Case Synopsis & Summary

This is a Criminal Miscellaneous Case (Crl.M.C. No. 5582 of 2022) before the High Court of Kerala at Ernakulam. The petitioners, accused Nos. 1 to 6 and 9 to 30 in Crime No. 457/CR/EOW III/KKD/11 of 2019 of the Crime Branch, seek quashing of the Final Report and all further proceedings in CC 152/2021 before the Chief Judicial Magistrate, Kalpetta. The respondents include the State of Kerala, the Detective Inspector of CBCID, EOW-III Kozhikode, and the victims/injured persons in the alleged Prize Chit and Money Circulation Schemes (Banning) Act offences (Sections 3 and 4 of the 1978 Act) and IPC Section 420 read with Section 34. The petition is supported by affidavits from the injured alleging a private dispute and no subsisting grievance, and the State Public Prosecutor confirms the settlement after verification by the SHO. The court notes that the dispute is private and, given the settlement, continued prosecution would likely be futile. Relying on Gian Singh v. State of Punjab and Another, the court invokes its power under Section 482 CrPC to quash. Accordingly, Annexure-I Final Report and all further proceedings in CC 152/2021 against the petitioners are quashed, effectively ending criminal proceedings against them in this matter.

Provisions of Law Cited

Prize Chit and Money Circulation Schemes (Banning) Act, 1978 - Sections 3 and 4Indian Penal Code, Section 420 read with Section 34Code of Criminal Procedure, Section 482

Legal Doctrines & Maxims

  • Gian Singh v. State of Punjab and Another [2012(4) KLT 108] - principle that the High Court may exercise jurisdiction under Section 482 CrPC to quash criminal proceedings in private disputes where continuance serves no useful purpose.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that the dispute was private and settled; affidavits from the injured persons indicate no subsisting grievance; SHO verified the settlement; given the private nature of the dispute, continuing proceedings would not serve any meaningful purpose, and the petitioners seek quashing under Section 482 CrPC in light of the settled position (Gian Singh).

Contentions of Respondents

The respondents acknowledge the settlement and, upon consideration of the affidavits and verifications, submit that continued prosecution would not serve the public interest where the dispute is essentially private and has been resolved.

CASE HAVING COME UP FOR ADMISSION ON 21.12.2022, THE COURT ON THE SAME DAY PASSED THE FOLLOWING:** 8 Crl.M.C No.5582 of 2022 ## **O R D E R** The petitioners are the accused Nos 1 to 6 and 9 to 30 in Crime No.457/CR/EOW III/KKD/11 of 2019 of Crime Branch which is now pending as C.C 152/2021 before the Chief Judicial Magistrate Court, Kalapetta. The offences alleged against the petitioners are punishable under Sections 3 and 4 of the Prize Chit and Money Circulation Schemes (Banning) Act 1978 and also under Section 420 read with Section 34 of Indian Penal Code. Annexure-I is the Final Report submitted by the Police. The respondent Nos. 3 to 17 are the victims of the Crime. This Crl.MC is filed for quashing all further proceedings pursuant to Annexure-I. 2. Heard Sri.P.Mohandas the learned counsel appearing for the petitioners, Smt. Sreeja V, the learned Public Prosecutor appearing for the State and Sri. K.K.Rajeev, the learned counsel appearing for the respondents 3 to 17. 3. The prayer for quashing the above proceedings is sought for by the petitioners on the ground that, the dispute 9 Crl.M.C No.5582 of 2022 between the parties has been settled and to substantiate the same, the injured persons have sworn Annexures-II to XVI affidavits respectively. The aforesaid affidavits indicate that, the matter has been settled and the injured persons have no subsisting grievance against the petitioners herein. They also conveyed that they have no objection in quashing the proceedings against the petitioners herein. The learned counsel for the respondents Nos.3 to 17/injured persons also confirmed the same. The learned Public Prosecutor upon instructions submitted that the veracity of the settlement was verified by the Station House officer concerned and before the SHO also, the injured persons have reiterated that, they do not have any objection in quashing the proceedings as they have no subsisting grievance against the petitioners herein. 4. Going through the materials available on record, it is discernible that, the dispute is basically private in nature and on account of settlement arrived at between the parties, no purpose would be served if the proceedings against the petitioners herein were allowed to continue. In such circumstances, the chances of a successful prosecution are very bleak. Therefore, I am of the view 10 Crl.M.C No.5582 of 2022 that going by the decision in **Gian Singh v. State of Punjab and Another [2012(4) KLT 108],** this is a fit case in which the powers of this Court under Section 482 of the Code of Criminal Procedure can be invoked. Accordingly, this Crl.M.C. is allowed. Annexure-I Final Report in Crime No.457/CR/EOW III/KKD/11 of 2019 of Crime Branch and all further proceedings in C.C.152/2021 pending before the Chief Judicial Magistrate Court, Kalapetta as against the petitioners who are the accused Nos 1 to 6 and 9 to 30 are hereby quashed.
