra Yadav, the court noted that amicable resolutions can justify quashing in appropriate cases. After perusal, the judge held the settlement genuine and concluded no public interest remained to justify continuation, quashing all proceedings in CC No.142/2023 and allowing the Crl.M.C. The order is accompanied by annexures and closing remarks on the matter.

Provisions of Law Cited

Cr.P.C. Section 482Indian Penal Code, 1860 Section 420Prize Chits and Money Circulation Schemes (Banning) Act, 1978 Sections 3 and 4

Legal Doctrines & Maxims

  • Inherent power of High Court under Cr.P.C. 482 to quash criminal proceedings.
  • Amicable settlement as a ground for quashing criminal proceedings (Gian Singh v. State of Punjab and Another; Narinder Singh and Others v. State of Punjab and Another; Yogendra Yadav and Others v. State of Jharkhand and Another)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners argued that the matter has been settled and continuing the proceedings would be futile given the nature of the offences; thus, quashing under Section 482 Cr.P.C. is warranted to prevent futility and unnecessary public expenditure.

Contentions of Respondents

The respondents conveyed that affidavits (Annexures II–VIII) are genuine and the deponents stand by the settlement; no public interest would be served by continuing the prosecution; the court should consider quashing in light of the settlement.

Crl.M.C. No.10677 of 2023 …................................................ Dated this the 31[st] day of January, 2024 ## ORDER Petitioners have invoked the jurisdiction under Section 482 Cr.P.C to quash all proceedings against them. 2. Petitioners are accused Nos.1 to 6, 9 to 23 and 26 to 39 in C.C.No.142/2023 on the files of the Chief Judicial Magistrate’s Court, Kalpetta arising out of Crime No.471/CR/EOW III/KKD/11 of CBCID Kozhikode, registered for the offences punishable under Section 420 of the Indian Penal Code, 1860 apart from Sections 3, and 4 of Prize Chits and Money Circulation Schemes (Banning) Act, 1978. Respondents 3 to 9 are the defacto complainants. 3. According to the prosecution, accused had collected an amount of Rs.34,940/- from the defacto complainants with a promise to provide them with a good return on the investments and thereafter failed to return the principal amount nor the interest, and thereby committed the offences alleged. ``` CRL.MC NO. 10677 OF 2023 ``` ``` 7 ``` 4. Heard the learned counsel for the petitioners and the learned counsel for the respondents, apart from the learned Public Prosecutor. 5. The learned counsel for the petitioners submitted that the matter has been settled and hence the proceedings against the petitioners ought to be quashed. It was also submitted that, considering the nature of offences alleged, no purpose would be served by continuing the proceedings. 6. In Gian Singh v. State of Punjab and Another [(2012) 10 SCC 303], the Apex Court has held that in appropriate cases, the High Court can take note of the amicable resolution of disputes between the victim and the wrongdoer to put an end to the criminal proceedings. This view was reiterated in Narinder Singh - and Others v. State of Punjab and Another [(2014) 6 SCC 466] and Yogendra Yadav and Others v. State of Jharkhand and Another [(2014) 9 SCC 653]. 7. I have perused Annexure-II to Annexure-VIII affidavits filed by respondents 3 to 9. The learned Public Prosecutor has submitted that upon verification, it is understood that the affidavits are ``` CRL.MC NO. 10677 OF 2023 ``` ``` 8 ``` genuine, and the defacto complainant and the other deponents stand by the contents thereof. I am satisfied that the matter has been settled and no public interest is involved in this case. There is no impediment for granting the prayer for quashing. The continuance of the proceedings will only be an exercise in futility. 8. Accordingly, all proceedings against the petitioners in C.C.No.142/2023 on the files of the Chief Judicial Magistrate’s Court, Kalpetta are quashed. This Crl.M.C is allowed as above. sd/BECHU KURIAN THOMAS JUDGE AMV/31/01/2024 ``` CRL.MC NO. 10677 OF 2023 ``` ``` 9 ``` ## **`APPENDIX OF CRL.MC 10677/2023`** ``` PETITIONER ANNEXURES Annexure -ICERTIFIED COPY OF THE FINAL REPORT FILED BY THE CRIME BRANCH BEFORE THE CHIEF JUDICIAL MAGISTRATE'S COURT, KALPETTA IN CRIME NO. 471/CR/EOW III/KKD/11 ON 29-04- 2023 ALONG WITH WITNESS SCHEDULE Annexure -IIAFFIDAVIT OF THE 3RD RESPONDENT Annexure -IIIAFFIDAVIT OF THE 4TH RESPONDENT Annexure -IVAFFIDAVIT OF THE 5TH RESPONDENT Annexure -VAFFIDAVIT OF THE 6TH RESPONDENT Annexure -VIAFFIDAVIT OF THE 7TH RESPONDENT Annexure -VIIAFFIDAVIT OF THE 8TH RESPONDENT Annexure -VIIIAFFIDAVIT OF THE 9TH RESPONDENT Annexure -IXTRUE COPY OF THE ORDER DATED 18-09-2020 IN CRL.M.C.NO. 266/2020 Annexure-XTRUE COPY OF THE ORDER DATED 15-11-2023 IN CRL.M.C.NO. 8137/2023 ``` **TRUE COPY**
